Radiolab episode on jury nullification is less bothered by state abuse of power than public desperation to fight back.

It should come as no surprise that public radio’s RADIOLAB would take government’s side against the growing grassroots effort to awaken citizens to the repressed potential of jury nullification. Any attention to the subject helps inform ordinary jurors of the power they have to stand up to the regular abuses of our judicial system. The benefit is tempered of course when liberal gatekeepers lean in with theatrics to fearmonger about anarchistic challenges to law and order and security. That’s exactly what Radiolab achieved though given plenty of material with which to have taken a more honest tack. Their program “Null and Void” aired May 12 and painted nullifiers as irrational extremists, giving a pass to the judges who purge juries and break the law by having nullifiers arrested.

I had high hopes when contacted by a producer for Radiolab in March. Our federal injunction protecting Denver jury nullification outreach efforts against an order by the Second Judicial District’s Chief Judge Michael Martinez was coming to trial in April. I imagined reporters would be sympathetic to our predicted success making our injunction permanent and the similar likeliness of our prevailing on contempt charges in a hearing which was to follow. I faciliated Radiolab’s access to Mark Iannicelli, who Denver arrested in violation of our injunction, and whose dismissed charges of felony tampering continue to be appealed by our legal adversaries. Thus far it’s a simple story of hoisting a chief justice on his own petard, using the justice system against itself, in defense of the people’s historical power as jurors.

Heicklen
But Radiolab had an alternate narrative in mind. Their story would center on a jury nullification champion who they could characterize as coming off the rails, the celebrated frequent arrestee Julian Heicklen. Septegenarian Heicklen became tired of judges warning him of arrest, despite his continued legal victories. By November 2016, Heicklen issued a manifesto of sorts, asking for armed backup to preempt a judge from making good on his renewed threat to arrest him. Heicklen posted this warning online and called it to everyone’s attention. Presumably it’s what drew Radiolab’s attention. Heicklen had put it out there, hoping to spark a John Brown-esque conflagration, I’d call it a bluff, meant to curtail the court’s continued abuse of power. It’s obvious from Heicklan’s hyperbole. I attach the significant excerpt in the notes below.

Radiolab didn’t reference this tract, nor mention their and the court’s foreknowledge of it. As they interviewed Heicklen, they asked him about his cause and even brought him to tears as he explained his distress about the injustice of the system, which continues to reinforce inequity and deny jurors their prerogative to step in its way. Then Radiolab prodded Heicklen to explain what he anticipated would happen when he showed up at the courthouse in defiance of the judge’s threat. On cue, Heicklen repeated his entreaty that supporters show up with guns to enforce his right to pass out fliers and avert the judge’s illegal threat to arrest him.

Many of us might share the elderly activist’s frustration with being habitually arrested then exhonerated, each time without apparent progress being made. Radiolab’s pretend reaction was to cue ominous silence, let the pin drop, cue indignant alarm, ostracize Heicklen, cue a spontaneous meting of Radiolab minds to elect to call the cops on Heicklen lest law enforcement personnel be shot.

Radiolab didn’t call the Chief Judge Frederick J. Lauten to question the irregularity of his repeating an illegal threat. How absolutely insane for a judge, already proven to be in the wrong, to keep asserting his authority to have a citizen falsely arrested?

When Heicklen showed up to the courthouse, with a friend, both without weapons of any kind, and without the backup support of “Tyranny Fighters” he’d hoped to mobilize, Heicklen was arrested for the more serious charges involving threats.

Radiolab may or may to have exacerbated Heicklen’s arrest. They certainly took credit for it, which is the least they could do for having exploited Heicklen as their straw man extremist.

Because Radiolab makes little effort to conceal their liberal bourgeois elitism. FIJA, the Fully Informed Jury Association was founded, according to Radiolab, in a Montana “bunghole”, which they qualify, they are entitled to call Helena, the capitol of Montana, because one of the show’s producers is from Montana.

Wolverine
You might ask, what’s Wolverine got to do with this? Anyone who’s read Ariel Dorfman knows better than to bring superheroes into political discourse. Radiolab didn’t know how better to distinguish between a citizen’s right, as proscribed by the Bill of Rights, and a power, something grown from common law. Whatever, they’re wrong. Juries are guaranteed by the sixth amendment, now commonly understood to be “a jury of your peers.”

Radiolab never uses that phrase, it’s too everyman. But they do riff ad nauseum on Wolverine, who’s a superhero with superpowers, namely CLAWS, which for Radiolab described this aberrant power that jury nullification advocates are promoting. The public as beast, and mutant power threatening elitists like a werewolf’s claws. Someone adds, as a further irrelevance, that Wolverine’s real superpower is regenerative, the power to heal but nevermind. They say that, and it’s the only trivia that actually does apply to jury nullification. Radiolab autistic savants.

They recorded Mark Iannicelli in front of the Denver courthouse, that was our single consolation!

It’s no surprise that Radiolab takes the government’s side against the public’s growing inclination to “burn it down.” Radiolab got great quotes from Mark, but chose to demonize other jury nullification pamphleteers who were so frustrated with being arrested that wanted to deter future arrests with guns.

By the show’s end, the white privileged NPR broadcasters feel more comfortable with the law in the hands of “unelected, white” judges over inexpert jurors described as “twelve random jerk-offs from the street.” They’re taking about your constitutionally protected jury of your peers.

Hopefully listeners will glean the great information offered by this piece and nullify Radiolabs’s privileged condescension.

A copy of your letter to Rick Scott dated October 13, 2016, was given to me. In your letter, you stateit is your intent to “distribute flyers regarding the duties of jurors and witnesses at criminal trials” at the Orange County Courthouse during th first week of December.” This letter is a reminder that such conduct continues to be proscribed on courthouse grounds under Administrative Order 2011-03 which governs expressive conduct taward summoned jurors. Enclosed is a copy of Adminiustrative Order 2011-03 for your perusal.

As you know, this Administrative Order is constituional as the Fifth District Court of appeal had “no difficulry upholding Administrative Order No. 2011–03 as reasonable, viewpoint neutral regulation….” Schmidter & Heicklen v. State, 103 So. 3d 2663,270 (Fla. 5th DCA 2012)(a copy of which is enclosed). This Court, as well as the Orange Cpounty Sheriff, qill enforce the provisions of Admionistrative Order No. 2011-03 to ensure the fair and orderly conduct of jury trials and to prevent dissruptions or interference with that basic right.

Based on the Administrative Order’s continuing validity, you may wish to reconsider your intended course of action and find alternative means in which to disseminate your message. If you intend on distributing materials to jurors, you will be issued a trespass notice and if you then remain on courthouse grounds, you could be arrested for trespass.

Unfortunately there seems to be a disagreement between the Florida court and the United States Federal Court. I was one of the appellants in the Florida case. The decision was based on lies and incorrect information introduced by the state attorneys. The judges should have know this, since I carefully pointed out the errors, but they did not care. They had made up their minds before hearing the case.

Previously I was arrested 5 times for distributing this literature at the the U. S. District Court in Manhattan, NY. I was arrested and charged with jury tampering. After 17 months of trial, Judge Kimba Wood declared that distributing this literature was not jury tampering because I did not discuss any case with a juror sitting on that trial. I was invited to Harvard University Law School to give a lecture on my case. Also I have been informed that my case is being taught to all students at Yale Law School. Presumably it is being taught elsewhere as well.

Currently I distribute the same flyers at both state and federal courthouses around the country. None of them arrest me. Three of these courthouses are state courthouses. They are in Fort Lauderdale, Fl; Pittsburgh, PA (last week); and Newark, NJ. The federal courthouses this year have been in Fort Lauderdale, FL; Newark, NJ; Manhattan, NY; Palo Alto, CA; Pittsburgh, PA (last week) and San Jose, CA; The state courthouses do not approach me. The federal courthouse Homeland Security officers at federal courts all threatened to arrest me until I told them to check it with a judge. They did, and none of them made an arrest.

December 5, 2016 will be a critical day in the history of the United States. I will appear at the Orange County Courthouse, 425 N. Orange Avenue, Orlando, FL and distribute “Nullification by Jury” flyers on the public sidewalk leading from the parking lot to the courthouse. I am asking all Tyranny fighters and anyone else to join me armed with loaded guns to shoot any courthouse employee or officer of the court (i.e. guards, Orlando police, State police, Sheriffs, or lawyers) that approach within 15 feet of me. One of 4 things can happen:

Neither the court personnel, the Tyranny Fighters, nor the press will appear. That will be the smoothest, but dullest, situation.

The Court officers only will appear and arrest me.

The Tyranny Fighters only will appear and protect me.

Both the Court officers and the Tyranny Fighters will appear. The gun battle for the return of a free country with a democratic republic will occur.

I am irrelevant. The future of the United States will be determined by the others or by you. Either we will continue the route to the gas chambers as described in the attached document, or we shall backtrack to a democratic republic. In either case I will have died by then.

Federation Council members, State Duma deputies, good afternoon. Representatives of the Republic of Crimea and Sevastopol are here among us, citizens of Russia, residents of Crimea and Sevastopol!

Dear friends, we have gathered here today in connection with an issue that is of vital, historic significance to all of us. A referendum was held in Crimea on March 16 in full compliance with democratic procedures and international norms.

More than 82 percent of the electorate took part in the vote. Over 96 percent of them spoke out in favour of reuniting with Russia. These numbers speak for themselves.

To understand the reason behind such a choice it is enough to know the history of Crimea and what Russia and Crimea have always meant for each other.

Everything in Crimea speaks of our shared history and pride. This is the location of ancient Khersones, where Prince Vladimir was baptised. His spiritual feat of adopting Orthodoxy predetermined the overall basis of the culture, civilisation and human values that unite the peoples of Russia, Ukraine and Belarus. The graves of Russian soldiers whose bravery brought Crimea into the Russian empire are also in Crimea. This is also Sevastopol – a legendary city with an outstanding history, a fortress that serves as the birthplace of Russia’s Black Sea Fleet. Crimea is Balaklava and Kerch, Malakhov Kurgan and Sapun Ridge. Each one of these places is dear to our hearts, symbolising Russian military glory and outstanding valour.

Crimea is a unique blend of different peoples’ cultures and traditions. This makes it similar to Russia as a whole, where not a single ethnic group has been lost over the centuries. Russians and Ukrainians, Crimean Tatars and people of other ethnic groups have lived side by side in Crimea, retaining their own identity, traditions, languages and faith.

Incidentally, the total population of the Crimean Peninsula today is 2.2 million people, of whom almost 1.5 million are Russians, 350,000 are Ukrainians who predominantly consider Russian their native language, and about 290,000-300,000 are Crimean Tatars, who, as the referendum has shown, also lean towards Russia.

True, there was a time when Crimean Tatars were treated unfairly, just as a number of other peoples in the USSR. There is only one thing I can say here: millions of people of various ethnicities suffered during those repressions, and primarily Russians.

Crimean Tatars returned to their homeland. I believe we should make all the necessary political and legislative decisions to finalise the rehabilitation of Crimean Tatars, restore them in their rights and clear their good name.

We have great respect for people of all the ethnic groups living in Crimea. This is their common home, their motherland, and it would be right – I know the local population supports this – for Crimea to have three equal national languages: Russian, Ukrainian and Tatar.

Colleagues,

In people’s hearts and minds, Crimea has always been an inseparable part of Russia. This firm conviction is based on truth and justice and was passed from generation to generation, over time, under any circumstances, despite all the dramatic changes our country went through during the entire 20th century.

After the revolution, the Bolsheviks, for a number of reasons – may God judge them – added large sections of the historical South of Russia to the Republic of Ukraine. This was done with no consideration for the ethnic make-up of the population, and today these areas form the southeast of Ukraine. Then, in 1954, a decision was made to transfer Crimean Region to Ukraine, along with Sevastopol, despite the fact that it was a federal city. This was the personal initiative of the Communist Party head Nikita Khrushchev. What stood behind this decision of his – a desire to win the support of the Ukrainian political establishment or to atone for the mass repressions of the 1930’s in Ukraine – is for historians to figure out.

What matters now is that this decision was made in clear violation of the constitutional norms that were in place even then. The decision was made behind the scenes. Naturally, in a totalitarian state nobody bothered to ask the citizens of Crimea and Sevastopol. They were faced with the fact. People, of course, wondered why all of a sudden Crimea became part of Ukraine. But on the whole – and we must state this clearly, we all know it – this decision was treated as a formality of sorts because the territory was transferred within the boundaries of a single state. Back then, it was impossible to imagine that Ukraine and Russia may split up and become two separate states. However, this has happened.

Unfortunately, what seemed impossible became a reality. The USSR fell apart. Things developed so swiftly that few people realised how truly dramatic those events and their consequences would be. Many people both in Russia and in Ukraine, as well as in other republics hoped that the Commonwealth of Independent States that was created at the time would become the new common form of statehood. They were told that there would be a single currency, a single economic space, joint armed forces; however, all this remained empty promises, while the big country was gone. It was only when Crimea ended up as part of a different country that Russia realised that it was not simply robbed, it was plundered.

At the same time, we have to admit that by launching the sovereignty parade Russia itself aided in the collapse of the Soviet Union. And as this collapse was legalised, everyone forgot about Crimea and Sevastopol ­– the main base of the Black Sea Fleet. Millions of people went to bed in one country and awoke in different ones, overnight becoming ethnic minorities in former Union republics, while the Russian nation became one of the biggest, if not the biggest ethnic group in the world to be divided by borders.

Now, many years later, I heard residents of Crimea say that back in 1991 they were handed over like a sack of potatoes. This is hard to disagree with. And what about the Russian state? What about Russia? It humbly accepted the situation. This country was going through such hard times then that realistically it was incapable of protecting its interests. However, the people could not reconcile themselves to this outrageous historical injustice. All these years, citizens and many public figures came back to this issue, saying that Crimea is historically Russian land and Sevastopol is a Russian city. Yes, we all knew this in our hearts and minds, but we had to proceed from the existing reality and build our good-neighbourly relations with independent Ukraine on a new basis. Meanwhile, our relations with Ukraine, with the fraternal Ukrainian people have always been and will remain of foremost importance for us.

Today we can speak about it openly, and I would like to share with you some details of the negotiations that took place in the early 2000s. The then President of Ukraine Mr Kuchma asked me to expedite the process of delimiting the Russian-Ukrainian border. At that time, the process was practically at a standstill. Russia seemed to have recognised Crimea as part of Ukraine, but there were no negotiations on delimiting the borders. Despite the complexity of the situation, I immediately issued instructions to Russian government agencies to speed up their work to document the borders, so that everyone had a clear understanding that by agreeing to delimit the border we admitted de facto and de jure that Crimea was Ukrainian territory, thereby closing the issue.

We accommodated Ukraine not only regarding Crimea, but also on such a complicated matter as the maritime boundary in the Sea of Azov and the Kerch Strait. What we proceeded from back then was that good relations with Ukraine matter most for us and they should not fall hostage to deadlock territorial disputes. However, we expected Ukraine to remain our good neighbour, we hoped that Russian citizens and Russian speakers in Ukraine, especially its southeast and Crimea, would live in a friendly, democratic and civilised state that would protect their rights in line with the norms of international law.

However, this is not how the situation developed. Time and time again attempts were made to deprive Russians of their historical memory, even of their language and to subject them to forced assimilation. Moreover, Russians, just as other citizens of Ukraine are suffering from the constant political and state crisis that has been rocking the country for over 20 years.

I understand why Ukrainian people wanted change. They have had enough of the authorities in power during the years of Ukraine’s independence. Presidents, prime ministers and parliamentarians changed, but their attitude to the country and its people remained the same. They milked the country, fought among themselves for power, assets and cash flows and did not care much about the ordinary people. They did not wonder why it was that millions of Ukrainian citizens saw no prospects at home and went to other countries to work as day labourers. I would like to stress this: it was not some Silicon Valley they fled to, but to become day labourers. Last year alone almost 3 million people found such jobs in Russia. According to some sources, in 2013 their earnings in Russia totalled over $20 billion, which is about 12% of Ukraine’s GDP.

I would like to reiterate that I understand those who came out on Maidan with peaceful slogans against corruption, inefficient state management and poverty. The right to peaceful protest, democratic procedures and elections exist for the sole purpose of replacing the authorities that do not satisfy the people. However, those who stood behind the latest events in Ukraine had a different agenda: they were preparing yet another government takeover; they wanted to seize power and would stop short of nothing. They resorted to terror, murder and riots. Nationalists, neo-Nazis, Russophobes and anti-Semites executed this coup. They continue to set the tone in Ukraine to this day.

The new so-called authorities began by introducing a draft law to revise the language policy, which was a direct infringement on the rights of ethnic minorities. However, they were immediately ‘disciplined’ by the foreign sponsors of these so-called politicians. One has to admit that the mentors of these current authorities are smart and know well what such attempts to build a purely Ukrainian state may lead to. The draft law was set aside, but clearly reserved for the future. Hardly any mention is made of this attempt now, probably on the presumption that people have a short memory. Nevertheless, we can all clearly see the intentions of these ideological heirs of Bandera, Hitler’s accomplice during World War II.

It is also obvious that there is no legitimate executive authority in Ukraine now, nobody to talk to. Many government agencies have been taken over by the impostors, but they do not have any control in the country, while they themselves – and I would like to stress this – are often controlled by radicals. In some cases, you need a special permit from the militants on Maidan to meet with certain ministers of the current government. This is not a joke – this is reality.

Those who opposed the coup were immediately threatened with repression. Naturally, the first in line here was Crimea, the Russian-speaking Crimea. In view of this, the residents of Crimea and Sevastopol turned to Russia for help in defending their rights and lives, in preventing the events that were unfolding and are still underway in Kiev, Donetsk, Kharkov and other Ukrainian cities.

