Radiolab episode on jury nullification is less bothered by state abuse of power than public desperation to fight back.

It should come as no surprise that public radio’s RADIOLAB would take government’s side against the growing grassroots effort to awaken citizens to the repressed potential of jury nullification. Any attention to the subject helps inform ordinary jurors of the power they have to stand up to the regular abuses of our judicial system. The benefit is tempered of course when liberal gatekeepers lean in with theatrics to fearmonger about anarchistic challenges to law and order and security. That’s exactly what Radiolab achieved though given plenty of material with which to have taken a more honest tack. Their program “Null and Void” aired May 12 and painted nullifiers as irrational extremists, giving a pass to the judges who purge juries and break the law by having nullifiers arrested.

I had high hopes when contacted by a producer for Radiolab in March. Our federal injunction protecting Denver jury nullification outreach efforts against an order by the Second Judicial District’s Chief Judge Michael Martinez was coming to trial in April. I imagined reporters would be sympathetic to our predicted success making our injunction permanent and the similar likeliness of our prevailing on contempt charges in a hearing which was to follow. I faciliated Radiolab’s access to Mark Iannicelli, who Denver arrested in violation of our injunction, and whose dismissed charges of felony tampering continue to be appealed by our legal adversaries. Thus far it’s a simple story of hoisting a chief justice on his own petard, using the justice system against itself, in defense of the people’s historical power as jurors.

Heicklen
But Radiolab had an alternate narrative in mind. Their story would center on a jury nullification champion who they could characterize as coming off the rails, the celebrated frequent arrestee Julian Heicklen. Septegenarian Heicklen became tired of judges warning him of arrest, despite his continued legal victories. By November 2016, Heicklen issued a manifesto of sorts, asking for armed backup to preempt a judge from making good on his renewed threat to arrest him. Heicklen posted this warning online and called it to everyone’s attention. Presumably it’s what drew Radiolab’s attention. Heicklen had put it out there, hoping to spark a John Brown-esque conflagration, I’d call it a bluff, meant to curtail the court’s continued abuse of power. It’s obvious from Heicklan’s hyperbole. I attach the significant excerpt in the notes below.

Radiolab didn’t reference this tract, nor mention their and the court’s foreknowledge of it. As they interviewed Heicklen, they asked him about his cause and even brought him to tears as he explained his distress about the injustice of the system, which continues to reinforce inequity and deny jurors their prerogative to step in its way. Then Radiolab prodded Heicklen to explain what he anticipated would happen when he showed up at the courthouse in defiance of the judge’s threat. On cue, Heicklen repeated his entreaty that supporters show up with guns to enforce his right to pass out fliers and avert the judge’s illegal threat to arrest him.

Many of us might share the elderly activist’s frustration with being habitually arrested then exhonerated, each time without apparent progress being made. Radiolab’s pretend reaction was to cue ominous silence, let the pin drop, cue indignant alarm, ostracize Heicklen, cue a spontaneous meting of Radiolab minds to elect to call the cops on Heicklen lest law enforcement personnel be shot.

Radiolab didn’t call the Chief Judge Frederick J. Lauten to question the irregularity of his repeating an illegal threat. How absolutely insane for a judge, already proven to be in the wrong, to keep asserting his authority to have a citizen falsely arrested?

When Heicklen showed up to the courthouse, with a friend, both without weapons of any kind, and without the backup support of “Tyranny Fighters” he’d hoped to mobilize, Heicklen was arrested for the more serious charges involving threats.

Radiolab may or may to have exacerbated Heicklen’s arrest. They certainly took credit for it, which is the least they could do for having exploited Heicklen as their straw man extremist.

Because Radiolab makes little effort to conceal their liberal bourgeois elitism. FIJA, the Fully Informed Jury Association was founded, according to Radiolab, in a Montana “bunghole”, which they qualify, they are entitled to call Helena, the capitol of Montana, because one of the show’s producers is from Montana.

Wolverine
You might ask, what’s Wolverine got to do with this? Anyone who’s read Ariel Dorfman knows better than to bring superheroes into political discourse. Radiolab didn’t know how better to distinguish between a citizen’s right, as proscribed by the Bill of Rights, and a power, something grown from common law. Whatever, they’re wrong. Juries are guaranteed by the sixth amendment, now commonly understood to be “a jury of your peers.”