Naturally, we could not leave this plea unheeded; we could not abandon Crimea and its residents in distress. This would have been betrayal on our part.

First, we had to help create conditions so that the residents of Crimea for the first time in history were able to peacefully express their free will regarding their own future. However, what do we hear from our colleagues in Western Europe and North America? They say we are violating norms of international law. Firstly, it’s a good thing that they at least remember that there exists such a thing as international law – better late than never.

Secondly, and most importantly – what exactly are we violating? True, the President of the Russian Federation received permission from the Upper House of Parliament to use the Armed Forces in Ukraine. However, strictly speaking, nobody has acted on this permission yet. Russia’s Armed Forces never entered Crimea; they were there already in line with an international agreement. True, we did enhance our forces there; however – this is something I would like everyone to hear and know – we did not exceed the personnel limit of our Armed Forces in Crimea, which is set at 25,000, because there was no need to do so.

Next. As it declared independence and decided to hold a referendum, the Supreme Council of Crimea referred to the United Nations Charter, which speaks of the right of nations to self-determination. Incidentally, I would like to remind you that when Ukraine seceded from the USSR it did exactly the same thing, almost word for word. Ukraine used this right, yet the residents of Crimea are denied it. Why is that?

Moreover, the Crimean authorities referred to the well-known Kosovo precedent – a precedent our western colleagues created with their own hands in a very similar situation, when they agreed that the unilateral separation of Kosovo from Serbia, exactly what Crimea is doing now, was legitimate and did not require any permission from the country’s central authorities. Pursuant to Article 2, Chapter 1 of the United Nations Charter, the UN International Court agreed with this approach and made the following comment in its ruling of July 22, 2010, and I quote: “No general prohibition may be inferred from the practice of the Security Council with regard to declarations of independence,” and “General international law contains no prohibition on declarations of independence.” Crystal clear, as they say.

I do not like to resort to quotes, but in this case, I cannot help it. Here is a quote from another official document: the Written Statement of the United States America of April 17, 2009, submitted to the same UN International Court in connection with the hearings on Kosovo. Again, I quote: “Declarations of independence may, and often do, violate domestic legislation. However, this does not make them violations of international law.” End of quote. They wrote this, disseminated it all over the world, had everyone agree and now they are outraged. Over what? The actions of Crimean people completely fit in with these instructions, as it were. For some reason, things that Kosovo Albanians (and we have full respect for them) were permitted to do, Russians, Ukrainians and Crimean Tatars in Crimea are not allowed. Again, one wonders why.

We keep hearing from the United States and Western Europe that Kosovo is some special case. What makes it so special in the eyes of our colleagues? It turns out that it is the fact that the conflict in Kosovo resulted in so many human casualties. Is this a legal argument? The ruling of the International Court says nothing about this. This is not even double standards; this is amazing, primitive, blunt cynicism. One should not try so crudely to make everything suit their interests, calling the same thing white today and black tomorrow. According to this logic, we have to make sure every conflict leads to human losses.

I will state clearly – if the Crimean local self-defence units had not taken the situation under control, there could have been casualties as well. Fortunately this did not happen. There was not a single armed confrontation in Crimea and no casualties. Why do you think this was so? The answer is simple: because it is very difficult, practically impossible to fight against the will of the people. Here I would like to thank the Ukrainian military – and this is 22,000 fully armed servicemen. I would like to thank those Ukrainian service members who refrained from bloodshed and did not smear their uniforms in blood.

Other thoughts come to mind in this connection. They keep talking of some Russian intervention in Crimea, some sort of aggression. This is strange to hear. I cannot recall a single case in history of an intervention without a single shot being fired and with no human casualties.

Like a mirror, the situation in Ukraine reflects what is going on and what has been happening in the world over the past several decades. After the dissolution of bipolarity on the planet, we no longer have stability. Key international institutions are not getting any stronger; on the contrary, in many cases, they are sadly degrading. Our western partners, led by the United States of America, prefer not to be guided by international law in their practical policies, but by the rule of the gun. They have come to believe in their exclusivity and exceptionalism, that they can decide the destinies of the world, that only they can ever be right. They act as they please: here and there, they use force against sovereign states, building coalitions based on the principle “If you are not with us, you are against us.” To make this aggression look legitimate, they force the necessary resolutions from international organisations, and if for some reason this does not work, they simply ignore the UN Security Council and the UN overall.

This happened in Yugoslavia; we remember 1999 very well. It was hard to believe, even seeing it with my own eyes, that at the end of the 20th century, one of Europe’s capitals, Belgrade, was under missile attack for several weeks, and then came the real intervention. Was there a UN Security Council resolution on this matter, allowing for these actions? Nothing of the sort. And then, they hit Afghanistan, Iraq, and frankly violated the UN Security Council resolution on Libya, when instead of imposing the so-called no-fly zone over it they started bombing it too.

There was a whole series of controlled “colour” revolutions. Clearly, the people in those nations, where these events took place, were sick of tyranny and poverty, of their lack of prospects; but these feelings were taken advantage of cynically. Standards were imposed on these nations that did not in any way correspond to their way of life, traditions, or these peoples’ cultures. As a result, instead of democracy and freedom, there was chaos, outbreaks in violence and a series of upheavals. The Arab Spring turned into the Arab Winter.

A similar situation unfolded in Ukraine. In 2004, to push the necessary candidate through at the presidential elections, they thought up some sort of third round that was not stipulated by the law. It was absurd and a mockery of the constitution. And now, they have thrown in an organised and well-equipped army of militants.

We understand what is happening; we understand that these actions were aimed against Ukraine and Russia and against Eurasian integration. And all this while Russia strived to engage in dialogue with our colleagues in the West. We are constantly proposing cooperation on all key issues; we want to strengthen our level of trust and for our relations to be equal, open and fair. But we saw no reciprocal steps.

On the contrary, they have lied to us many times, made decisions behind our backs, placed us before an accomplished fact. This happened with NATO’s expansion to the East, as well as the deployment of military infrastructure at our borders. They kept telling us the same thing: “Well, this does not concern you.” That’s easy to say.

It happened with the deployment of a missile defence system. In spite of all our apprehensions, the project is working and moving forward. It happened with the endless foot-dragging in the talks on visa issues, promises of fair competition and free access to global markets.

Today, we are being threatened with sanctions, but we already experience many limitations, ones that are quite significant for us, our economy and our nation. For example, still during the times of the Cold War, the US and subsequently other nations restricted a large list of technologies and equipment from being sold to the USSR, creating the Coordinating Committee for Multilateral Export Controls list. Today, they have formally been eliminated, but only formally; and in reality, many limitations are still in effect.

In short, we have every reason to assume that the infamous policy of containment, led in the 18th, 19th and 20th centuries, continues today. They are constantly trying to sweep us into a corner because we have an independent position, because we maintain it and because we call things like they are and do not engage in hypocrisy. But there is a limit to everything. And with Ukraine, our western partners have crossed the line, playing the bear and acting irresponsibly and unprofessionally.

After all, they were fully aware that there are millions of Russians living in Ukraine and in Crimea. They must have really lacked political instinct and common sense not to foresee all the consequences of their actions. Russia found itself in a position it could not retreat from. If you compress the spring all the way to its limit, it will snap back hard. You must always remember this.

Today, it is imperative to end this hysteria, to refute the rhetoric of the cold war and to accept the obvious fact: Russia is an independent, active participant in international affairs; like other countries, it has its own national interests that need to be taken into account and respected.

At the same time, we are grateful to all those who understood our actions in Crimea; we are grateful to the people of China, whose leaders have always considered the situation in Ukraine and Crimea taking into account the full historical and political context, and greatly appreciate India’s reserve and objectivity.

Today, I would like to address the people of the United States of America, the people who, since the foundation of their nation and adoption of the Declaration of Independence, have been proud to hold freedom above all else. Isn’t the desire of Crimea’s residents to freely choose their fate such a value? Please understand us.

I believe that the Europeans, first and foremost, the Germans, will also understand me. Let me remind you that in the course of political consultations on the unification of East and West Germany, at the expert, though very high level, some nations that were then and are now Germany’s allies did not support the idea of unification. Our nation, however, unequivocally supported the sincere, unstoppable desire of the Germans for national unity. I am confident that you have not forgotten this, and I expect that the citizens of Germany will also support the aspiration of the Russians, of historical Russia, to restore unity.

I also want to address the people of Ukraine. I sincerely want you to understand us: we do not want to harm you in any way, or to hurt your national feelings. We have always respected the territorial integrity of the Ukrainian state, incidentally, unlike those who sacrificed Ukraine’s unity for their political ambitions. They flaunt slogans about Ukraine’s greatness, but they are the ones who did everything to divide the nation. Today’s civil standoff is entirely on their conscience. I want you to hear me, my dear friends. Do not believe those who want you to fear Russia, shouting that other regions will follow Crimea. We do not want to divide Ukraine; we do not need that. As for Crimea, it was and remains a Russian, Ukrainian, and Crimean-Tatar land.

I repeat, just as it has been for centuries, it will be a home to all the peoples living there. What it will never be and do is follow in Bandera’s footsteps!

Crimea is our common historical legacy and a very important factor in regional stability. And this strategic territory should be part of a strong and stable sovereignty, which today can only be Russian. Otherwise, dear friends (I am addressing both Ukraine and Russia), you and we – the Russians and the Ukrainians – could lose Crimea completely, and that could happen in the near historical perspective. Please think about it.

Let me note too that we have already heard declarations from Kiev about Ukraine soon joining NATO. What would this have meant for Crimea and Sevastopol in the future? It would have meant that NATO’s navy would be right there in this city of Russia’s military glory, and this would create not an illusory but a perfectly real threat to the whole of southern Russia. These are things that could have become reality were it not for the choice the Crimean people made, and I want to say thank you to them for this.

But let me say too that we are not opposed to cooperation with NATO, for this is certainly not the case. For all the internal processes within the organisation, NATO remains a military alliance, and we are against having a military alliance making itself at home right in our backyard or in our historic territory. I simply cannot imagine that we would travel to Sevastopol to visit NATO sailors. Of course, most of them are wonderful guys, but it would be better to have them come and visit us, be our guests, rather than the other way round.

Let me say quite frankly that it pains our hearts to see what is happening in Ukraine at the moment, see the people’s suffering and their uncertainty about how to get through today and what awaits them tomorrow. Our concerns are understandable because we are not simply close neighbours but, as I have said many times already, we are one people. Kiev is the mother of Russian cities. Ancient Rus is our common source and we cannot live without each other.

Let me say one other thing too. Millions of Russians and Russian-speaking people live in Ukraine and will continue to do so. Russia will always defend their interests using political, diplomatic and legal means. But it should be above all in Ukraine’s own interest to ensure that these people’s rights and interests are fully protected. This is the guarantee of Ukraine’s state stability and territorial integrity.

We want to be friends with Ukraine and we want Ukraine to be a strong, sovereign and self-sufficient country. Ukraine is one of our biggest partners after all. We have many joint projects and I believe in their success no matter what the current difficulties. Most importantly, we want peace and harmony to reign in Ukraine, and we are ready to work together with other countries to do everything possible to facilitate and support this. But as I said, only Ukraine’s own people can put their own house in order.

Residents of Crimea and the city of Sevastopol, the whole of Russia admired your courage, dignity and bravery. It was you who decided Crimea’s future. We were closer than ever over these days, supporting each other. These were sincere feelings of solidarity. It is at historic turning points such as these that a nation demonstrates its maturity and strength of spirit. The Russian people showed this maturity and strength through their united support for their compatriots.

Russia’s foreign policy position on this matter drew its firmness from the will of millions of our people, our national unity and the support of our country’s main political and public forces. I want to thank everyone for this patriotic spirit, everyone without exception. Now, we need to continue and maintain this kind of consolidation so as to resolve the tasks our country faces on its road ahead.

Obviously, we will encounter external opposition, but this is a decision that we need to make for ourselves. Are we ready to consistently defend our national interests, or will we forever give in, retreat to who knows where? Some Western politicians are already threatening us with not just sanctions but also the prospect of increasingly serious problems on the domestic front. I would like to know what it is they have in mind exactly: action by a fifth column, this disparate bunch of ‘national traitors’, or are they hoping to put us in a worsening social and economic situation so as to provoke public discontent? We consider such statements irresponsible and clearly aggressive in tone, and we will respond to them accordingly. At the same time, we will never seek confrontation with our partners, whether in the East or the West, but on the contrary, will do everything we can to build civilised and good-neighbourly relations as one is supposed to in the modern world.

I understand the people of Crimea, who put the question in the clearest possible terms in the referendum: should Crimea be with Ukraine or with Russia? We can be sure in saying that the authorities in Crimea and Sevastopol, the legislative authorities, when they formulated the question, set aside group and political interests and made the people’s fundamental interests alone the cornerstone of their work. The particular historic, population, political and economic circumstances of Crimea would have made any other proposed option – however tempting it could be at the first glance – only temporary and fragile and would have inevitably led to further worsening of the situation there, which would have had disastrous effects on people’s lives. The people of Crimea thus decided to put the question in firm and uncompromising form, with no grey areas. The referendum was fair and transparent, and the people of Crimea clearly and convincingly expressed their will and stated that they want to be with Russia.

Russia will also have to make a difficult decision now, taking into account the various domestic and external considerations. What do people here in Russia think? Here, like in any democratic country, people have different points of view, but I want to make the point that the absolute majority of our people clearly do support what is happening.

The most recent public opinion surveys conducted here in Russia show that 95 percent of people think that Russia should protect the interests of Russians and members of other ethnic groups living in Crimea – 95 percent of our citizens. More than 83 percent think that Russia should do this even if it will complicate our relations with some other countries. A total of 86 percent of our people see Crimea as still being Russian territory and part of our country’s lands. And one particularly important figure, which corresponds exactly with the result in Crimea’s referendum: almost 92 percent of our people support Crimea’s reunification with Russia.

Thus we see that the overwhelming majority of people in Crimea and the absolute majority of the Russian Federation’s people support the reunification of the Republic of Crimea and the city of Sevastopol with Russia.

Now this is a matter for Russia’s own political decision, and any decision here can be based only on the people’s will, because the people is the ultimate source of all authority.

Members of the Federation Council, deputies of the State Duma, citizens of Russia, residents of Crimea and Sevastopol, today, in accordance with the people’s will, I submit to the Federal Assembly a request to consider a Constitutional Law on the creation of two new constituent entities within the Russian Federation: the Republic of Crimea and the city of Sevastopol, and to ratify the treaty on admitting to the Russian Federation Crimea and Sevastopol, which is already ready for signing. Spinning US atrocities, words matter: shooting sprees & shopping rampages

Headlines about Sunday’s midnight massacre in Kandahar transformed quickly from NATO FORCES RAID to become LONE GUNMAN KILLS 16, as the attributed sources shifted from Afghan locals on the scene to US military spokesmen. One might argue it’s in the interest of national security to attribute the murders in Balandi and Alkozai to a solitary stalker, to tamp the swelling anger of the Afghan populace, but what’s the truth? Making a rare concession, the NYT has revised its headline a 3rd time to read LONE SOLDIER SAID TO BE KILLER OF 16 AFGHANS, and the BBC puts “ACTED ALONE” in quotes. (UPDATE: AP adds “allegedly” and LA Times “apparently”)
 
Pundits stroke our soldiers’ egos by asking could one special forces soldier alone kill so many (?!), but more difficult to imagine is how a rogue fighter can equip himself and pass through multiple security defenses unobserved. Also doubtful is how and why a stealth assassin would burn the victims’ bodies as he moved about. Easier to believe is that damage control decided it best that one man take the fall for his comrades, God and country, probably the one too drunk to object.

Tea Partying with the Freak Brothers

Whew! These Occupy posts are far more difficult to pry from myself than their predecessors; the hands-on mechanics of putting the earlier stuff into practice in the present world, amongst the isolated pools of individuated consciousness we humans represent, each with his or her own vision of the whole, has been at the very least disorienting. I’ve lately revived an old motto i swiped from the good people at Oat Willie’s down in Austin, Texas: Onward Through the Fog! How odd is it that i’ve recently connected with some folks that hark back to that place in ways that are deeply surreal. Oat Willie’s and Fat Freddie will seem to be completely out of place in this bit, in which i mean to address the notion of cooperation amongst disparate factions, but not permanently i hope. By the end of this post, i hope to connect Occupy, The Tea Party, disparate passions, and yes, Hippies. It will be necessary to engage in some relatively surreal thinking.

Last night on a new Facebook page, “UNITE: OCCUPY,” (cap lock and all), i got into a conversation about this stuff started by a guy that asked whether anyone thought a joint event between Occupiers and Tea Partiers might be possible. Sure, i said, our Colorado Springs group had lots of Tea Partiers among its earliest enthusiasts, and although many have pulled away, there still exists a close association with many that veer sharply toward the Te Party camp, especially among Ron Paul supporters. The common ground Occupy shares with the Tea Party, at least t a grass root level, is substantial. There can be no doubt of the equally substantial differences. I suspect that it would take some pretty serious ideological barnstorming to bring the two camps together, but nothing prevents the groups from at least tentative discussion to find commonalities.

Tonight our Occupy group staged a talk by Tea Party stalwart, Constitutionalist Mike Holler. Mike seemed for all appearances to be an earnest and well-versed supporter of Constitutional “fundamentalism,” if you will. He peppered his talk with lots of my favorite quotes from my favorite founding fathers. He got a little testy about the revisionist history his kids bring home from college early on–perhaps indicative of one point of separation between Occupiers and Tea Partiers. Some of those are important. Occupy is international, where the Tea Party can display degrees of jingoism. I, personally, respect the earnest efforts of our Enlightenment founders, but recognize that they were flawed, and aver that their document was dated by racist, sexist, and elitist provisions and thinking that they might be excused from by noting their temporal milieu. We don’t have the same luxury. Occupy is legitimately grass root, supported by sweat and blood more than funded, where TP is, or at least became very quickly corporately funded “astroturf,” disingenuously proffering libertarian ideals as a smoke screen for corporate license to plunder. Occupiers are in my experience far more diverse than Tea Partiers. Socialist and Anarchist Occupiers are common, as are assorted races, genders, orientations, and religious persuasions, where Tea Partiers seem to my limited observation to be relatively homogeneously white Christian capitalist patriots. Mike interjected that both groups had been misrepresented by the media, and that seems likely to be so given that mainstream media seems content to misrepresent ’bout anything they report in this country, but Fox news and the rabid right like the Tea Party so much i have to wonder if he’s fallen victim to a personal soft spot.

Mike spoke eloquently enough in his effort to simplify the Constitution, focusing on issues of freedom, and state’s rights. He said very little with which i could find disagreement. He pointed out two major points of confluence between Occupy and the Tea Party–personal liberty, and a rally-cry, “No more Bailouts!” I suspect he fastidiously avoided some points he knew or at least feared might be contentious, like for example the ludicrous assertions i’ve heard often that environmental warnings from the scientific community stem from some kind of Satanic control scheme from the–well just whom is never too clear. The Vatican or something. Commies, i guess. That just maybe the best way for Tea Partiers and Occupiers to interact, though, for now, concentrating on the common aversion to what amounts to Fascism. Interacting from that perspective could exclude much conversation. It could put the Tea Party in the same position as the Occupy movement, after their Fascist sponsors withdraw in horror. Whatever. We Occupiers got on just fine with Tea Party Mike–“Mr. Constitution.”

Mike largely expressed notions we Occupiers could embrace. I suppose he could have done a bit of research and tailored his speech toward that end, but i think we just agree; he seemed a grassroot kind of guy, to me. He briefly alluded to schisms within the Tea Party, and there’s no sensible reason to avoid acknowledging the same within Occupy. Last night’s event was attended by Occupy people that have had such extreme altercations in their attempts to wrestle a semblance of ideological unity from a stubbornly liquid platform that it could easily enough have disintegrated into bedlam. I attended with my dear friend Thomas, with whom i often disagree. In fact, he and i often disagree so strongly that sometimes i feel like smacking him in back of the head. I expect he feels the same way about me at times. Maybe much of the time. Take note, war-mongers of the world: Thomas is a great guy, and even though we disagree with one another, sometimes strongly, neither of us has smacked the other in back of the head. Get it?

So here we were last night, disparate Occupiers engaging a Tea Party mouthpiece in a room full of people that have all experienced the vagaries of human interaction under a fairly pressurized circumstance over the past few months. No butterflies fluttered around the room, but no one worked up a bickering session, either. We worked together. All of us. One could recall the old adage that “The enemy of my enemy is my friend,” but that would be devolution. I prefer to imagine that those with arguments present recognized the futility of scrapping amongst friends, if only below the radar of their Egos. Whether my nobler hopes for those pained souls in the room last night are valid or not, the assertions i made in these non-pages well before Occupy began remain true. The system we wrestle against is collapsing around our heads. And the solution is spiritual, to a far greater extent than it is temporal.

Fat Freddy is a comic book character that lives in Denver. Seriously. I met him a little while ago. (This only seems out of place, i promise.) Mr. Constitution Mike Holler expressed the opinion last night that our American republic, our constitutional federation of states, is in its final throes; that we are in a position where, ” it’s too late to save the country, but too early to start shooting.” Mike seemed tentative in expressing his hope that God might pull some kind of supernatural rabbit from his celestial hat to resolve our monumental national woes. I expect he feared perturbing the often non-Christian sensibilities of the Occupiers. He needn’t have worried quite so much–we may be largely skeptical of literal interpretations, but we’re pretty tolerant of that sort of thing. When i met Fat Freddy–an icon of counter-cultural activism important to me since childhood, an old-school Hippie with connection to the most famous and infamous of that crowd–he singled me out and pulled me aside to explain in some detail his expectation for a spiritual upheaval in coming days. Freddy’s taken up with the Urantia Book, a tome i’ve heard Christians disparage as devilish. I couldn’t see anything devilish about what he showed me. He earnestly explained his expectation for resolution. Soon.

We had come to Denver to talk about foreclosures and bank jiggery-pokery with another guy, and pulled up at Freddy’s house without knowing it. It just happened that way. These old Hippies like Tea Party fave, Ron Paul. (Follow along, now, i know it’s weird, and yeah, i know a lot of Occupiers don’t like Paul; i’m not sure about him myself). Also in attendance at that meeting was a woman i had been conversing with on line for quite a while in the context of Occupy. It took me nearly through the whole meeting to recognize her, because i knew her to live down in the Four Corners neighborhood of Colorado. She lives at Freddy’s now. This juxtaposition is so weird that now i’m expecting the Mad Hatter, or Lewis Carroll himself to pop up at some meeting quoting from Jabberwocky. Mike Holler holds out for resolution to the country’s woes in a traditional Christian context. My own suspicion, shared with J.B.S. Haldane, is that the Universe is not only queerer than we suppose, but queerer than we can suppose. But somewhere in the mix i am convinced that some divine Thing many of us think of as God is deeply interested in the little proceedings here on our little blue marble and that our interactions are subsequently and necessarily thus influenced.

We live right here. We have no choice but to manage things on a coarse, physical level; but we also live, i think, on an overlapping and less tangible plane, where we have more influence than we might ordinarily imagine. At the same time, things seem to occur herethere without our conscious direction. We’ll need to keep plugging away at things like grasping the Constitution, and taking on massive, quixotic quests like fighting banks and a world full of renegade, intransigent governments and power brokers, not to mention our own internal battles, as finely defined as within our own Souls. We’ll need to recognize the Truth in one another, even when it’s obscured by a bunch of worldly disagreement and fog. And so far as i can tell, were learning. Whatever that means.

News of Berlusconi’s wiretapped indiscretion via Twitter offered what online translators would not reveal, how to say “unf*ckable” in the languages of your upstream: infollable, onneukbare… his choice of words remain as yet censored in the German press. Wouldn’t it be curious to learn which cultures have no word for the concept? I’d have thought that would be American.

First they came for the Communists, but we don’t like Communists…

First they came for the Communists,?
and I didn’t speak out because I wasn’t a Communist.
Then they came for the Trade Unionists,
?and I didn’t speak out because I wasn’t a Trade Unionist.
Then they came for the Jews,?
and I didn’t speak out because I wasn’t a Jew.
Then they came for me?
and there was no one left to speak out for me.
 
These famous words float an admonition, but isn’t it more likely an adage? They describe the passivity which permitted Hitler’s abuses, but could apply to the ordinary manifestation of totalitarianism. Has human nature yet learned except in hindsight? First they came for the Communists, but we all spoke out, the end. That’s because the big lie is “they.” Try substituting “we” and you see the tsunamic inevitability of mob ethnocentrism. First we came for the Communists, Trade Unionists, and Jews, then him, then her, pure fun until it was me. Oops.

This quote, spoken by German priest Martin Niemoll, features prominently in the US Holocaust Museum in Washington DC. When I saw it I made a note to look up what seemed a strange discrepancy. Curiously in their version, the first group to be targeted are Socialists, not Communists. I say curiously, because I wouldn’t bring it up if I didn’t think the distinction was very unfortunate.

There are several variations of this “poem” because Niemoll repeated it in many sermons and never wrote it down. Asked about it through the years, sometimes he included Jehovah’s Witnesses and gays, and omitted others. Never, however, did he fail to mention Communists, and never were they not the first.

Does it make a difference? If you consider that Communists are the beasts of burden for Socialism, yes. If there’s a boogieman of Capitalism, it’s not the straw man Socialist, it’s the grassroots, proletariat Communist. Socialists are the intellectuals. The far less palatable working class are the Communists. How unfortunate to scrub Niemoll’s warning of its authentic historical detail. The Nazis first came for the Communists.

Bed bugs have made a comeback in the lives of the American poor, lending an uncomfortable new relevance to a folk bedtime salutation. Imagine if we said “Goodnight, don’t let the butterflies bite.” That carries no folk wisdom whatever.

And so how perverse that a traditionally maligned group such as the Jews, firmly ensconcing themselves on Niemoll’s list, decide another unpopular group needn’t the same protection. Doesn’t it defeat the very threat the old priest wanted us to think about? Yes, each group is meant to represent people in general, universality. But it doesn’t work to say bunnies, or amiable characteristics, because then the prospect doesn’t make sense, our youngsters are made vigilant facing a direction from which an attack never comes.

If the exclusion of Communists was a concession to the perennial Red Scare climate of the US capitol, it sadly confirms why Martin Niemoll’s warning won’t find purchase. Even in a Holocaust Museum dedicated to “never again” coming after people based on their social group, some don’t care about looking out for the most vulnerable.

Imagine Niemoll’s dictum as paraphrased for the Hindu castes. Imagine the Brahmins reciting it, leaving off the untouchables.

Robert Fisk and the language of power, danger words: Competing Narratives

Celebrated reporter -and verb- Robert Fisk had harsh words, “danger words” he called them, for host Al-Jazeera where he gave an address about the language of power which has infected newsman and reader alike. Beware your unambiguous acceptance of empty terms into which state propagandists let you infer nuance: power players, activism, non-state actors, key players, geostrategic players, narratives, external players, meaningful solutions, –meaning what?
I’ll not divulge why these stung Al-J, but I’d like to detail the full list, and commit not to condone their false usage at NMT, without ridicule, “quotes” or disclaimer.

Fisk listed several expressions which he attributes to government craftsmen. Unfortunately journalists have been parroting these terms without questioning their dubious meaning. Fisk began with a favorite, the endless, disingenuous, “peace process.” What is that – victor-defined purgatory? Why would “peace” be a “process” Fisk asks.

How appropriate that some of the West’s strongest critics are linguists. Fisk lauded the current seagoing rescue of Gaza, the convoy determined to break the Israeli blockade. He compared it to the Berlin Airlift, when governments saw fit to help besieged peoples, even former enemies. This time however, the people have to act where their governments do not.

I read recently that the Gaza Freedom Flotilla might be preparing accommodations for Noam Chomsky to join the passage. Won’t that be an escalation? I imagine if Robert Fisk would climb aboard too, it would spell doom for any chance the relief supplies would reach the Gazans. A ship convoy with Chomsky and Fisk on board would present an opportunity that an Israeli torpedo could not resist.

Here is his list. If you can’t peruse the lecture, at least ponder these words with as much skepticism as you can. The parenthesis denote my shorthand.

peace process (detente under duress, while enduring repression)

“Peace of the Brave” (accept your subjugation, coined for Algeria, then France lost)

“Hearts and Minds” (Vietnam era psych-ops, then US lost)

spike (to avoid saying: increase)

surge (reinforcements, you send them in you’re losing)

key players (only puppets and their masters need apply)

indirect talks (concurrent soliloquies, duets performed solo in proximity to common fiddler calling tune)

competing narratives (parallel universes in one? naturally the perpetrator is going to tell a different tale, disputing that of victim’s; ungoing result is no justice and no injustice) examples:

wall vs. security barrier;
colonization vs settlements, outposts or Jewish neighborhoods.

Af-Pak (ignores third party India and thus dispute to Kashmir)

Robert Fisk, The Independent newspaper’s Middle East correspondent, gave the following address to the fifth Al Jazeera annual forum on May 23.

Power and the media are not just about cosy relationships between journalists and political leaders, between editors and presidents. They are not just about the parasitic-osmotic relationship between supposedly honourable reporters and the nexus of power that runs between White House and state department and Pentagon, between Downing Street and the foreign office and the ministry of defence. In the western context, power and the media is about words – and the use of words.

It is about semantics.

It is about the employment of phrases and clauses and their origins. And it is about the misuse of history; and about our ignorance of history.

More and more today, we journalists have become prisoners of the language of power.

Is this because we no longer care about linguistics? Is this because lap-tops ‘correct’ our spelling, ‘trim’ our grammar so that our sentences so often turn out to be identical to those of our rulers? Is this why newspaper editorials today often sound like political speeches?

Let me show you what I mean.

For two decades now, the US and British – and Israeli and Palestinian – leaderships have used the words ‘peace process’ to define the hopeless, inadequate, dishonourable agreement that allowed the US and Israel to dominate whatever slivers of land would be given to an occupied people.

I first queried this expression, and its provenance, at the time of Oslo – although how easily we forget that the secret surrenders at Oslo were themselves a conspiracy without any legal basis. Poor old Oslo, I always think! What did Oslo ever do to deserve this? It was the White House agreement that sealed this preposterous and dubious treaty – in which refugees, borders, Israeli colonies – even timetables – were to be delayed until they could no longer be negotiated.

And how easily we forget the White House lawn – though, yes, we remember the images – upon which it was Clinton who quoted from the Qur’an, and Arafat who chose to say: “Thank you, thank you, thank you, Mr. President.” And what did we call this nonsense afterwards? Yes, it was ‘a moment of history’! Was it? Was it so?

Do you remember what Arafat called it? “The peace of the brave.” But I don’t remember any of us pointing out that “the peace of the brave” was used originally by General de Gaulle about the end of the Algerian war. The French lost the war in Algeria. We did not spot this extraordinary irony.

Same again today. We western journalists – used yet again by our masters – have been reporting our jolly generals in Afghanistan as saying that their war can only be won with a “hearts and minds” campaign. No-one asked them the obvious question: Wasn’t this the very same phrase used about Vietnamese civilians in the Vietnam war? And didn’t we – didn’t the West – lose the war in Vietnam?

Yet now we western journalists are actually using – about Afghanistan – the phrase ‘hearts and minds’ in our reports as if it is a new dictionary definition rather than a symbol of defeat for the second time in four decades, in some cases used by the very same soldiers who peddled this nonsense – at a younger age – in Vietnam.

Just look at the individual words which we have recently co-opted from the US military.

When we westerners find that ‘our’ enemies – al-Qaeda, for example, or the Taliban -have set off more bombs and staged more attacks than usual, we call it ‘a spike in violence’. Ah yes, a ‘spike’!

A ‘spike’ in violence, ladies and gentlemen is a word first used, according to my files, by a brigadier general in the Baghdad Green Zone in 2004. Yet now we use that phrase, we extemporise on it, we relay it on the air as our phrase. We are using, quite literally, an expression created for us by the Pentagon. A spike, of course, goes sharply up, then sharply downwards. A ‘spike’ therefore avoids the ominous use of the words ‘increase in violence’ – for an increase, ladies and gentlemen, might not go down again afterwards.

Now again, when US generals refer to a sudden increase in their forces for an assault on Fallujah or central Baghdad or Kandahar – a mass movement of soldiers brought into Muslim countries by the tens of thousands – they call this a ‘surge’. And a surge, like a tsunami, or any other natural phenomena, can be devastating in its effects. What these ‘surges’ really are – to use the real words of serious journalism – are reinforcements. And reinforcements are sent to wars when armies are losing those wars. But our television and newspaper boys and girls are still talking about ‘surges’ without any attribution at all! The Pentagon wins again.

Meanwhile the ‘peace process’ collapsed. Therefore our leaders – or ‘key players’ as we like to call them – tried to make it work again. Therefore the process had to be put ‘back on track’. It was a railway train, you see. The carriages had come off the line. So the train had to be put ‘back on track’. The Clinton administration first used this phrase, then the Israelis, then the BBC.

But there was a problem when the ‘peace process’ had been put ‘back on track’ – and still came off the line. So we produced a ‘road map’ – run by a Quartet and led by our old Friend of God, Tony Blair, who – in an obscenity of history – we now refer to as a ‘peace envoy’.

But the ‘road map’ isn’t working. And now, I notice, the old ‘peace process’ is back in our newspapers and on our television screens. And two days ago, on CNN, one of those boring old fogies that the TV boys and girls call ‘experts’ – I’ll come back to them in a moment – told us again that the ‘peace process’ was being put ‘back on track’ because of the opening of ‘indirect talks’ between Israelis and Palestinians.

Ladies and gentlemen, this isn’t just about clichés – this is preposterous journalism. There is no battle between power and the media. Through language, we have become them.

Maybe one problem is that we no longer think for ourselves because we no longer read books. The Arabs still read books – I’m not talking here about Arab illiteracy rates – but I’m not sure that we in the West still read books. I often dictate messages over the phone and find I have to spend ten minutes to repeat to someone’s secretary a mere hundred words. They don’t know how to spell.

I was on a plane the other day, from Paris to Beirut – the flying time is about three hours and 45 minutes – and the woman next to me was reading a French book about the history of the Second World War. And she was turning the page every few seconds. She had finished the book before we reached Beirut! And I suddenly realised she wasn’t reading the book – she was surfing the pages! She had lost the ability to what I call ‘deep read’. Is this one of our problems as journalists, I wonder, that we no longer ‘deep read’? We merely use the first words that come to hand …

Let me show you another piece of media cowardice that makes my 63-year-old teeth grind together after 34 years of eating humus and tahina in the Middle East.

We are told, in so many analysis features, that what we have to deal with in the Middle East are ‘competing narratives’. How very cosy. There’s no justice, no injustice, just a couple of people who tell different history stories. ‘Competing narratives’ now regularly pop up in the British press. The phrase is a species – or sub-species – of the false language of anthropology. It deletes the possibility that one group of people – in the Middle East, for example – are occupied, while another group of people are doing the occupying. Again, no justice, no injustice, no oppression or oppressing, just some friendly ‘competing narratives’, a football match, if you like, a level playing field because the two sides are – are they not – ‘in competition’. It’s two sides in a football match. And two sides have to be given equal time in every story.

So an ‘occupation’ can become a ‘dispute’. Thus a ‘wall’ becomes a ‘fence’ or a ‘security barrier’. Thus Israeli colonisation of Arab land contrary to all international law becomes ‘settlements’ or ‘outposts’ or ‘Jewish neighbourhoods’.