Radiolab never uses that phrase, it’s too everyman. But they do riff ad nauseum on Wolverine, who’s a superhero with superpowers, namely CLAWS, which for Radiolab described this aberrant power that jury nullification advocates are promoting. The public as beast, and mutant power threatening elitists like a werewolf’s claws. Someone adds, as a further irrelevance, that Wolverine’s real superpower is regenerative, the power to heal but nevermind. They say that, and it’s the only trivia that actually does apply to jury nullification. Radiolab autistic savants.

They recorded Mark Iannicelli in front of the Denver courthouse, that was our single consolation!

It’s no surprise that Radiolab takes the government’s side against the public’s growing inclination to “burn it down.” Radiolab got great quotes from Mark, but chose to demonize other jury nullification pamphleteers who were so frustrated with being arrested that wanted to deter future arrests with guns.

By the show’s end, the white privileged NPR broadcasters feel more comfortable with the law in the hands of “unelected, white” judges over inexpert jurors described as “twelve random jerk-offs from the street.” They’re taking about your constitutionally protected jury of your peers.

Hopefully listeners will glean the great information offered by this piece and nullify Radiolabs’s privileged condescension.

None of them responded to my requests. A copy of your letter to Rick Scott dated October 13, 2016, was given to me. In your letter, you stateit is your intent to “distribute flyers regarding the duties of jurors and witnesses at criminal trials” at the Orange County Courthouse during th first week of December.” This letter is a reminder that such conduct continues to be proscribed on courthouse grounds under Administrative Order 2011-03 which governs expressive conduct taward summoned jurors. Enclosed is a copy of Adminiustrative Order 2011-03 for your perusal.

As you know, this Administrative Order is constituional as the Fifth District Court of appeal had “no difficulry upholding Administrative Order No. 2011–03 as reasonable, viewpoint neutral regulation….” Schmidter & Heicklen v. State, 103 So. 3d 2663,270 (Fla. 5th DCA 2012)(a copy of which is enclosed). This Court, as well as the Orange Cpounty Sheriff, qill enforce the provisions of Admionistrative Order No. 2011-03 to ensure the fair and orderly conduct of jury trials and to prevent dissruptions or interference with that basic right.

Based on the Administrative Order’s continuing validity, you may wish to reconsider your intended course of action and find alternative means in which to disseminate your message. If you intend on distributing materials to jurors, you will be issued a trespass notice and if you then remain on courthouse grounds, you could be arrested for trespass.

Unfortunately there seems to be a disagreement between the Florida court and the United States Federal Court. I was one of the appellants in the Florida case. The decision was based on lies and incorrect information introduced by the state attorneys. The judges should have know this, since I carefully pointed out the errors, but they did not care. They had made up their minds before hearing the case.

Previously I was arrested 5 times for distributing this literature at the the U. S. District Court in Manhattan, NY. I was arrested and charged with jury tampering. After 17 months of trial, Judge Kimba Wood declared that distributing this literature was not jury tampering because I did not discuss any case with a juror sitting on that trial. I was invited to Harvard University Law School to give a lecture on my case. Also I have been informed that my case is being taught to all students at Yale Law School. Presumably it is being taught elsewhere as well.

Currently I distribute the same flyers at both state and federal courthouses around the country. None of them arrest me. Three of these courthouses are state courthouses. They are in Fort Lauderdale, Fl; Pittsburgh, PA (last week); and Newark, NJ. The federal courthouses this year have been in Fort Lauderdale, FL; Newark, NJ; Manhattan, NY; Palo Alto, CA; Pittsburgh, PA (last week) and San Jose, CA; The state courthouses do not approach me. The federal courthouse Homeland Security officers at federal courts all threatened to arrest me until I told them to check it with a judge. They did, and none of them made an arrest.

December 5, 2016 will be a critical day in the history of the United States. I will appear at the Orange County Courthouse, 425 N. Orange Avenue, Orlando, FL and distribute “Nullification by Jury” flyers on the public sidewalk leading from the parking lot to the courthouse. I am asking all Tyranny fighters and anyone else to join me armed with loaded guns to shoot any courthouse employee or officer of the court (i.e. guards, Orlando police, State police, Sheriffs, or lawyers) that approach within 15 feet of me. One of 4 things can happen:

Neither the court personnel, the Tyranny Fighters, nor the press will appear. That will be the smoothest, but dullest, situation.

The Court officers only will appear and arrest me.

The Tyranny Fighters only will appear and protect me.

Both the Court officers and the Tyranny Fighters will appear. The gun battle for the return of a free country with a democratic republic will occur.

I am irrelevant. The future of the United States will be determined by the others or by you. Either we will continue the route to the gas chambers as described in the attached document, or we shall backtrack to a democratic republic. In either case I will have died by then.

If Walmart is going to halt labor unrest with punitive “plumbing problems” its workers could plumb the same depths

CementWalmart has reportedly closed a smattering of its stores across the country citing “plumbing problems”. The mega-retailer’s media cohorts are reporting the mystery but won’t say that the closures coincide with stores which have been hardest hit by labor unrest. It turns out, Walmart has opted to close its doors where employees have most successfully organized “Fight For Fifteen” actions. By suddenly closing the stores Walmart preempted further organizing and punished the upstarts by laying off all the store’s employees with only a few hours notice. Walmart claims the plumbing problems will take a half year to fix. I think what remains of Walmart’s workforce has been given a wonderful opportunity to retaliate in kind. What of these plumbing problems? Are Walmart’s other stores showing signs of plumbing problems too? Might a larger wave of plumbing problems be induced? I think Walmart’s union-busting advisors have loosed a weapon that will prove more consequential for Walmart than its wage-slave victims. Foisted on their own petard, I believe is the expression. Petard in this case is substituted by toilette. Walmart customers can even get in on the act, err, investigation, for free. Come to Walmart empty handed, find a bag of cement in the hardware aisle, proceed to the public bathroom, flush it presto plumbing problem. Citizen plumbers can turn this plumbing mystery into a plumbing thriller.

Does the western media commemorate de Gaulle’s message without an inkling of irony?

Of course, today’s occupied peoples cannot be offered the same assurance, that help is on its way. Until he saw their message. Which element was it that was too risqué for conservative Hooter Springs: the lettuce-clad bikini girl? The call to go vegan? Or the trashing of the Tea Partier’s staple for what’s for dinner?

I have my own qualms about Kucinich, he keeps the real Left sucked into concentric electoral circles. Activated voters who should be pushing for a third party are corralled by Kucinich types to hold their breath for the so-called party of the people to represent real people. I’d like to see Kucinich leave the Dems, and I’d like to see the Democrats fool enough to boot him of their own accord. They can’t quit Lieberman but they’d dump on Kucinich. Tapping into the nutrition of life energy

Chinese specialty, half-fried fishYes, it’s a live fish. The Youtube video upsetting PETA depicts Chinese diners poking at the still gasping mouth of what’s for dinner. The plate isn’t hot, but watch your fingers! The meat is blackened to a crisp, while from the neck up the fish is kept wet with towels to ensure it doesn’t expire before the last bite. My, what a playful presentation with the red sauce!

I do wonder about the Chinese obsession with keeping food alive as long as possible. In the video the diners are laughing at the fish’s sudden reactions, which leaves the impression they are as surprised as we about this live novelty. But I doubt it is so rare an event among those who can afford it. I remember at outdoor markets in China, watching customers buy slices of fish meat cut directly from the sides of live fish. Does live fish keep longer than dead? Certainly it does.

Westerners won’t eat a lobster or crab that’s killed before it’s cooked. No doubt some Chinese think we are fools for believing dead fish is an acceptable substitute for live. Americans are already ridiculed for pretending frozen orange juice is any match for fresh squeezed. Who are Americans to opine on taste? For years we’ve eaten chickens fed on fishmeal, without realizing what Europeans could tell us from a table’s length away, American chicken smells fishy!

Now ask an American farmer about sweet corn and he’ll brag that it’s best boiled while still on the stalk. So there is consensus on a preference for fresh.

What constitutes fresh when we’re talking meat? If you ask a reptile or spider, it means live. Mammal predators kept at the zoo have to accustom themselves to eating pieces of steak where their nature is to grab from what’s on the run. What looks like Steak Tartar to us is what they usually leave to scavengers.

Has the human predator diet been converted to scavenger for the sake of convenience and civility?