You will not be surprised to know that it was Colin Powell, in his starring, powerless appearance as secretary of state to George W. Bush, who told US diplomats in the Middle East to refer to occupied Palestinian land as ‘disputed land’ – and that was good enough for most of the American media.

So watch out for ‘competing narratives’, ladies and gentlemen. There are no ‘competing narratives’, of course, between the US military and the Taliban. When there are, however, you’ll know the West has lost.

But I’ll give you a lovely, personal example of how ‘competing narratives’ come undone. Last month, I gave a lecture in Toronto to mark the 95th anniversary of the 1915 Armenian genocide, the deliberate mass murder of one and a half million Armenian Christians by the Ottoman Turkish army and militia. Before my talk, I was interviewed on Canadian Television, CTV, which also owns the Toronto Globe and Mail newspaper. And from the start, I could see that the interviewer had a problem. Canada has a large Armenian community. But Toronto also has a large Turkish community. And the Turks, as the Globe and Mail always tell us, “hotly dispute” that this was a genocide. So the interviewer called the genocide “deadly massacres”.

Of course, I spotted her specific problem straight away. She could not call the massacres a ‘genocide’, because the Turkish community would be outraged. But equally, she sensed that ‘massacres’ on its own – especially with the gruesome studio background photographs of dead Armenians – was not quite up to defining a million and a half murdered human beings. Hence the ‘deadly massacres’. How odd!!! If there are ‘deadly’ massacres, are there some massacres which are not ‘deadly’, from which the victims walk away alive? It was a ludicrous tautology.

In the end, I told this little tale of journalistic cowardice to my Armenian audience, among whom were sitting CTV executives. Within an hour of my ending, my Armenian host received an SMS about me from a CTV reporter. “Shitting on CTV was way out of line,” the reporter complained. I doubted, personally, if the word ‘shitting’ would find its way onto CTV. But then, neither does ‘genocide’. I’m afraid ‘competing narratives’ had just exploded.

Yet the use of the language of power – of its beacon-words and its beacon-phrases -goes on among us still. How many times have I heard western reporters talking about ‘foreign fighters’ in Afghanistan? They are referring, of course, to the various Arab groups supposedly helping the Taliban. We heard the same story from Iraq. Saudis, Jordanians, Palestinian, Chechen fighters, of course. The generals called them ‘foreign fighters’. And then immediately we western reporters did the same. Calling them ‘foreign fighters’ meant they were an invading force. But not once – ever – have I heard a mainstream western television station refer to the fact that there are at least 150,000 ‘foreign fighters’ in Afghanistan. And that most of them, ladies and gentlemen, are in American or other Nato uniforms!

Similarly, the pernicious phrase ‘Af-Pak’ – as racist as it is politically dishonest – is now used by reporters when it originally was a creation of the US state department, on the day that Richard Holbrooke was appointed special US representative to Afghanistan and Pakistan. But the phrase avoided the use of the word ‘India’ whose influence in Afghanistan and whose presence in Afghanistan, is a vital part of the story. Furthermore, ‘Af-Pak’ – by deleting India – effectively deleted the whole Kashmir crisis from the conflict in south-east Asia. It thus deprived Pakistan of any say in US local policy on Kashmir – after all, Holbrooke was made the ‘Af-Pak’ envoy, specifically forbidden from discussing Kashmir. Thus the phrase ‘Af-Pak’, which totally deletes the tragedy of Kashmir – too many ‘competing narratives’, perhaps? – means that when we journalists use the same phrase, ‘Af-Pak’, which was surely created for us journalists, we are doing the state department’s work.

Now let’s look at history. Our leaders love history. Most of all, they love the Second World War. In 2003, George W. Bush thought he was Churchill as well as George W. Bush. True, Bush had spent the Vietnam war protecting the skies of Texas from the Vietcong. But now, in 2003, he was standing up to the ‘appeasers’ who did not want a war with Saddam who was, of course, ‘the Hitler of the Tigris’. The appeasers were the British who did not want to fight Nazi Germany in 1938. Blair, of course, also tried on Churchill’s waistcoat and jacket for size. No ‘appeaser’ he. America was Britain’s oldest ally, he proclaimed – and both Bush and Blair reminded journalists that the US had stood shoulder-to-shoulder with Britain in her hour of need in 1940.

But none of this was true.

Britain’s old ally was not the United States. It was Portugal, a neutral fascist state during World War Two. Only my own newspaper, The Independent, picked this up.

Nor did America fight alongside Britain in her hour of need in 1940, when Hitler threatened invasion and the German air force blitzed London. No, in 1940 America was enjoying a very profitable period of neutrality – and did not join Britain in the war until Japan attacked the US naval base at Pearl Harbour in December of 1941.

Ouch!

Back in 1956, I read the other day, Eden called Nasser the ‘Mussolini of the Nile’. A bad mistake. Nasser was loved by the Arabs, not hated as Mussolini was by the majority of Africans, especially the Arab Libyans. The Mussolini parallel was not challenged or questioned by the British press. And we all know what happened at Suez in 1956.

Yes, when it comes to history, we journalists really do let the presidents and prime ministers take us for a ride.

Today, as foreigners try to take food and fuel by sea to the hungry Palestinians of Gaza, we journalists should be reminding our viewers and listeners of a long-ago day when America and Britain went to the aid of a surrounded people, bringing food and fuel – our own servicemen dying as they did so – to help a starving population. That population had been surrounded by a fence erected by a brutal army which wished to starve the people into submission. The army was Russian. The city was Berlin. The wall was to come later. The people had been our enemies only three years earlier. Yet we flew the Berlin airlift to save them. Now look at Gaza today. Which western journalist – and we love historical parallels – has even mentioned 1948 Berlin in the context of Gaza?

Look at more recent times. Saddam had ‘weapons of mass destruction’ – you can fit ‘WMD’ into a headline – but of course, he didn’t, and the American press went through embarrassing bouts of self-condemnation afterwards. How could it have been so misled, the New York Times asked itself? It had not, the paper concluded, challenged the Bush administration enough.

And now the very same paper is softly – very softly – banging the drums for war in Iran. Iran is working on WMD. And after the war, if there is a war, more self-condemnation, no doubt, if there are no nuclear weapons projects.

Yet the most dangerous side of our new semantic war, our use of the words of power – though it is not a war since we have largely surrendered – is that it isolates us from our viewers and readers. They are not stupid. They understand words, in many cases – I fear – better than we do. History, too. They know that we are drowning our vocabulary with the language of generals and presidents, from the so-called elites, from the arrogance of the Brookings Institute experts, or those of those of the Rand Corporation or what I call the ‘THINK TANKS’. Thus we have become part of this language.

Here, for example, are some of the danger words:

· POWER PLAYERS

· ACTIVISM

· NON-STATE ACTORS

· KEY PLAYERS

· GEOSTRATEGIC PLAYERS

· NARRATIVES

· EXTERNAL PLAYERS

· PEACE PROCESS

· MEANINGFUL SOLUTIONS

· AF-PAK

· CHANGE AGENTS (whatever these sinister creatures are).

I am not a regular critic of Al Jazeera. It gives me the freedom to speak on air. Only a few years ago, when Wadah Khanfar (now Director General of Al Jazeera) was Al Jazeera’s man in Baghdad, the US military began a slanderous campaign against Wadah’s bureau, claiming – untruthfully – that Al Jazeera was in league with al-Qaeda because they were receiving videotapes of attacks on US forces. I went to Fallujah to check this out. Wadah was 100 per cent correct. Al-Qaeda was handing in their ambush footage without any warning, pushing it through office letter-boxes. The Americans were lying.

Wadah is, of course, wondering what is coming next.

Well, I have to tell you, ladies and gentlemen, that all those ‘danger words’ I have just read out to you – from KEY PLAYERS to NARRATIVES to PEACE PROCESS to AF-PAK – all occur in the nine-page Al Jazeera programme for this very forum.

I’m not condemning Al Jazeera for this, ladies and gentlemen. Because this vocabulary is not adopted through political connivance. It is an infection that we all suffer from – I’ve used ‘peace process’ a few times myself, though with quotation marks which you can’t use on television – but yes, it’s a contagion.

And when we use these words, we become one with the power and the elites which rule our world without fear of challenge from the media. Al Jazeera has done more than any television network I know to challenge authority, both in the Middle East and in the West. (And I am not using ‘challenge’ in the sense of ‘problem’, as in ‘”I face many challenges,” says General McCrystal.’)

How do we escape this disease? Watch out for the spell-checkers in our lap-tops, the sub-editor’s dreams of one-syllable words, stop using Wikipedia. And read books – real books, with paper pages, which means deep reading. History books, especially.

Al Jazeera is giving good coverage to the flotilla – the convoy of boats setting off for Gaza. I don’t think they are a bunch of anti-Israelis. I think the international convoy is on its way because people aboard these ships – from all over the world – are trying to do what our supposedly humanitarian leaders have failed to do. They are bringing food and fuel and hospital equipment to those who suffer. In any other context, the Obamas and the Sarkozys and the Camerons would be competing to land US Marines and the Royal Navy and French forces with humanitarian aid – as Clinton did in Somalia. Didn’t the God-like Blair believe in humanitarian ‘intervention’ in Kosovo and Sierra Leone?

In normal circumstances, Blair might even have put a foot over the border.

But no. We dare not offend the Israelis. And so ordinary people are trying to do what their leaders have culpably failed to do. Their leaders have failed them.

Have the media? Are we showing documentary footage of the Berlin airlift today? Or of Clinton’s attempt to rescue the starving people of Somalia, of Blair’s humanitarian ‘intervention’ in the Balkans, just to remind our viewers and readers – and the people on those boats – that this is about hypocrisy on a massive scale?

The hell we are! We prefer ‘competing narratives’. Few politicians want the Gaza voyage to reach its destination – be its end successful, farcical or tragic. We believe in the ‘peace process’, the ‘road map’. Keep the ‘fence’ around the Palestinians. Let the ‘key players’ sort it out.

Ladies and gentlemen, I am not your ‘key speaker’ this morning.

Obama wants his Katrina kept on QT

President Obama rationalizes not prosecuting his Bush predecessors because he wants to look forward not back. Who knew that he meant “back” to the future as well? The Obama administration has get-out-of-jail-free cards for Goldman Sachs et al, and they’re already fouling the evidence that could be used against BP. It serves BP’s interest to pretend their Gulf spill is spewing only five thousand barrels a day. Now even the government is pretending everyone is too busy with the cleanup to measure exactly. It can’t be for want of a lesser-decimal soundbite, experts have the blowout pinned at a similar-syllable’d four million gallons per day.

The government and BP’s incuriosity ignores current estimates that the flow of crude oil escaping the well is between 76,000 and 104,000 barrels, 95,000 being the mean which yields a figure of 1/3 of the Exxon Valdez disaster PER DAY.

Of course as the spill grows to round Florida and reach Cuba and the Atlantic coast, the White House is prepared to forecast that the flow has gotten worse. So far chemical dispersants are diluting the muck that is the public’s only measure of the catastrophe.

The Miami Herald quotes Houston engineer and blogger Bob Cavnar who suggests that industry approximations which the media has been parroting are simply bullshit:

“I’m sitting here looking at it right now, and it ain’t 5,000 barrels a day, I’ll guarantee it … In Houston, there’s about 125,000, 150,000 engineers. And all the engineers can calculate what the flow is.”

Counterfeiting Iran’s Green Movement

Here’s an interesting twist on currency counterfeiting: the forged defacement of Iranian banknotes. Sure it’s a real bill, with real doodles, but did it circulate beyond anyone’s kitchen table? Hmm.

At this moment, Iranian students are protesting a video aired by the government purporting to depict demonstrators defiling a poster of the Ayatollah. They assert the footage was fabricated to accuse them of being counter-revolutionaries. In such a climate, how likely is it students are defacing his image on currency and then passing it on?

It appears to me, this “Banknote Uprising” meme is a shameless and unimaginative contrivance, devised in some expat’s Parisian apartment, to pretend Tehran is being flooded with green-marked bills, hoping to prompt real Iranians to take real risks for such a scheme.

A French account quotes a “Alireza, an artist and journalist in Tehran.”

“Mirhossein Mousavi asked young people to use their imagination. And that’s what they’ve done. These banknotes, marked with images and slogans, are everywhere. I have some myself. The central bank tried to take them out of circulation, but there are so many, they had to give up on the idea. For the young people it’s a way of saying ‘We’re here. The green movement is still going on.'”

You can trace the “Banknote Uprising” story from here to here. A closer source being perhaps here. None offer a hint about from where the bills emerged, or even why we should conclude they have been penned by students.

Customizing currency is an easy thing to do in the privacy of your own home, you can even mount and frame your work, or immortalize it on the internet. But is it fair to pretend it passed through the hands of accomplices and ordinary citizens, merchants and bankers, and back again?

Even in America, imagine writing something unpopular on a bill, and trying to convince a local business owner to accept it, knowing he has to exchange it with others, make the same pitch, and ultimately someone has to cough it up to a bank teller. In America the only penalty you face is the proverbial admonishment that it’s a federal crime to deface US currency, yada yada. But what if the person on the other side of the transaction is really offended? Can you do it anonymously? Money passing hands is the very definition of paper trail.

The gist of this meme is to suggest that disenfranchisement with the government is so prevalent that dissenting slogans are circulating freely as citizens pass money from one to another. Is that true? It supports the theory that the last elections in Iran were stolen. But no evidence of fraud has emerged except as made by the US-backed reform parties. The usual international election watchdogs do not report the wrongdoings they observed in abundance in Afghanistan for example.

Writing slogans on currency is not uncommon. Before the last election, I know people who wrote pro-Obama on every bill that passed their hands. Before that there was always something cute to pass along on dollar bills. Kilroy was here, maybe? But I don’t recall any examples of those marked bills or others, coming back.

The Green Movement protesters of Tehran deserve our admiration for their heroism. Not because they represent a democratic uprising, but for being caught between a repressive system, and Western agitators bent on contriving dissent to serve their own goals of regime change.

I think the forgers give themselves away with their choice of slogans. Have a gander at: Khamenei the non-believer is servant of Putin. OR They stole oil money and give it to Chavez. Best of all are the photos of half-dozen bills marked with a rubber stamp, arrayed before the stamp and ink pad. That’s a how-to illustration, not evidence of currency floating through the market.

Shah of Iran on banknoteThe reporting references Iran’s cultural heritage of marking banknotes with dissenting messages. An example is provided of a banknote with the image of the Shah of Iran, defaced by a rubber stamp on the occasion of the Islamic Revolution. But that’s quite another case, where Iran’s currency couldn’t be pulled immediately upon the Shah’s downfall. The existing bills had to be laundered with an official stamp until new bills could be printed to replace them.

Banknote Uprising we can wish. Do it yourself, but don’t con others into acts you’re not foolhardy enough to try yourself.

Ward Churchill to speak for O’odham

O'odham rightsAccording to Censored News, Activist and scholar Ward Churchill will speak at the Unitarian Universalist Church of Tucson, 4831 W. 22nd St., on November 13, 2009 at 7:00 p.m. to benefit O’odham VOICE Against the Wall, which since 2003 has organized and advocated for the traditional O’odham leaders and elders of the Tohono O’odham communities in the southern territory of the United States and northern territory of Mexico. Professor Churchill’s talk is part of the “Apartheid in America: Surviving Occupation in O’odham Lands”

The People Who Emerged From the Earth

Over two thousand years ago the descendents of the O’odham moved into the southwestern region of the area now claimed by the U.S. as the state of Arizona. 1 The O’odham have had one of the longest histories of contact with the forces of European colonization compared with the rest of the native North American peoples. The O’odham’s first contact with Spanish invaders took place in the mid 16th century; nearly one hundred years before the colonization of the North Atlantic coast and Great Lakes regions were begun by the French and English colonists. As such, the history of the O’odham provides a good context for an investigation of the colonization of Native North America, and more specifically, an investigation of the interplay between, and results of, the varied responses to colonization – that of collaboration, accommodation, and resistance.

Many histories of the O’odham refer to these desert people as the Papago. The term Papago was a name given to the O’odham by the Spanish colonizers, and is likely the result of a Spanish corruption of the O’odham word “papabi” which was the O’odham name for one of their principal bean varieties. Thus, the Spanish colonizers term for the O’odham (Papago) came to mean “the bean eaters.” 2 For the purposes of this study I will refrain from the use of the term Papago and will refer to “the people” 3 by their traditional pre-colonial name. 4

As is often the case, with the name Papago being a good example, European constructs are often imposed upon indigenous peoples by the historians that seek to portray their past. This result can occur when historians seek to glorify European norms and traditions at the expense of indigenous ones, and can also be the result of the subconscious indoctrination of the historian by the dominant culture – in this case that of western style industrial civilization. In other cases it can be the result of a simple uncritical usage of language.

One of the most dominant and reoccurring “civilized” constructs imposed upon indigenous peoples history is the commonly understood notion that the O’odham, or any other indigenous North American culture for that matter, existed as a totality or uniformed mass. This study will seek to use the history of the interaction between the O’odham peoples and the United States, both its government and its peoples, to deconstruct this myth of the totality and provide a history of the O’odham’s varied responses to colonization from an anti-colonial and anti-industrial perspective. By investigating various important case studies in O’odham history, and looking not only at resistance but also accommodation and collaboration, it is hoped that this work will help to provide a more realistic historical picture of the effects of colonization, and the intentions and reactions of both the colonizer and the colonized. Within the previously stated context and theoretical framework, this study will argue that while the O’odham responded to the U.S. invasion of their lands in various ways, the choices to resist, accommodate, or collaborate with the forces of colonization did not affect the overall U.S. policy concerning the O’odham – that policy being the eventual total assimilation of the O’odham into the dominant “civilized” industrial system. 5

This investigation will include a strong focus on O’odham resistance to colonization, as any anti-colonial history should, however it will not discount or ignore the many historical occurrences of accommodation, and in some cases outright collaboration, with the colonizers. It is important to always keep in mind that none of the actions and reactions in any of the case studies looked at are attributable to the O’odham as a “totality,” but rather are attributable only to the various groupings of O’odham, be they incarnated in the form of the individual, the clan, the village, an economic or spiritual grouping, or an established political organization.