In our contemporary quest for reclaiming nutrition, I’ll be curious to know if there’s a forbidden energy gone missing from our scavenged meals.

I’ll let the clip speak for itself about the inhumanity of devouring a meal as it looks on. And I’m really glad that no worse videos have emerged from China. As yet there are no Youtube videos of diners eating monkey brains straight from the skull of a live monkey strapped to the table, nor of the infamous “three squeals” delicacy of live rat fetuses.

harry the dirty dogThe swearing in of the White House Dog is upon us, as the ever vigilant American press reports that Obama’s dog may debut Tuesday! Unfortunately the President has decided to pick a Portuguese water dog simply because it has a cute and ‘IN’ brand name.

My entire family is certainly deeply depressed about this as we had expected that our very own Colorado Peace Dog, Dirty Harriet, would have made a much better pick, and WOULD HAVE BEEN PICKED, if Dennis Kucinich had only become President instead of the fake imitation liberal the DNC gave us on the sly. A peace dog was considered way too radical by Joe Biden to ever be allowed into the White House, so Dirty Harriet never got interviewed for the post.

At least, let us hope that the new dog is not executed like Hillary eventually did with Socks, the Cat. Though, before Socks died he did get much better medical care than Americans ever did out of the Clinton family. Unfortunately, Socks was no longer able to deliver the proper image for Hillary and so ‘had to be put to sleep’, as the expression goes. He was shedded, in other words.

We have no report yet about whether the Obama family will be getting any official aquarium fish, mice, gerbils, or hamsters? So we must sill wait with baited breath for any sign that other animals will be anointed by Barack, or not?

PETA officials say it is way too early to tell still, and are encouraging the Royal Family to release all chickens, pigs, cows, and frogs as a gesture of goodwill as they consider the animal world and their position about wild and domestic life. If not, they are planning to throw a shoe full of animal blood at the President at the earliest possible opportunity, though the woman doing it will be extremely sexy.

This also will be used as a test to find out if the policy on torture use has been changed any at all, or whether it has all been merely cosmetic words, by the now, not so New, Administration? Good luck, PETA. And good luck, Thanksgiving turkeys.

elephant friendOK, this is a gratuitous commentary but don’t blame me for it, since I’ve merely overdosed on the religion from the Colorado Springs Justice and Peace Commission, a group supposedly dedicated to fighting US war making and not just for going to some sort of New Age Church on off days of the week. Pacifists always are counselling others on non-violence, but rarely are under any direct attack of their own that they have to defend against. However, elephants are in a different situation and react normally rather than spiritually as Jesus perhaps would have done. Of course, stories have it that in the Temple he did not act nonviolently either? But that’s just the Bible so what do they really know about Jesus anyway?

Actually, most American pacifists I have known think that Jesus would merely have voted for the Democratic Party ticket if Jesus were to return as an American. When you see those morph computer images of ‘Barack Lincoln’, we should realize that Lincoln is just a stand-in for Jesus and/ or Gandhi here. It is against the Christian religion to morph Jesus with people like Barack, just like Muslims don’t allow pictures of Mohammed to be waved around to all. So Barack Obama morphed with Lincoln is allowed though, so they went with that. I’d rather see a herd of Indian elephants show up at the Grand Inauguration this Tuesday though, and resist in the manner they know how to do so well.

Colo. Springs unintelligentsia for McCain

COLORADO SPRINGS- Elsewhere, John McCain’s campaign hasn’t been able to draw audiences of more than 500 people, but Colorado Springs folk came in droves. Doors opened at 9am, but cars began queuing at 7. When the event began at eleven, the 10,000 seats were taken and thousands more faithful were still arriving. Plus us.

I held a couple signs, to remind attendees about the KEATING FIVE, HELLO? and about McCain’s dubious Hanoi Hilton mistreatment, P.O.W. FRAUD.

We got a lot of “America love it or leave it” sentiment. Otherwise the opportunity was ripe to confront some of this city’s most ardent war supporters with reminders of a different school of thought.

A half-dozen PETA activists came with compelling issues to put before the crowd. One was dressed as Sarah Palin with a beauty queen sash that read MISS GLOBAL WARMING, another was dressed as a polar bear. Two more were wolves holding signs asking to outlaw the sniping of wild animals from airplanes.