A God of Civilization and Coercion Comes to the O’odham

The O’odham’s first encounter with Spanish invaders took place in the mid sixteenth century when a group of conquistadors led by Alvaro Nunez Cabeza de Vaca entered O’odham territory in search of gold. These men did not find the riches they were looking for and left the desert region to return to the Spanish colony. However, soon after word spread of the O’odham villages on the northern periphery of the Spanish colony, missionaries began to travel north to bring God and “civilization” to the native people residing there. By 1686, Catholic missionaries had formed a few small missions in O’odham territory using what they believed to be the influence of their soft power 6 techniques to lure the O’odham into their missions where they were then subjected to a rigorous schedule of cultural indoctrination. Most O’odham historians, including Winston Erickson, 7 and to a lesser extent, Bernard Fontana 8 have, during this time period, focused on the O’odham who chose to reside nearby and within these early missions, thus painting a picture of the O’odham as accepting of Spanish influence and cultural indoctrination.

However a closer look at this time period reveals that mission O’odham were only a small percentage of the total population of O’odham residing in the Sonoran desert 9 and that the ones who were there may not have been so for the reasons that the colonizers believed. San Xavier del Bac, the largest mission in O’odham lands, as well as many other missions, took advantage of the fact that the desert O’odham migrated in the dry winter months to the Northern Piman settlements along the rivers to work the small farm plots for sustenance. 10 The Catholic missions inserted themselves into this traditional pattern. Those O’odham who worked and lived near the missions were, for the most part, seasonal residents, which shows that the missions were viewed merely as being of utilitarian value. Thus, the O’odham as a totality were not necessarily accommodating to or interested in anything the missionaries had to offer per se, and when the missionaries began to employ “hard power” techniques and abuse or overstep the grounds for their welcome it did not go without consequence. 11

Accommodating and ignoring the missionaries was not the only response to colonization practiced by the O’odham during the seventeenth and eighteenth centuries. Although historians such as Erickson feel that “the missions did serve the O’odham well….,” 12 that assertion is contradicted by the fact that there were many large scale rebellions waged against the missions from outside and from within. In 1695, 1751, 1756, and 1776, large scale rebellions occurred in which missionaries were killed and their missions burned to the ground. 13 In some cases these rebellions were the doing of joint O’odham/Apache alliances, which is significant considering that many histories of the O’odham and Apache portray them as immemorial enemies. This may be the result of the fact that by the early nineteenth century the Spanish government initiated a campaign of divide and conquer that was continued later by the Mexican and U.S. governments to turn the O’odham and Apache against one another, thus easing the project of their subjugation.

A Change in the Occupation Government: Washington Enters O’odham Lands

In 1821, Mexican Independence from Spain was achieved and interest in the O’odham dropped away nearly entirely. By 1828, the new and secular Mexican government began the process of shutting down the missions in O’odham territory and by 1842, the last of the missions were closed. Soon after, in 1846, the United Stated initiated a war for territorial expansion against Mexico. This war was not of immediate consequence to the O’odham peoples. Isolated in desert regions, the fighting between the two occupation powers affected them little in the short run. However, the signing of the Treaty of Guadalupe Hidalgo in 1848, which ended the war, would lay the foundations for a series of disastrous events which would affect the O’odham in very negative ways.

Of greatest consequence to the O’odham was the fact that the boundary between the United States and Mexico was not finalized by the treaty of Guadalupe Hidalgo. The boundary was designated by Article Five of the Treaty as being an arbitrary line roughly following the 32nd parallel, an area which runs through the southern part of modern Arizona. To the east, the border was provided by the Rio Grande. The exact boundary line along the 32nd parallel was to be decided at a later date. It is also important to note here that the Treaty also provided that all Mexican citizens absorbed by the United States were to be granted U.S. citizenship, which included all indigenous peoples in the annexed territory since under Mexican law they were considered citizens. In the treaty the United States also assumed the responsibility for preventing cross border raiding into Mexico by the southwestern tribes, specifically the Apache. 14

In the aftermath of the signing of the treaty of Guadalupe Hidalgo, it became quickly apparent that an acceptable border between Mexico and the United States along the 32nd parallel would not be achieved. An official survey expedition was assembled by the United States and Mexico in 1849 to trace out the boundary between the two countries with little success. Various borderlines were agreed to and then abandoned and re-made by the United States, sometimes in a unilateral decision that dismissed the positions of the Mexican government altogether. 15

The principal concern for the United States was to secure title to an area of land in northern Sonora, Mexico that was ideally suited for the construction of a portion of the southern continental railroad whose building was being discussed in the U.S. Congress at the time. One of the main advocates for this southern railroad route was a South Carolina man by the name of Colonel James Gadsden. Gadsden’s history of connections to powerful business, military, and political leaders is very interesting and his appointment by the United States to be Minister to Mexico in 1853 serves as a very informative source to gauge the United States’ intentions towards Native Americans and the O’odham in particular.

James Gadsden was born into an influential southern family and graduated from Yale University. After enlisting and serving in the war of 1812, Gadsden was sent to the Florida territory with Andrew Jackson to aid in the campaign of removal and extermination being waged against the Seminole Indians, which took place from 1816-1818. After this war against the Seminole, Gadsden was appointed by President Monroe as commissioner to oversee the removal of the Seminole Indians to Indian Territory. Like the more famous removal of the Cherokee, the removal of the Seminole, and the high death rate suffered as a result, unarguably constituted genocide. 16 As a reward for a job well done, Gadsden was appointed by Monroe to a seat on the legislative council of the territory of Florida, thus beginning Gadsden’s political career. In 1840, Gadsden was elected President of the Louisville, Charleston, and Cincinnati Railroad. In 1853, the Secretary of War, an ardent white supremacist and slavery defender by the name of Jefferson Davis, appointed Gadsden to be Minister to Mexico. 17 As Minister to Mexico, one of Gadsden’s primary missions was to negotiate a final demarcation of the boundary between the U.S. and Mexico. Although Gadsden was a zealous believer in Manifest Destiny, his ideas concerning racial Anglo-Saxonism 18 caused him to be an opponent of the total annexation of Mexico. Gadsden, like many racist U.S. politicians of that time, felt that the total absorption of Mexico and its non-Anglo population into the United States would pollute the Anglo bloodline too much and thus he sought only to gain enough territory for the United States to build the southern pacific route. 19 Thus, a man who had presided over a war of genocide against the Seminole Indians, was a devout racist, and who had obvious conflicts of interest due to his connections to the railroads, was put into a position to determine the territorial boundary between the United States and Mexico and in the process also determine the boundaries of the O’odham’s land. With its appointment of Gadsden, the intent of the U.S. government could not be clearer. Business interests and territorial expansion were to run roughshod, by any means necessary, over any native peoples who stood in the way.

It is no surprise that when James Gadsden finally successfully negotiated a treaty with Santa Anna to secure what is now the southern portion of Arizona, the O’odham were not consulted. In fact, the Gadsden Treaty, signed into law in 1853, did not contain any mention of the O’odham at all. Considering that the new boundary line put in place by the Gadsden Treaty literally split the traditional O’odham lands in two, it is obvious that the intentions of the United States were in no way benevolent. Here it is also important to point out that the terms of the Gadsden Treaty specifically included the same citizenship provisions which were spelled out in the earlier Treaty of Guadalupe Hidalgo. 20 Although the Gadsden treaty was of great significance for the O’odham, their isolation and the outbreak of the Civil War enabled them to live another decade in relative isolation from Anglo encroachment.

Assimilation, Cultural Destruction, Double Speak and Ordained Genocide

The causes which the Almighty originates, when in their appointed time he wills that one race of men – as in races of lower animals – shall disappear off the face of the earth and give place to another race, and so on, in the great cycle traced out by Himself, which may be seen, but has reasons too deep to be fathomed by us. The races of the mammoths and mastodons, and the great sloths, came and passed away: The red man of America is passing away!

No doubt with similar justifications in mind as those of the Committee on Indian Affairs, Anglo settlers began their invasion of O’odham lands less than a year after the conclusion of the Civil War. The Homestead Act had opened up the lands of Southern Arizona to Anglo squatters and in 1866, one of the first of many bills was passed by Congress granting mineral rights to any citizen who claimed them. 22 Every one of these homesteads opened and every resource extraction operation initiated without the express consent of the O’odham represented an illegal action under the Gadsden Treaty. The citizenship provisions of the Gadsden Treaty had granted citizenship to all former Mexican citizens and the O’odham were, by legal definition, included in this formulation. The United States, however, refused to consider “uncivilized” peoples as being worthy of the protections granted to citizens by the fourth amendment of the U.S. Constitution, which prohibits the expropriation of property. This refusal of the United States government to follow its own laws pertaining to Native Americans when those laws happen to stand in the way of U.S. interests has been a common occurrence in United States Indian policy. This land grab was only the first of many illegalities committed against the O’odham people by the United States and its citizens. In this respect the O’odham are in a special position when compared with many other tribes. While the theft of native lands by the United States Government was usually legally justified by treaty stipulations signed between a tribe and the U.S. government, this justification could not and cannot be used in the case of the O’odham since no treaty was ever signed with the O’odham by the United States Government. 23

For the most part, the O’odham did not resist this initial incursion of Anglo settlement, rather the O’odham practiced accommodation and moved farther out into the desert to shield themselves from the new settlers invading their lands. Traditional ways were maintained with the exception of the introduction of cattle ranching. The O’odham territory was well suited for the raising of cattle and a good number of O’odham became cattle ranchers, both for purposes of subsistence as well as for sale to Anglos residing in and around Tucson. In the 1880s, as increasing numbers of Anglo cattle ranchers began to invade and take over their pasture, some O’odham began to resist.

The O’odham resisted by stealing the Anglo cattle herds which were rounded up and driven south to be sold on the Mexican market. The expropriation of Anglo cattle herds was not isolated, and it became a major concern for the settlers and the government. In at least one case, a large cattle outfit was driven out of business. 24 The concern over this outbreak of O’odham theft of Anglo cattle was large enough that newspapers as far away as Los Angeles ran stories about the phenomenon. For the most part these stories seem to have been deliberately used to justify the enclosure of the O’odham into reservations as the government and Anglo cattle ranchers seized the opportunity to gain even more O’odham land by arguing that it was an unfair burden for the Anglo cattle ranchers to have to “support” the O’odham. 25 Here, in previous case study, we have another common attribute of U.S. Indian policy in general, and one which occurs again and again in the history of O’odham contact with the U.S. government and Anglo settlers – blaming the victim.

Another official position of United States Indian policy during this time period was that everything done to the Indians was, in the words of Indian Commissioner J. Q. Smith, in their own “best interests.” 26 Whether this obvious sham was based on a subconscious guilt and delusion or was a cynical example of “double-speak,” it is obvious that Native American’s best interest’s were the last thing on the government’s mind. Nevertheless, with this reasoning as justification, the first official reservation for the O’odham was created by executive order of President Grant on July 1, 1874. This small reservation surrounded the Old Catholic mission at San Xavier del Bac. It is estimated that only about ten percent 27 of the desert O’odham took up residence within this reservation – these were labeled as “civilized” O’odham by U.S. census takers. The vast majority of O’odham were labeled as “wild” and continued to live in the vast desert regions west of San Xavier del Bac. While it is obvious that the desert O’odham were resisting cultural assimilation by avoidance, even the mission O’odham maintained a resistance to European culture as the next example will illustrate.

While visiting the old mission at San Xavier a newspaper columnist from the Los Angeles Times wrote that upon her visit in 1882, she could see “not a single civilized human habitation within miles.” This writer goes on to state that the O’odham’s dwellings were in the form of “conical mud huts.” In the casual racism and Social Darwinist rhetoric of the period she also adds that,

“The Papagos are but little in advance of gophers and prairie dogs in their habitations.” 28

The point is that after more than 200 years of European influence, even the mission O’odham continued to build their traditional shelters. 29

Progressivism and Cultural Genocide: The Dawes Act

In 1887, the General Allotment Act, also known as the Dawes Act, was signed into law. The Dawes Act was the staging point for the forced assimilation of those remnants of Native American groupings which had not been totally decimated by the preceding period of “Indian Wars” and forced relocations. The essential function of the Dawes Act was to disrupt traditional tribal land holding patterns and thus force Native Americans into the Anglo system of private property. The O’odham, like most other Native American cultures, did not have a concept of private property – land was held in common for the benefit of the village group. Communally held land was an essential pre-requisite for their Anarchistic political system and extremely de-centralized tribal structure. 30

The first section of the Dawes Act provides for equal “sections” of land to be parceled out to each “head of family.” This head of family was always understood to be the father of each family when land was allotted. Thus, this first section of the act not only attempted to destroy the communal land system of Native Americans, it also instituted Patriarchy as the basis for social functioning in Native America. 31 In addition, Section Five of the Act also provides that any un-allotted lands be subject to purchase by the United States government. Section Six and Seven provide that all monies paid by the U.S. for un-allotted Native lands be held for each tribe by the U.S. Treasury and “subject to appropriation” by the U.S. government to repay itself for the implementation of allotment as well as to provide for the “civilization” of Native Americans. 32 In less veiled words, these sections are basically stating that Native Americans will be forced to pay for their own cultural annihilation.

This interpretation of the intent of the Dawes Act becomes clearer when one looks at the arguments and debates that took place in Congress and within self described progressive “Indian rights” groups such as the Indian Rights Association. Critics of the Dawes Act in Congress such as Rep. Russell Errett understood that

“the main purpose of this bill is not to help the Indian troubles so much as it is to provide a method for getting at the valuable Indian lands and opening them up for settlement.” 33

And Senator Dawes, the namesake of the final bill, speaking of the land and resources of Native Americans stated that

“civilization has got after these possessions with a greed never before equaled but it is idle to expect to stay it….” 34

As for the progressive Indian Rights Association, they argued that

“the organization of the Indians into tribes is, and has been, one of the most serious hindrances to the advancement of civilization, and that every effort should be made to secure disintegration of all tribal organizations….” 35

And one of their leaders, Reverend L. Abbott, provided justification with the statement:

“Barbarism has no rights which civilization is bound to respect.” 36

So here we have a self-proclaimed progressive Indian Rights organization arguing for cultural genocide and against the notion that Native Americans have any rights that civilized people are bound to respect! This conclusion provides a perfect example of the essence of “progressive” or “civilized” thought.

The Dawes Act had a much less devastating effect for the O’odham than it did for many other Native American tribes. At the time of its passage, the only official reservation for the O’odham was the San Xavier reservation which, as was stated earlier, was only a small 71,090 acre reservation around the old mission San Xavier del Bac. When the allotment agent came to San Xavier in 1890, he allotted out 41,600 acres of land to the 363 O’odham whom he counted in his census as being resident at the time. 37 The vast majority of the O’odham still continued to live west of San Xavier in the expansive desert regions and were little affected by the allotment schemes. Even those O’odham who lived in San Xavier and were allotted land paid little attention to the artificial boundaries drawn on paper which supposedly privatized their land – they continued to farm and graze the land communally. 38 This refusal to abide by the provisions of the Dawes Act is also a form of resistance to cultural assimilation and adds one more example to show that for those O’odham who resisted, the most often employed method of resistance was non-compliance and avoidance. This specific response to colonization was made possible by the isolation and expansiveness of their desert home, which many Anglo’s continued to view as a “hopeless desert.” 39

The Domestication of the “Wild Papago”

The vast majority of the O’odham continued to resist assimilation and maintained a fairly traditional lifestyle – minus the introduction of cattle herding and horse rearing. In the twenty years following the passage of the Dawes Act, a growing effort was made to enclose the “Wild Papago” 40 and forcibly strip them of their traditional culture and instill them with the “civilized” values of the industrial Anglo. As was mentioned previously in the paper, ranchers and the government used O’odham cattle theft from Anglo ranchers as one tool to justify the enclosure of the O’odham within a reservation. During this period, Anglo Cattle ranchers continued to encroach deeper and deeper into O’odham territory and scuffles began to break out.