We are just wiping out primates

Ernest Cline One of the most disturbing things about lifestyle vegetarians and the group PETA is that they consistently distract people from paying attention to the real dangers to animals on this planet. They want to fight about whether one should have a hamburger or not and often engage in tactics that are just plain stupid.

They consistently seem to have a fetish about ‘liberating’ animals from cages, for just one example. It puts them in the news but not in a great way when they go about ‘freeing’ other people’s animals. I don’t like animal abuse by science either, but that is not the main threat facing animal life on this planet.

And just several weeks ago, local animal rights people were out in front of the KFC on Nevada doing their parade as big chickens! Really now, I just don’t think they are going to move people on the plight of chickens in this cruel hard world we live in. Will they show up at Petco and Petsmart some time soon to protest the mistreatment of fish there? Oh the horrors of selling feeder fish!

Meanwhile, there hardly is any animal rights movement at all to stop the animalcide of multiple species around the planet. The movement to protect natural areas where these animal species reside is quite separate from the PETA gang’s general activities. It is the Environmental Movement that does this work and not the animal rights gang.

The simple fact of the matter, is that if people are treated right on this planet, then so will animals as a whole. It doesn’t really do to single out the treatment of animals as the big issue above all else, it just makes one look rather silly. However that is not the case in regards to animalcide. When animal and plant biodiversity is destroyed, then all plants, animals, humans, are threatened at one and the same time.

At the top of our list of issues involving animals has to be the fact that Primates ‘face extinction crisis’. We are definitely talking about dangers to ourselves here and animal rights activists would do themselves and animals a favor by concentrating on this sort of major issue, rather than the chickens at KFC or the primates in cages over at the University’s labs. They would do us all right by doing that, and by stopping being media hounds through silly and poorly thought out activism.

The Case of Pedro Zapeta vs The US National Security State

Pedro Zapeta‘s case is a case of the US government robbing the very poor to give to the National Security State.

He was a Guatemalan trying to get back to his native country with savings from his extremely low paying US job as a dishwasher. Instead, the US government seized his piggy bank at the airport! Then they set his deportation up after lifting his wallet, so to speak. So how does the US government treat the well-to-do Guatemalans? Does it rob them, too, like they did this poor Guatemalan, Pedro Zapeta ?

I can answer that myself. In 1985 I flew back from Guatemala City to Houston, Texas. On board, their was a fellow US citizen who was scared to death because we were seated 2 rows right behind a wealthy Guatemalan who I started euphorically making fun of. I have a big mouth and was excited to be going home but my American companion was scared to death. It seems we were seated right behind Mario Sandoval Alarcon.

Who was he? Why was he being waited on by the air steward as if he was royalty? Why was he on a plane going to the US? Below is a little about the guy. The American woman next to me on this flight had to return to Guatemala so I shut up for her sake. Maybe that is what kept me from being thrown out an open door as we flew over Mexico that day. Who knows?

Guatemala: In 1954, with the formation of the CIA-sponsored Army of Liberation (AOL) organized to overthrow reformist President Jacobo Arbenz Guzman, Guatemala became fixed in a pattern of anticommunist political violence which persists today. (11)

The Eisenhower administration tagged Arbenz as procommunist and sent E. Howard Hunt of the CIA (and, later, of Watergate fame) to organize the AOL. (45) In 1957, a radical right faction of the government set up by the U.S. to replace Arbenz assassinated his successor, President Castillo Armas, and formed a new party, the National Liberation Movement (MLN).

Mario Sandoval Alarcon was the driving force behind the government, and the MLN became the legitimizer of his paramilitary operations. (11)

Sandoval Alarcon, known as the “godfather,” launched his career in the AOL, and has been head of the WACL in Guatemala since 1972. (11) He was the coordinator of La Mano Blanco, which oversaw the operations of many of the death squads in Central America. La Mano Blanco was coordinated by CAL.