In another classic example of the “blame the victim” tactic, a pro-enclosure story was printed in the Los Angeles Times, no doubt to build public pressure for the domestication of the “Wild Papago.” The story concerns a group of O’odham who had resisted an Anglo cattleman’s attempts to enclose one of their water sources. When these O’odham continually tore down the fence that this cattleman had built, the rancher filed a report with the local Indian Agency sheriff to have the men arrested. When the sheriff arrived to arrest the O’odham responsible for defending their water source, he was taken hostage. The sheriff was later released unharmed; however, the incident was used to make the argument that such troubles can only be expected to increase if the O’odham were not enclosed on a reservation where they could be more easily controlled and monitored. 41

The tactic of occupying and diverting natural water sources was one of the tools used by the Anglo settlers and government to destroy the self sufficiency of the O’odham and force them into reservations where they would be dependent on the government for their water and would thus be easier to control and monitor. Some of the O’odham clearly understood what was happening, which is evidenced by instances of resistance both to the enclosure of natural water sources as well as resistance to the drilling of wells. One example of the U.S. government using water as a tool of forced cultural assimilation can be found by looking at an event recorded by an O’odham calendar stick 42 keeper. In 1912, the O’odham residing in the village of Santa Rosa, an isolated and traditional village in the western desert region of O’odham territory, were paid a visit by an Anglo Indian Commissioner who wished to drill a well for them. The Chief of the village objected to the drilling of the well on the grounds that it would disturb their culture, their autonomy and their self-sufficiency. The government agent proceeded to have the well drilled anyway. Upon completion of the well, the Chief of the village, according to the calendar stick keeper, stated that

“the well must be left alone and, in order that the Papagos might continue their old life, water must still be carried from the spring in the foothills.” 43

However, the prohibition by the Chief could not be upheld due to the overwhelming convenience of the new well and after a period of abstaining from its usage, the village of Santa Rosa (including the Chief) gave in and thus was assimilated into the industrial system by being made dependent on the Government well. 44 During this same time period, encroaching Anglo farmers engaged in the diversion of O’odham water sources to irrigate their farms. This practice served as another method of forcing the self sufficient O’odham into a relationship of dependence upon the government. In many areas so much water was diverted that the O’odham could no longer grow their traditional summer crops. 45

In 1919, the first incarnation of an O’odham reservation to enclose the nearly two million acres of desert that the “Wild Papago” were residing in was established. The formation of the desert O’odham reservation in 1919 ushered in a period of exponentially increased government interference in O’odham matters, and of course, the various forms of coercive assimilation were multiplied. By 1933, thirty-two unwanted wells were drilled all over the new reservation. 46 The well drilling was often opposed by those who were trying to maintain the O’odham Him’dag – the traditional ways of the desert people.

Resistance and Collaboration: O’odham Responses to Forced Modernization

In contrast to the traditional O’odham who had maintained resistance to cultural assimilation for the past 300 years, there was also a small number of O’odham based in the new reservation that welcomed collaboration with the forces of Anglo modernization and advocated for cultural accommodation and in some instances for total cultural assimilation. These men would later form an organization called the Papago Good Government League, which would serve as the propaganda arm of the Bureau of Indian Affairs and government policy in general. The leadership of this new faction had been taken from their families as youths and placed in Protestant boarding schools to be culturally indoctrinated. The Tucson Presbyterian Training School was one of the indoctrination centers where many future members of the Good Government League had been sent. 47

Religious indoctrination, whether Catholic or Protestant, has always been one of the most powerful tools of colonization and its justification used by European invaders against the indigenous peoples of the Americas. The necessary counterpart to the forced indoctrination of Christian principals and morals has always been the repression of indigenous spiritual practices. The United States government understood the profound power that traditional spiritual practices had in maintaining group solidarity and cohesion and it is for this reason that such spiritual practices were made illegal and repressed historically. In 1883, a Court of Indian Offenses was established by congress at the request of Secretary of Interior Henry M. Teller to eliminate traditional spiritual practices. In a report to the commissioner of Indian Affairs, Teller laid out his goals and his rationale stating that,

“If it is the purpose of the Government to civilize the Indians, they must be compelled to desist from the savage and barbarous practices that are calculated to continue them in savagery….”

Teller went on to associate those who resisted the repression of their spirituality with the “non-progressive” faction of Indians and labeled traditional spiritualism as “debauchery,” “diabolism,” and “savagery.” The overarching argument of his letter is that in order to civilize the Indians and bring them into the industrial system, their traditional spiritualism must be destroyed. As an initial step towards this end, Teller advised that Medicine Men be “compelled” to desist from their practice of “deception.” 48

Although the Court of Indian Offenses advocated that coercion be used to repress and destroy indigenous spiritualism, it failed to succeed in this project even when it used force to try to stop traditional spiritual rituals. According to Historian Edward Spicer, the only thing the Court succeeded in doing was driving traditional spiritual practices underground. In the case of many resistant O’odham, traditional spiritual practices were continued without regard to regulations or prohibitions against them, and in many cases, federal authorities resorted to repression and arrest to try to stop these practices. One traditional spiritual practice of the O’odham which was particularly hated by the Protestant Missionaries and Indian Agents was the Vi-kita ceremony.

The Vi-kita ceremony of the O’odham has been written about and studied by many Anglo historians and anthropologists, the most prominent being Columbia Anthropologist Ruth Underhill. 49 Before going into a short description of the Vi-kita it is important to understand that this ceremony varied depending on who was conducting it and where it was being conducted. Peter Blaine, an influential O’odham man sympathetic to the traditional ways, wrote in his autobiography about Underhill’s methods. Blaine explained the traditional way for the O’odham to tell about their past was to do it

“in a group so that everybody had a chance to talk and tell it their way. Underhill was talking to just one man…Dr. Underhill was wrong all the way in how she got her information.” 50

As scholars from the dominant culture often do, Underhill had applied her own notions of hierarchy, authority and individualism to her work with the O’odham and totally disregarded their traditional methods of conveying information in a communal fashion.

The Vi-kita itself was a yearly rain and fertility festival preformed to initiate and give thanks for the yearly summer rains. The ceremony itself consisted of the communal singing of rain songs, dancing, intimate encounters, and the consumption of Navait (Saguaro wine), an alcoholic drink made by the fermentation of Saguaro Cactus buds. The consumption of this wine was meant to symbolize the connection between the sky and the earth. The intake of the Navait was representative of the earth’s intake of rain. Participants drank Navait until vomiting occurred as this act embodied the clouds issuing forth rain unto the earth. It was a powerful ceremony that bonded the O’odham with the elements of nature.

When Protestant missionaries, and a small number of Protestant O’odham in the Good Government League, backed by U.S. Indian Agents, began their attempts to usurp power on the newly formed western O’odham (Sells) 51 reservation in the early 20th century, one of the first things they attacked was the practice of the Vi-kita ceremony. In the early 1930s, Peter Blaine explained that the traditional O’odham from the San Xavier reservation would travel to the western reservation for the Vi-kita. He states that,

“In the late 1920s the government tried to stop this wine drinking ceremony on the Sells reservation. But no Papago or Agency police could ever stop it.”

In one instance Blaine tells the story of how he helped defend three traditional O’odham Vi-kita ceremony leaders when they were arrested by agents from the Indian Bureau and jailed in Tucson. During the trial, a group of Protestant O’odham men from the Good Government League 52 argued for the repression of the ceremony – one of these men, Richard Hendrix, would continue to plague the traditional O’odham in future encounters. To respond to the collaborationist Good Government League, the resistant traditional O’odham formed the League of Papago Chiefs to counter the attempts of the Protestant Good Government League to usurp control on the reservation. 53

The Indian Reorganization Act and O’odham land rights

On June 18th, 1934, President Roosevelt signed into law the Indian Reorganization Act which finally stopped the forced allotment process initiated by the Dawes Act in 1887. The Indian Reorganization Act was viewed by its proponents as being in the best interests of the Indians. One of the reasons for this view was the fact that the Dawes Act and its forced allotment provisions had resulted in the loss of 90,000,000 acres of tribal lands and it was hoped by some, including then Indian Commissioner John Collier, that the Indian Reorganization Act could be used to regain some of this lost land.

The public was also encouraged to view the Indian Reorganization Act as being beneficial for Native Americans. A large article in the Los Angles Times entitled “The Bill to Return Indian Rights” stated that:

“After a century of graft, plunder and injustice, this bill has the objective of handing their own souls back to the Indians.” 54

However, such optimism and notions of cultural relativism were not held by all. As a precursor to the Indian Reorganization Act, a report was prepared for the Secretary of the Interior in 1928 to lay out the need for a change in Federal Indian Policy. The report stated that the “great majority of Indians are ultimately to merge into the general population” and that it was the government’s responsibility to assimilate Native Americans into “white civilization” because “the hands of the clock cannot be turned backwards.” Sympathetic attempts to help Native Americans retain their culture were stigmatized as attempts to “preserve them as museum specimens.” 55 Indian Commissioner John Collier was one of those who believed that Native Americans should retain their culture and that “the awakening of the racial spirit must be sustained….” 56 However, although the finalized Indian Reorganization Act did contain elements that were meant to “help” Native Americans, many of its articles were still designed to impose “civilized” systems on Native Americans.

It can be argued that the intent of the finalized Indian Reorganization Act was to initiate a new chapter in the push for the total cultural assimilation of the Native American tribes. The argument that there was no qualitative change between the Dawes Act and the Reorganization Act is legitimate. The Indian Reorganization Act provides the examples for the argument. The main tool of assimilation in the Indian Reorganization Act was the provision in Section 17 which allowed for Native American tribes to form their own tribal governments, constitutions and laws which, although it is not specifically stated, were intended to be Anglo in structure and functioning. In the case that these native governments were not sufficiently acceptable to the U.S. government, section 17 also provided that all Tribal Government formations must be “approved by the Secretary of the Interior.” 57 This clearly shows that the intent of the Act was not to allow Native Americans to become fully autonomous, either culturally or politically. For a tribe such as the O’odham, which had a long history of decentralization and consensus decision making, the imposition of western style liberal democracy, with its attendant centralization and majority rule system, was an obvious method of forced cultural indoctrination. Peter Blaine, who was mentioned earlier, was an O’odham man who had sympathy for the traditional, decentralized and communal way of O’odham societal organization. When the collaborationist Papago Good Government League began to maneuver themselves into the position of representing all of the O’odham, Blaine took it upon himself to lead the charge to discredit their assertions to business interests and the Federal Government that they represented the O’odham. Blaine wrote that:

“This so-called council represented only their own church people, but they took it upon themselves to become a council for all Papagos. They had meetings. Nobody attended them but these four guys because most people didn’t recognize them as leaders.” 58

In 1934 Blaine, along with another O’odham from the Gila Bend reservation named Leon Pancho became the first O’odham to travel to Washington D.C. These two men were sent as representatives of the traditional chiefs of the O’odham villages to argue against a recent court order that closed the Sells reservation to outside, Anglo owned, mining. The court order was a result of a lawsuit brought by the members of the Good Government League, including Richard Hendrix, who had teamed up with outside lawyers. These lawyers were to receive as payment a ten percent share of all land reclaimed from the mining companies, or a monetary equivalent. As this entire procedure was done behind the backs of the majority of the O’odham, when it was revealed, there was great resentment towards the Good Government League by many of the O’odham.

While in Washington D.C., Blaine was informed of the pending Indian Reorganization Act, and he became a supporter of the Act due to its provision allowing for the self government of Native Americans, as well as a provision in section Six that allowed the Secretary of Interior to manage mineral, mining, and livestock on the reservation. 59 In the case of the O’odham this meant that the reservation would be re-opened to mining and they would regain an important means of economic sustenance. According to Blaine, the mines were an important economic resource for the O’odham as they provided jobs and a market where beef and other O’odham products could be sold. 60 This is yet another unfortunate example of how the incursion of Anglo industrial technology served to destroy the self-sufficiency of the O’odham by making them dependent on it for survival.

Whether or not the mines were truly in the best interest of the O’odham is a complex topic which cannot be dealt with here. However it should be stated that Blaine and his companions’ trip to Washington D.C. was financed by the Tucson Chamber of Commerce, an organization that functioned in support of the mining interests, not the O’odham. This Tucson Chamber of Commerce was the same organization that had aggressively petitioned President Wilson to rescind his 1916 act forming the Sells reservation because it prevented Anglo agricultural interests from exploiting the area’s “best agricultural and grazing lands.” 61

Resistance to and Collaboration with the “White Man’s War”

Not long after the passage of the Indian Reorganization Act and the formation of the first O’odham Tribal Government, the United States declared war on Japan, thus entering World War II. The participation of Native Americans in World War II has been well publicized, especially the role the Dineh (Navajo) played as code talkers in the South Pacific. The United States government and the mainstream media portrayed Native Americans as being eager to fight for their homeland, and eager to assimilate into “white civilization” once they returned from the war. Nearly 25,000 62 Native Americans served in the United States military during World War II, many of whom were no doubt under the impression that their service would be rewarded with increased “rights” after the war’s end. Instead, as a “reward” for Native Americans participation in World War II the United States government established the Indian Claims commission in 1946 to legalize the U.S. occupation of Native American Lands never granted to the U.S. by treaty, passed House Concurrent Resolution 108 to terminate tribal recognition as separate entities from the Federal Government, and then instituted a plan in 1954 to relocate Native Americans off the reservation and into “Indian Ghettos” in the nation’s large cities. 63 These were the “rewards” for participation in World War II.

Like many other Native American Tribes, some of the O’odham Nations members participated in World War II. Ruth Underhill claims that the O’odham enlisted to serve in World War II “in droves” 64 and it is documented that the O’odham tribal government bought $10,000 in war bonds. 65 However, the extent of this involvement was distorted by the media, academia, and even some of the O’odham leaders in the tribal government. Richard Hendrix, a former member of the collaborationist Good Government League, had risen to prominence in the new O’odham tribal government by this time and was interviewed by the Arizona Archaeological and Historical Society on November 16, 1942. In this interview Hendrix exposed the extent to which he had allowed his mind to be colonized and assimilated into that of the dominant white culture. Speaking of colonization in general and World War II in particular, Hendrix stated that the O’odham had:

Learned to love the American government and they learned to love the Stars and Stripes. And when the war came and the time came for our boys to be registered, there was no exception. They registered just the same as white boys did. And now they are out fighting alongside the white boys, the American boys. They are just as anxious as the white boys to kill as many Japs, to kill as many Germans, and they are very anxious to win this great war so that the Papago people in this desert land may continue to enjoy the freedom of their homes. 66

Hendrix’s internalization of white supremacist racial notions is a heart breaking and shocking example of the extent to which he had accepted the ideology of “white civilization.” In addition, his assertion that every O’odham boy registered for the war with “no exception” is glaringly false.

Aside from the fact that there are always exceptions to everything, there was also a large scale organized resistance to World War II led by an old Chief and medicine man, Pia Machita, and his band of traditional O’odham who resided in an isolated village in the north western area of the Sells Reservation known as the Hickwan district. According to Peter Blaine, the O’odham residing in some of the most isolated villages in the Hickwan district had not seen a white man until the 1930s, and continued to practice the traditional O’odham Him’dag. 67 When Pia Machita was informed of the compulsory registration of young O’odham boys for induction into World War II, he instructed the youth of his village to refuse to sign the registration forms when they were visited by the local Indian Agent. Pia Machita was a very traditional leader who refused cultural assimilation and would not accept the authority of the Bureau of Indian Affairs or the O’odham tribal government. Finally, after all efforts to persuade Pia Machita’s village to register had failed, the tribal chief of police and a gang of Federal Marshals led by U.S. Marshall Ben McKinney invaded the village at two in the morning on October 16th, 1941, with tear gas bombs and guns drawn – when the Marshals attempted to take Pia Machita into custody some of the young men from the village used force to liberate him and severely beat one of the federal marshals. In the face of this resistance, the government agents and their local collaborators retreated to Tucson. When the Attorney General’s Office heard of the resistance on the O’odham reservation, they immediately got involved in the effort to repress this draft resistance movement as quickly as possible to prevent its possible spread to other reservations. By May 17th, 1941, after a period of about six months of trying to track down Pia Machita and his small band of men, Marshall McKinney and O’odham collaborators including Jose Ignacio from the tribal government, surrounded Pia Machita in the village of Stoa Pitk and took him into custody without incident. 68

Peter Blaine was the O’odham tribal chairman during the time that Pia Machita was leading the draft resistance movement. Although he did not believe that Pia Machita and his men were threats in any way, he was annoyed by what he perceived to be their stubbornness and attributed their draft resistance to his belief that they “didn’t really understand what they were doing.” 69 In reality, it was Blaine who did not understand the reasons behind Pia Machita and his men’s resistance to enlistment. Pia Machita and his men understood very well what they were doing – they were resisting giving aid to a government that they understood was their enemy. Given this understanding, and given the dictionary definition of the word “collaboration,” it becomes necessary to label those O’odham who participated in the arrest of Pia Machita as such – collaborators. The understanding that the U.S. government was the enemy of the traditional O’odham of the Hickwan district was based upon a long history of attempts by the U.S. government to force the Traditional O’odham of that area to abandon the Him’dag and embrace elements of Anglo “progress” such as dams, railroads, wells, and the protestant religion. Despite Peter Blaine’s inability to understand why the O’odham in the Hickwan district rejected Anglo-civilization in its totality, he still maintained sympathy for the people there. When Pia Machita and two co-defendants were finally sentenced to serve 18 months in prison at Terminal Island Federal Prison for their roles in leading the resistance movement, Peter Blaine eventually came to their aid and used his connections as tribal chairman to persuade the sentencing Judge to release Pia Machita early and allow him to return to the reservation and his family. 70

Conclusion

The history of the O’odham’s contact with the United States government has been one marked by a persistent current of resistance to cultural assimilation into “white civilization.” This resistance has included a variety of tactics and actions. The favored tactic of resistance to assimilation for many of the O’odham groupings seems to have been that of avoidance and feigned accommodation to Anglo culture when expedient. However, as was evidenced by the O’odham’s early history of contact with the Spanish, they did not refrain from waging armed resistance to colonization when they were pushed into a situation where other tactics might have been ineffectual.

In addition to resistance and accommodation, it has also been shown that some of the O’odham choose to engage in direct collaboration with the Anglo colonization of their lands and minds. As this paper has shown, the levels of collaborative activity amongst the O’odham varied, and so did the effects of such collaboration. When investigating instances of collaboration it is always important to understand the context which produced them and to remember that the ultimate blame for a situation of oppression should always be placed upon the group committing the acts of repression – in this case the United States government and allied business interests. It is important to show such examples of collaboration and to understand that all human cultures who have been the victim of colonization have invariably contained individuals who chose to collaborate for a variety of reasons. The O’odham are no exception to this rule. Making apologies for collaboration or failing to mention the instances where such collaboration did occur creates a historical distortion and does nothing to aid present struggles for liberation.