The death squads have terrorized Guatemala since their formation in the 1960s. When interviewed by the authors of Inside the League a political analyst said,”People ask if the death squads are controlled by the [Guatemalan] Army. They are the Army.”(11)

Sandoval Alarcon was head of the National Congress and vice president under Colonel Kjell Laugerud Schell from 1974 to 1978. While vice president, he established close ties with Taiwan through his leadership of WACL. He sent an estimated fifty to seventy Guatemalan army officers to the Academy in Taiwan for training. (11) In 1980, WACL requested that Sandoval Alarcon help D’Aubuisson establish death squads in El Salvador. (11,45)

In 1979, John Singlaub and Daniel Graham of the American Security Council and soon to be founders of the new U.S. WACL branch, the USCWF, visited Guatemala. The purpose of their junket was to begin to heal the relationship between the U.S. and Guatemala that had become strained under the Carter administration. They also informed the Guatemalan government that a Reagan victory would lead to a resumption of military ties between the countries.

Mario Sandoval Alarcon attended President Ronald Reagan’s inaugural ceremonies. (11) Alberto Piedra, WACL member, was appointed ambassador to Guatemala by President Reagan. (38,40)

While Sandoval failed in his bid to become president of Guatemala, he remained the power behind the throne. In 1985, he was still the head of WACL, claimed to have a private army of three thousand, and the ability to put thousands more paramilitary troops into action on short notice. (11)

Getting beyond TOO FAR

PetaI was very heartened to catch sight in the Indy of a local protest against KFC Kentucky Fried Cruelty, organized by PETA, the People for the Ethical Treatment of Animals. I didn’t know there was an active chapter in Colorado Springs. I’ll try to be in contact.
 
Another friend wasn’t so excited. “Sometimes, he told me, I think PETA goes too far.” I had to agree.

But I’m convinced that sometimes you have to go TOO FAR. In fact I’m not sure we don’t ALWAYS have to go that far. And looking at our own efficacy, including that of PETA’s, perhaps we are not going FAR ENOUGH!

PETA is being maligned with the same character assassination used to sideline America’s unions. Labor too greedy, the corporate press told us. Fat cats and layabouts, wanting high wages for nothing, going TOO FAR. Never mind that the unions gave us every work regulation we enjoy today, the public believed the media slander. The multinationals and their media broke the power we had to bargain collectively. Globalization will finish the job. TOO FAR my foot.

Might I ask: what about the systemic dehumanization being pushed on us? When will you decide that what they’re doing goes TOO FAR? I’d love to see somebody watch a video capturing the mistreatment of animals by our food industry –brought to us through the great efforts of PETA– and recoil in horror at what they see. Let them decry THAT’S GOING TOO FAR!

Katrina relief: what can you do?

Katrina Relief- What should you do?
Hoist the Federal Governement up on its own petard!
Do not aid and abet the carpetbagger land grab!
Do not aid and abet the displacement and scattering of the Louisiana poor.

The poor are the ones who’ll have to stay and stand up for their rights to their land.
Recovery funds should go to them, not to the reconstruction companies, developers and gaming resorts. I’m sorry but that’s not going to happen if you are helping to ship them out of Louisiana and Mississippi to put them up here.

Immediately after the Katrina disaster, “philanthropists” from Colorado Springs hired buses to go down to the relief shelters. The “philanthropists” plastered the stricken areas with fliers advertizing COME TO SCENIC COLORADO SPRINGS, etc.

The “philanthropists” set up agencies here to allocate the refugees to hotels and then apartments and houses. They helped connect refugees with cars, appliances, furniture and clothing. Those “philanthropists” were also quite visionary, because they foresaw that FEMA would pay for it all!

So what did those “philanthropists” accomplish after all? That FEMA money would flow into Colorado Springs coffers! Apartments and homes that had been empty are now occupied! Colorado Springs goods and services are now getting Federal dollars. And who were those “philanthropists?” Wealthy, well-known, developers! And apartment complex owners! And local business leaders!

Many of the refugees have since returned to the south to be with their families and friends. But it looks like the “philanthropists” foresaw that too, because it didn’t matter, the rents on those now empty apartments are already paid! FEMA paid for a year’s rent on each of them.

That’s taxpayer money, going to those wealthy “philanthropists.” All the less money than can go to help the Katrina victims rebuild their homes and their lives.

What should you do for the Katrina victims? Wish them Godspeed, call your congressman to urge that more support be offered to Katrina’s real victims, then call the U.S. Attorney General and urge him to prosecute the “philanthropists” for profiteering and fraud.

That’s what you can do.

We’ve seen this before in the South. It was called THE RECONSTRUCTION. And the northern opportunists who plagued the Reconstruction? They were called CARPETBAGGERS.