The O’odham responses to colonization never represented a totality, but a strong current of resistance is evident throughout their history. In regards to the United States government, it can be said, given the primary sources looked at, and the final drafts of laws signed and policies followed, that the intent of the United States government toward all Native American tribes, when it was not outright genocidal, has been the cultural destruction and absorption of remaining Native Americans into the dominant industrial culture of “white civilization.” Regardless of the varying tactics used, and the various lip service about “best interests” and “justice,” it has been shown that there has never been a qualitative change in United States policy toward the O’odham people and Native Americans in general. The O’odham have maintained aspects of their traditional culture despite the best efforts of the government to force assimilation, not as a result of such efforts. A continuing current of struggle between the forces of colonization and resistance has persisted for centuries, in all its various forms, within the minds and bodies of many O’odham and will continue until liberation.

This example is meant to show the insidious nature of industrial technology and is not intended to place any blame on this specific group of O’odham for their ultimate choice to begin using the well. This example is given to show how industrial technology always comes with strings attached. In this case, once the village becomes dependent on the well they in turn become dependent on the Anglo civilization which is needed to maintain the functioning of such a well, and thus become less able to resist other Anglo incursions. Three meals away from revolution

Brochure from ready.govThe phrase is oft quoted, but no one knows who originated it –or, even if it’s true. It could just be an old pharah’s wives tale. But Obama buys it: from the people who brought you hope.gov we’ve now come to ready.gov. Where the White House assures you there is no need to fear coming plagues and pestilence so long as you “Prepare. Plan. Stay Informed.” and be sure to have food for three days.

Is it three meals or nine? Is the consequence anarchy or revolution? The “truism” is commonly sited as being an old Russian expression, but it’s so pithy, others guess it has a literary source like Dumas. A contemporary scholar placed it back much further:

The Romans believed that civilization is never more than three meals away from anarchy.

Of course, when Stalin or Trotsky are thought to have said it, the dire consequence for civilization is revolution. Which is where the saying catches the popular imagination. Internet sleuths are eager to credit the wisdom to a BBC situation comedy. “[Arnold] Rimmer said it in Red Dwarf.” Although two decades before, Science Fiction authors Larry Niven and Jerry Pournelle wrote in Lucifer’s Hammer, that civilization is “only three meals removed from savagery.”

Doubtless in earlier times, you ate well if you could rely on one solid meal every day, which no doubt holds true for the majority of the world still. In the developed nations of course, we cannot see ourselves subsisting on less than three.

The makers of the documentary King Corn interviewed Senator Chuck Grassley about America’s food supply, which is where the expression piqued my interest. Grassley explained: “A society is always nine meals away from a revolution. If you have people going without food for three days and there are enough of them out there, they will revolt.”

Like the “300 pound gorilla” which has now become 900lbs, the units have indexed with man’s inflated prosperity, likewise the vicarious sense that salvation from inequity might come by revolution. A better educated Briton is thought to have coined the nine meals abstraction. At the height of last year’s food crisis, it was recalled that Lord Cameron of Dillington, in his capacity of head of the UK’s Countryside Agency, coined version 2.0 “nine meals from anarchy.”

The distinction between anarchy and revolution was noted by Fredick Upham Adams in 1896, unearthed by Wikiquotes, who speculated on the veracity of the concept:

…I realize that the spirit of liberty does not exist in hungry men. People talked about a day coming when the people would become so hungry and desperate that they would rise in a revolution and sweep all before them. Such a day will never come. Hungry men may fight, but it will be for a bone—not for liberty. The perpetuity of liberty rests with those who eat three square meals a day.

Of course, Maslow would later quantify this with his hierarchy of needs, but I think modern man clings to the revolutionary idyll over anarchy because it gives him imaginary elbow room to believe right could prevail over the totalitarian misrule of the state. For the common man, it grants him reprieve from the likelihood that Orwell was correct to imagine that the future of mankind will be a soldier’s foot on your face forever. For the affluent, thoughts of a revolutionary cleansing assuage their guilt.

But Obama’s crew appears to be taking no chances. They’ve unveiled a website at www.ready.gov which expands on George W. Bush’s plastic and duct tape. Actually, the plastic and duct tape are still there, but at the top Obama wants us to be sure to get our three squares, for three days.

Through its Ready Campaign, the U.S. Department of Homeland Security educates and empowers Americans to take some simple steps to prepare for and respond to potential emergencies, including natural disasters and terrorist attacks. Ready asks individuals to do three key things: get an emergency supply kit, make a family emergency plan, and be informed about the different types of emergencies that could occur and their appropriate responses.

All Americans should have some basic supplies on hand in order to survive for at least three days if an emergency occurs. Following is a listing of some basic items that every emergency supply kit should include. However, it is important that individuals review this list and consider where they live and the unique needs of their family in order to create an emergency supply kit that will meet these needs. I can’t imagine there’s a single corporate media journalist who wouldn’t be hard pressed to defend the pro-war filter he or she puts on the news for US domestic consumption. Corporate tools? They’re military industrial pitchmen. Advocating death and dismemberment without restraint. Let them plead ignorance. Bullshit. I’d love to see Bill Clinton make a case for all of them.

Antiwar voices are split on whether to charge MSM collaborators for war crimes, for selling the Anglo world on patently illegal wars. But how else are we to be rid of them? America remains locked in a Vulcan mind meld with these impudent, immoral careerists. Perhaps apprehension by the Iranians, and a trial by revolutionary council, is the only justice they might ever meet. Dispatch them to Kurdistan: Assignment Iran! Let the Persians teach Americans the only way to deal with poisonous snakes.

The media song now, to spin the recent errant three in the best light, is that Kurdistan was not an unthinkable destination for tourists such as they, and perfectly safe too. Unless you venture toward the Iran border, where US commandos have been raiding Iranian infrastructure, while the US Navy taunts the Iranian coast in full force. Alas, Kurdistan, quite happy with its undeclared sovereignty from Iraq, has proven to be a safe haven for Anglos.

I remember a most heartbreaking scene from the first month of the war, recorded by an independent American photographer as he worked his way through Kurdistan. Perhaps you recall it.

Do I mean the friendly fire, or accidental, I’m not sure which to put in quotes, bombing which killed coalition troops, but also took out a Kurd ally who may have turned out to rival a more favored ally? No, not that one.

Our photographer was making his second entry into Iraq as I recall, and documented a personal incident thus. He was traveling with a Kurd escort, when an Iraqi combatant broke through with a grenade, determined to blow himself up next to the American.

And I should clarify, I was not rooting against the photographer, but– here’s what happened.

The Iraqi was being held off by a Kurd fighter, but he had pulled the pin on the grenade, and leaned against his opponent, dooming both of them if the Kurd dared to shoot him. The scene unfolded in the progression of stills the photographer snapped as he hastened away. The Iraqi was chest to chest with the Kurd, pleading to be let to get the American. I interpreted his entreaties to say: Brother let me pass, I must reach the American, I have no quarrel with you, let me die with the infidel. The Kurd seemed for a moment to consider the words of his Iraqi brother. American deaths counts many hundred fold, we are brothers fighting the American aggressors, I have committed to die for this act, help me, please let me just reach him.

I could be wrong, he may have been cursing the filthy Kurd for blocking his way. But his locked eyes and sweated brow reflected an earnest human being.

I cannot be sure how long this went on, but the Kurd kept the desperate man at bay, and as soon as the Kurd had wrestled control of the grenade, he shot the would-be assassin point black. The Iraqi fell unceremoniously into the tall weeds. The last image showed his body collapsed in the ditch beside the road. The photographer and his Kurd entourage moved on.

There were honest, unembedded journalists in the early stages of the war. A record number were killed by the US military until none report independently anymore. Journalists working for foreign news agencies are detained in secret US prisons, under the same pretext that we protest of Iran or North Korea.

If we do not have the resolve to string up these blood-thirsty yellow journalists, promulgating lies to justify the continued slaughter of countless innocents, let the Iranians have at them.

Phony Sedon-y meet Social Ecology

I mentioned in my last post that I’d had a visceral negative reaction to Sedona — undeniably one of the most beautiful places on earth — which surprised and dismayed me. I had a vague sense that I was offended by the opulence and pseudo-spiritualism of the place, but that didn’t completely explain my snarky attitude which, I’ve come to understand, usually masks a deeper response to perceived injustice or dashed hopes.

I found an answer in the form of a book I happened to pull from my brother’s bookshelf: An American Child Supreme — the education of a liberation ecologist, by John Nichols. It’s a memoir of sorts, and tries to decipher how any of us — born into a culture that very nearly ensures that we become bigots, greedy consumers, warmongers, and environmental parasites — develops a social conscience.

John Nichols tells of the life-changing — often seemingly innocuous — events, people and books that transformed him from a product of a privileged upbringing and Mayflower pedigree to a liberation ecologist (as opposed to naturalist or environmentalist), a more radical superstratum of social ecology.

I won’t go into any of that, although it was fascinating to me. I’ll just write the words that I scratched frantically into my little notebook so I’d not lose them or allow myself to forget them. I wasn’t sure how they related to Sedona, but somehow they did.

Myself, I do not have the courage or the fanaticism that motivated Diana Oughton (of the Weather Underground) to build bombs, but I cannot envision the changes we need without some sort of apocalyptic reaction against the current levels of violence generated by the daily economic activities of the multinationals that feed and clothe us.

Territorial shooting wars are only a small fraction of the greater (and more horrific) violence of a world market that levels forests, pollutes the oceans, impoverishes people and toxifies topsoil in order to bring us our hamburgers, polyester golf slacks, and Marlboro cigarettes. “The human murder by poverty in Latin America is secret,” writes Eduard Galeano. “Every year, without making a sound, three Hiroshima bombs explode over communities that have become accustomed to suffering with clenched teeth. This systemic violence is not apparent but is real and constantly increasing: its holocausts are not made known in the sensational press but in Food and Agricultural Organization statistics.”

Environmental collapse is now universally caused by monopoly capital plundering earth’s biological and human resources for profit. The profit is generated by the labor of those underdogs, whose energy is thus co-opted to destroy the environment. This means that our most destructive environmental problems are tied to their inequality. . . . That inequality is causing a downward social spiral on earth and eco-devastation. Profit requires demolition. The racism that deforms our nation (and the globe) is a tool used by a capitalist society to maintain class divisions for profit-making reasons, so racism is also a main component of biosystem toxicity.

John Nichols sums up the philosophy of a liberation ecologist when he quotes Tom Athanasiou’s book Divided Planet: The Ecology of Rich and Poor, whose words are directed at environmentalists:

“The time for such political innocence is over. . . .it is past time for environmentalists to face their own history, in which they have too often stood not for justice and freedom, or even for realism, but merely for the comforts and aesthetics of affluent nature lovers. They have no choice. History will judge greens by whether they stand with the world’s poor.”

That must be it. I distrusted Sedona because it quite obviously doesn’t stand with the world’s poor, nor even the nation’s middle class. It is an enclave for affluent nature lovers whose social consciences are buried in crystals and energy forces, $4 iced teas and expensive gauzy skirts.

Sedona seems to care not a whit about social or economic justice nor — I’d wager a guess — about wreaking environmental havoc in Utah and New Mexico to keep its own little slice of Eden energized and enflowered. There is no need for Sedona to worry about the larger world, neither liberation for its people nor the sustainability of its global environment. Sedona exists unto itself and its wealthy denizens — to be owned, developed and distributed and enjoyed at their directive.

Psalm 137, writes Joel Kovel, is “a virtual anthem of the Zionist cause.” The passage is subtitled in the New Revised Standard Edition Bible as Lament over the Destruction of Jerusalem. You probably recognize the phrases from gospel music:

But omitted from the musical versions, and popular discourse at least outside of Israel, is the longing for revenge, expressed in verses 7-9:

Does this bear any relation to the 437 children killed in Israel’s last incursion into Gaza? Note, Kovel wrote Overcoming Zionism in the wake of the IDF’s atrocities in Lebanon, the ferocity of which their Gaza operation could only be said to have exceeded. Kovel did find counterparts to Psalm 137 in contemporary Israeli rhetoric. He quotes Rafi Ginat, editor-in-chief of Yediot Ahronot, July 28, 2006.

“wipe out villages that host Hezbollah terrorists […] wash with burning fire the Hezbollah terrorists, their helpers, their collaborators, and those who look the other way, and everyone who smells like Hezbollah, and let their innocent people die instead of ours.”

And Kovel quotes Israeli poet Ilan Shenfeld, published in Ynet, July 30, 2006, who throws the fate of Gaza’s children in with those of Lebanon:

“March on Lebanon and also on Gaza with ploughs and salt. Destroy them to the last inhabitant. Turn them into an arid desert, an uninhabited, turbid valley. Because we yearned for peace and wanted it, and our houses we destroyed first, But they were a wasted gift for those murderers, with beard and Jihad bands, Who shout: ‘Massacre now!,’ and who have neither love nor peace, Neither god nor father. […]

“Save your people and make bombs, and rain them on villages and towns and houses till they collapse. Kill them, shed their blood, terrify their lives, lest they try again To destroy us, until we hear from tops of exploding mountains, Ridden down by your heels, sounds of supplication and lamentation. And your pits will cover them. Whoever scorns a day of bloodshed, He should be scorned. Save your people, and make war.”

Ran HaCohen wrote in Antiwar.com, quoting Israeli peace activist A. B. Yehoshua from Ha’aretz, March 19, 2004, who justified the plan for Gaza.

“After we take out the settlements … we would use force against an entire population, use force in a total manner. … We would cut off the electricity in Gaza. We would cut off communications in Gaza. We would stop fuel supply to Gaza…. It won’t be a desirable war, but definitely a purifying one.”

Was Sharon quote really not genuine?

Are quotes being fraudulently attributed to Israeli ministers (as NMT’s indignant Israeli PR visitors are insisting)? We decided to look into the Ariel Sharon “fabrication” about who controls of America. Let’s just say our hasbara critics are going to wish they’d tempered their indignation. In the process, we found more indecorous pronouncements, which we’ve included with direct attributions from the Israeli press. Tokhis oyfn tish.

Did Israeli Prime Minister Ariel Sharon say “I control America,” or words to such effect? It turns out this has been made a bone of contention since the alleged rebuke to Foreign Minister Shimon Peres in October 2001.

The Israeli PR website CAMERA (Committee for Accuracy in Middle East Reporting in America) has been accusing Arab-sympathetic Washington Report, (Washington Report on Middle East Affairs -WRMEA) of orchestrating this story. The quote was picked up by the international press from Chicago Tribune syndicated columnist Georgie Anne Geyer, who had attributed it to having been reported on Israeli radio station Kol Yisrael.

CAMERA claimed that Kol Yisrael denied having aired the quote. But Geyer could not discount the veracity of her multiple Israeli sources, whether or not they heard it on the radio or at the meeting, but the veteran journalist stood by her longstanding contacts. Under a coordinated barrage of LTE complaints by CAMERA, the Chicago Tribune issued this clarification on June 14, 2002:

“[the quote was] widely reported in the Palestinian press but cannot be confirmed in independent sources. Geyer and Universal Press Syndicate regret not having attributed the quote more specifically.”

Hardly an admission of “fabrication,” as CAMERA and this site’s hasbara propagandists are lauding.

And whether Sharon said it or not, Senator Fullbright, or Secretary of State John Foster Dulles had already spelled that notion out for posterity.

Perhaps Prime Minister Olmert’s recent claim to have interrupted George Bush mid-speech, to command Secretary of State Condoleezza Rice to stand down on a United Nations vote condemning the recent Gaza attack, proves Israel’s influence, more loudly than pronouncing it.

But a statement about who claims to control whom, pales in comparison to what some Israeli ministers have voiced about their military objectives in Gaza. They remind me of American commanders, utterly oblivious to the Geneva Conventions.

Here’s what Israeli Deputy Defense Minister Matan Vilnai famously told Army Radio last year:

“The more Qassam fire intensifies and the rockets reach a longer range, they will bring upon themselves a bigger ‘Shoah’ because we will use all our might to defend ourselves.”

SHOAH is the Hebrew word for Holocaust; itself a word zealously trademarked by Zionists internationally to mean only the genocide perpetrated by the Nazis against the Jews.

Israeli PR damage-control immediately jumped in to assert that by ‘Shoah,’ Vilnai had meant ‘disaster,’ the word’s original definition. (Would that be like asking Americans to believe that when Rudy Giuliani brings up 911, he’s talking about dialing emergency?)

“We should let them know ‘you have to leave, this area will be taken down tomorrow’ and just take it down – that will show them we mean business. Sporadic actions are good, but they’re not good enough.”

Edward Abbey quotes Louisa May Alcott

According to his FOIA files which Edward Abbey requested from the FBI, and which the Moab Canyon County Zephyr is releasing serially, Abbey first came to the agency’s attention as editor of the University of New Mexico’s campus literary magazine The Thunderbird, when fellow students could not dissuade him from printing on its March 1951 cover:

Actually, Abbey’s FBI file opens with his 1947 public letter calling for students to burn their draft cards. Most of the rest of his fed investigation attempts to separate fact from his fictional MONKEYWRENCH GANG, which inspired Earth First! When Edward Abbey died in 1989, there followed a rapid disintegration of Earth First, and the attempted car-bomb assassination and frame-up of organizer Judi Bari.

Liability and the value of a human life…

How much does one person or all of society owe for injuries, deaths or other damages caused by actions that an individual or the representatives of Society take?

(I posted this on another forum, alfrankenweb.com. This hits at the core of a few issues that have been brought out in the forum recently.)

For instance, this time last year, an Insurance Agency, Cigna, made the decision to allow a young lady to die, even though there was a transplant liver available for her, under the notion that she only had about a 50% chance of surviving such an operation.

This mirrors the Terri Schiavo case, in several important ways.

George Bush, Jeb Bush, Karl Rove, Pat Buchanan, Rush Limbaugh, Newt Gingrich, just a representative sampling of Republican “Leadership”… not only didn’t condemn the decision but some actually applauded it.

Mrs Schiavo had, apparently, about a zero percent chance of survival or ever recovering from her coma.

Richard Cheney, even though his company has surpassed Microsoft as the richest corporation in America and therefore the world, had a life prolonging surgery done, at Taxpayer Expense, even though:

his age, condition and personal habits will nullify the surgery within a decade anyway…

He has never contributed anything to Society in his entire sojourn on our planet…

And has himself denied and been an accomplice to denying the same types of life-prolonging surgeries not only to his own employees but also to any Americans who weren’t smart enough to be born, like him, with silver spoons in our mouths.

And he’s an accomplice to more than a Million murders.

Then there’s the issue of Guns.

The “Swimming Pool” analogy was brought up, and having car seats for kids too small to effectively be protected by seatbelts, and the issue of Seat-Belts themselves.

But it’s the Insurance Underwriters who brought legislation that ordered the Seat Belt and Car Seat laws, also not allowing people to burn toxic waste in their backyards, or burn anything that will set their neighborhood on fire or even their own houses.

Insurance companies = not social liberals.

In Texas, which the Frightened Wing love to proclaim as their primary territory, you can’t operate a motor vehicle without Fiscal Responsibility. You either have to have 50,000 dollars in a bank account specifically set aside for the purpose, for each vehicle, for liability claims… or purchase insurance for each vehicle.

If you own dogs which are prone to bite, your homeowners insurance goes up.

If you have a history of driving like you’re stupid your car insurance premiums go up, AND you have to carry more liability coverage.

Here’s where the disconnect begins… If you own a business,even if it’s a business like Construction which has a very high attrition rate among the workers (the ones who do the actual building both of the properties and the profits of the company) you DON’T have to carry basic Workman’s Compensation insurance. and there’s even moves afoot to Decrease employer contributions to Social Security, the ONLY disability insurance available to the vast majority of non-union Workers.

You’re also not required to carry insurance on firearms in case you, your kids, your spouse etcetera decide to do something either deliberately evil or blatantly STUPID and get people killed.

The “Poster Child Case” for this attitude was India v Union Carbide for damages done including Human Lives Lost (and yes, for those right wingers who hate being called Baby-Killers, a lot of the people killed or crippled for life were in fact infants.)

The Right Wing argue that the judgment was excessive because the “Third World” meaning dark brown people would never in their lifetimes earn more than $30K (conveniently ignoring the FACT that these were the families of Union Carbide’s Corporate Slave Labor Poolerrr… “Valued Employees” yeah, that’s the ticket) and thus the value of their lives was not equivalent to the lives of American White Collar Workers

They also, in cases of Capital Murder, or the global “war on terror” trot out the Old Testament law of “eye shall go for eye, tooth for tooth, stripe for stripe and life for life”

So, here’s an interesting theory of how that would work.

Say you’re responsible, through arrogance and ignorance, for your employee being crippled for life.

The catfish-processing workers Mr Bush declared to not be worthy of any compensation for their Carpal Tunnel injuries, for instance, every person who was crippled by that policy and the practices of the Catfish farms and their processing plants, should be able to demand that one person in the corporate heirarchy or amongst the investors in those operations should be taken out, and made to stretch his hand out across a cement block, and have it smashed irreparably with a large heavy object.

Because, you see, stripe shall go for stripe.

That refers to the seriousness of a wound.

The War on Terror, should have ended immediately at the time 3,000 of the people responsible had been killed.

Oh, wait, me ams forgot, instead of going after the ones actually responsible the Bush-Cheney people chose to go after civilian targets.

As Gilda Radner used to say, “never mind”.

Instead of the Right Wing screaming and howling about the victims and their families at Bhopal being compensated at a rate of One Years Salary for one of the Office Workers who were their Overseers on the Union Carbide Plantation errr … Supervisors and managers… yeah, that’s the ticket… for each HUMAN LIFE LOST and for those who merely had injuries that would cripple them for life, less money than it would take to have their injuries treated at anything other than a Third World hospital.

You know, the hospitals the same Right Wingers say are so very inferior to Our System…

Instead of that, for every life lost, starting from the CEO, the Board of Directors, on down, the Corporate Officers and shareholders, from the ones who own the most shares in the company on down, being taken out and asphyxiated in a Gas Chamber, just like their victims.

I think the Right Wing would scream very loudly about something like that.

Let’s turn it to a more pleasant subject.

If you have a Swimming Pool you have to have insurance on it. And routine inspections and random inspections.

If you don’t you get fined. That’s the way it is and even that wasn’t brought about by “Those Librul Elitist Latte-sippin’ Prius-Drivin’ Khaki pants-wearin’ sissy-boys” but instead as a cold, analytical business decision.

So, since that was the standard argument trotted out to counter the notion that gun owners should be held responsible for their TOYS

Let’s see the Masculinity Challenged Ones put their money where their mouths are.

Or at least find out, because, you know, unlike the freaks hanging out at the local firing range or the gun shop, Insurance Companies hire persons called “Actuaries” who maintain statistics like the number of accidental drownings per number of swimming pools, the number of Automobile fatalities as compared to the number of automobiles, the number of dog-bites by breed,…

Number of accidental and/or intentional gunshot wounds compared to the number and types of firearms…

Go to an Insurance Company Website.

And get the price quotes for Liability on your guns.

You’ll be asked questions, answer them honestly.

How many firearms you own.

How much ammunition you typically keep on hand.

Do you have a secured gun rack or safe for your firearms?

Keep in mind that your idea of secure probably isn’t as stringent as that of people who actually keep track of such things and actually know what the hell they’re doing.

Do you keep your ammunition inside your house?

If you do, you’re storing EXPLOSIVES in the same area where your family lives.

Buy some extra fire insurance, life insurance for every person in the house, and liability for your neighbors who might also perish or be seriously injured if you’re not SUPREMELY careful.

How many children do you have living with you or who typically visit?

How many of them are disabled and not as likely to survive without injuries if the Unthinkable Happens.

Hell with that, it’s not Unthinkable, if you don’t THINK about this you have absolutely no business whatsoever owning firearms…

Since bullets typically go through the wall of a house, even a BRICK wall, and into the neighboring house, get life insurance for each person living around you.

Your liability for his or her medical care could run into the MILLIONS, plus the cost of him to survive with as much normalcy and dignity as possible.

Palin gets natural lip gloss from NPR

We may all be eagerly awaiting the Thursday VP debate trainwreck, with finally a sense that sanity cannot but otherwise prevail on coverage of the Sarah Palin dunce cap corner. But Americans don’t have to look far to see that media bemusement with Palin is not unanimous, in fact NPR is still fawning. Nina Totenberg’s recent profile of Palin was as facetious as Palin herself. And the NPR website transcript suggest the staff don’t want to leave a record of Totenberg’s unbending endorsement. Morning Edition listeners get propaganda, websurfers get something more palatable than pure barf.

Totenberg knew she could not ignore the public’s growing repudiation of Palin, fueled by Palin’s self-immolation on ABC and lampooned by MSNBC, SNL and everyone in between. In her Morning Edition report, Totenberg began by paying lip service to her uphill task, putting the proverbial –you’d think a little too cliche at the moment– lipstick on a pig, paraphrased as sugarcoating. And then laying on the sugar anyway. In the excerpt below, the words in bold are actually Totenberg’s emphasis, not mine!

There’s no way to sugarcoat this. After a BRILLIANT debut at the Republican Convention and a speech that ELECTRIFIED the delegates and the country, Sarah Palin is STRUGGLING in her second act — as a candidate seeking to persuade uncommitted voters that she’s prepared to be vice president of the United States.

She draws HUGE crowds, though not as huge as G.O.P. staffers would like you to believe, still, by most standards, they’re ENORMOUS — five, ten, fifteen, even twenty thousand! People, particularly women, are thrilled to see someone SO like themselves up there and SUCCEEDING. And she remains a SPUNKY speaker.

Let’s see. Nina Totenberg concedes that sugarcoating will be impossible, then piles it on: “brilliant,” “electrified,” “huge crowds,” “enormous.” Not as huge as someone would have you believe, but ENORMOUS? Did you know huge was less than enormous? And then: “someone so like themselves,” “succeeding.” Now would either of those descriptions fit the Sarah Palin you’ve seen? She’s SO like you? She’s succeeding? Of course Totenberg doesn’t say she thinks so, nor that YOU think so, but simply that people do. Particularly women. Really Nina?

Then there’s a sample of Palin’s “spunky” speech:

[PALIN:] “Okay Pennsylvania. Over the next forty days, John McCain and I, we’ re gonna take our message and our mission of reform to voters of every background, in every party, or no party at all, and with your vote, we’re going to Washington to shake things up.”

Now I think it’s one thing to clean up Palin’s English, maybe even to prettify the grammar, but quite another to add or delete words. Compare the above semi-corrected transcript of Palin’s eruditeness to NPR’s.

Further on, Totenberg covers Palin’s energy policy expertise, playing a portion of Palin’s speech where she takes credit for a natural gas pipeline. Totenberg debunks, sort of:

News reports DO INDEED give her credit for the pipeline agreement, but suggest that Palin has left so many financial and land-rights problems unresolved that the pipeline might never be built.”

Totenberg sites “News reports” to substantiate Palin’s claims, the NPR website transcript changes this to “Media reports,” but isn’t this the same as arguing “Some People Say” to back up a statement without having to validate or invalidate it yourself?

(I recall NPR confronting Senator McCain about his ad accusing Barack Obama about advocating sex-ed for preschoolers. NPR cited Factcheck.org for contradicting McCain’s charge, to which the GOP candidate merely countered that the so-called “Factcheck.org” was entitled to their different view of the facts. Never did NPR feel compelled to provide investigation of its own into the facts. Do we need a news program to be so objective that it can be detached from reporting what is fact or what is misrepresentation?)

Also highlighted in the speech is her son, in Iraq, her Down Syndrome baby boy, and on the stage when we were with her, two of her three daughters, who with their mother worked the rope line for a few minutes afterwards. And then there’s Palin’s husband Todd, affectionately known as “The First Dude,” who’s a commercial fisherman, oil field worker, union member and close adviser to his wife.

[PALIN:] “He is the four time winner of the Iron Dog, the world’s longest snow machine race, two thousand miles! And the more John McCain hears about that Iron Dog Race, the more often he says Todd’s crazy.

Did you know Todd Palin’s moniker was coined out of “affection?” Whose? On the radio broadcast, it was just “The First Dude” which mirrors recent national news photo captions, usually sarcastic. However the NPR website transcript specifies “Alaska’s First Dude,” which might have made Totenberg’s suggestion more credible. I don’t know, we’d have to consult Palin’s Alaskan constituents.

Here is part of NPR’s written version of Nina Totenberg’s report, submitted for comparison. Palin Tries For Second Act On The Road. Perhaps NPR is not submitting such as being a literal transcript. Indeed even some of their quotes of Sarah Palin are not the words she actually spoke. By the way, the original web transcript did not include the disingenuous preface “There is no way to sugarcoat this.” This was added a day later. The transcript also omits Palin’s extra embellishments about her husband. In effect NPR listeners heard a vastly aggrandizing report than NPR has decided to put on record.

After a brilliant debut at the Republican National Convention and a speech that electrified the delegates and the country, Alaska Gov. The encirclement of US rivals is apace

The earlier Asian Great Silk Road trade routes went through Tashkent in Uzbekistan and Almaty in Kazakhstan for geographically obvious reasons, in a region surrounded by major mountain ranges. Geopolitical control of Uzbekistan, Kyrgyzstan, Kazakhstan would enable control of any potential pipeline routes between China and Central Asia just as the encirclement of Russia controls pipeline and other ties between it and western Europe, China, India and the Mideast.” –William Engdahl

In this light does it become more clear why American intelligence interests support FREE TIBET efforts, and Greg Mortenson’s Central Asian Institute “western education” encirclement of China’s southern border!

Bruce Gagnon of Organizing Notes has assembled some notes on the growing conflict in South Ossetia, Georgia, and the implications it poses for a broader military engagement.

WHAT DO WE KNOW ABOUT GEORGIA-RUSSIA CONFLICT?

I must admit that I am not an expert on the Georgia-Russia conflict that is now underway. But I have been following issues there for some time and have learned to see some linkages between what is going on in places like Poland, Czech Republic, Iran, Iraq, Afghanistan, China, and the Georgia-Russia conflict.

So here are some random, and not so random, observations and quotes that I think might give us all something to ponder.

* It’s all about oil and natural gas. Russia has the world’s largest supply of natural gas and Iran has the world’s second largest supply. There is much oil and natural gas up in the Caspian Sea region. Which ever country controls this part of the world will have a jump start in controlling the keys to the world’s economic engine for the foreseeable future.

* The expanding economy of China has tremendous need for energy. China now imports much of its oil via sea (thru the Taiwan Straits) and the U.S. has in recent years doubled its naval presence in this region pursuing the ability to “choke off” China’s ability to import oil. China is looking for alternative, land routes, to transmit oil thus pipelines through Central Asia become crucial. U.S. permanent bases in Afghanistan and attempts to put military bases in other Central Asian countries is in large part an attempt to create the ability to control these pipeline routes. F. William Engdahl, author of A Century of War: Anglo-American Oil Politics and the New World Order, maintains that, “Washington is out to deny China east land access to either Russia, the Middle East or to the oil and gas fields of the Caspian Sea.”

Engdahl goes on to say,

“A close look at the map of Eurasia begins to suggest what is so vital for China and therefore for Washington’s future domination of Eurasia. The goal is not only strategic encirclement of Russia through a series of NATO bases ranging from Camp Bond Steel in Kosovo to Poland, to Georgia, possibly Ukraine and White Russia, which would enable NATO to control energy ties between Russia and the European Union.”

* Some years ago I read the book called The Grand Chessboard by Zbigniew Brzezinski which I recently wrote about in relation to his being a chief foreign policy advisor to Barack Obama. Brzezinski has been critical of the Bush administration for invading Iraq essentially saying that it was the wrong war. Brzezinski has long maintained that Russia and China were the targets that had to be militarily contained if the U.S. hoped to continue its role as chief superpower of the world. He says, “Eurasia is the world’s axial super continent. A power that dominated Eurasia would exercise decisive influence over two of the world’s three most economically productive regions, Western Europe and East Asia. A glance at the map also suggests that a country dominant in Eurasia would almost automatically control the Middle East and Africa. With Eurasia now serving as the decisive geopolitical chessboard, it no longer suffices to fashion one policy for Europe and another for Asia…..Eurasia accounts for 75% of the world’s population, 60% of its GNP, and 75% of its energy resources. Collectively, Eurasia’s potential power overshadows even America’s.”

* In 2005 the Baku-Tbilisi-Ceyhan (BTC) oil pipeline opened. It cost $3.6 billion and was funded by British Petroleum (BP) in a consortium including Unocal of the U.S. and Turkish Petroleum, and others. With the fall of the Soviet Union a scramble ensued for political and economic control of this part of the world. Georgia is on the pipeline route. Russia was opposed to this pipeline route. Brzezinski was a consultant to BP during the Bill Clinton era and urged Washington to back the project whose route would circumvent Russia.

Brzezinski also serves on the board of the US-Azerbaijan Chamber of Commerce that includes people like Tim Cejka (President of ExxonMobil Exploration); Henry Kissinger; James Baker III (who in 2003 went to Georgia to tell them President Shevardnadze that Washington wanted him to step down so U.S.-trained Mikhail Shaakashvili could replace him as president); Brent Scowcroft (former Bush I national security adviser); and Dick Cheney (who served on the board before becoming Bush II’s V-P).

The U.S. has long been involved in supporting “freedom movements” throughout this region that have been attempting to replace Russian influence with U.S. corporate control. The CIA, National Endowment for Democracy (board members include former neo-conservative congressman Vin Weber and General Wesley Clark), and Freedom House (includes Zbigniew Brzezinski, former CIA director James Woolsey, and Obama foreign policy adviser Anthony Lake) have been key funders and supporters of placing politicians in power throughout Central Asia that would play ball with “our side”.

* Now all of this hardball politics is to be expected. The U.S., Russia, and China all want control of this part of the world. OK, nothing new there. But the current Georgia-Russia conflict indicates that things are moving to a new dangerous stage of development. Very recently the U.S. and Georgia held military maneuvers in the now disputed territories. Russia countered with military maneuvers of its own. Russia is feeling threatened by expanding U.S. bases in Romania, Bulgaria, Poland and the Czech Republic. Added to that are NATO attempts to put bases in Latvia, Lithuania, and Estonia and possibly even Georgia – all along or very near Russia’s border.

* None of this is about the good guys verses the bad guys. It is power bloc politics and when the shooting starts it is civilians who die and their communities get destroyed. Big money is at stake and big money does not mind killing innocent people who stand in the way of “progress”. For the peace movement we must first understand some of the history, and also understand the “chess” game now underway. We must not have illusions that this is about “democracy” and must denounce the military and corporate agenda of the players involved. For us in the U.S. we must also remove our blinders and see that both parties (Republican and Democrat) share a bi-partisan history and agenda of advancing corporate interests in this part of the world. Obama’s advisers, just like McCain’s (one of his top advisers was recently a lobbyist for the current government in Georgia) are thick in this stew.

* In the end the peace movement must recognize that this current fighting could trigger protracted war and the only question becomes which weapons get used? Does the U.S. decide it must “come to the aid of it’s ally Georgia”? Is an attack on Iran somehow connected to this widening war for oil? Are nuclear weapons on the table? None of us has all the answers but it is imperative that we begin asking these hard questions and learn as quickly as possible as much as we can about the region.

* Lastly, need I remind anyone, that any protracted warfare in this region will be directed by space satellite technology. Space control and domination gives the U.S. the leg-up in any superpower struggle for control of oil and natural gas.
