Radiolab episode on jury nullification is less bothered by state abuse of power than public desperation to fight back.

It should come as no surprise that public radio’s RADIOLAB would take government’s side against the growing grassroots effort to awaken citizens to the repressed potential of jury nullification. Any attention to the subject helps inform ordinary jurors of the power they have to stand up to the regular abuses of our judicial system. The benefit is tempered of course when liberal gatekeepers lean in with theatrics to fearmonger about anarchistic challenges to law and order and security. That’s exactly what Radiolab achieved though given plenty of material with which to have taken a more honest tack. Their program “Null and Void” aired May 12 and painted nullifiers as irrational extremists, giving a pass to the judges who purge juries and break the law by having nullifiers arrested.

I had high hopes when contacted by a producer for Radiolab in March. Our federal injunction protecting Denver jury nullification outreach efforts against an order by the Second Judicial District’s Chief Judge Michael Martinez was coming to trial in April. I imagined reporters would be sympathetic to our predicted success making our injunction permanent and the similar likeliness of our prevailing on contempt charges in a hearing which was to follow. I faciliated Radiolab’s access to Mark Iannicelli, who Denver arrested in violation of our injunction, and whose dismissed charges of felony tampering continue to be appealed by our legal adversaries. Thus far it’s a simple story of hoisting a chief justice on his own petard, using the justice system against itself, in defense of the people’s historical power as jurors.

Heicklen
But Radiolab had an alternate narrative in mind. Their story would center on a jury nullification champion who they could characterize as coming off the rails, the celebrated frequent arrestee Julian Heicklen. Septegenarian Heicklen became tired of judges warning him of arrest, despite his continued legal victories. By November 2016, Heicklen issued a manifesto of sorts, asking for armed backup to preempt a judge from making good on his renewed threat to arrest him. Heicklen posted this warning online and called it to everyone’s attention. Presumably it’s what drew Radiolab’s attention. Heicklen had put it out there, hoping to spark a John Brown-esque conflagration, I’d call it a bluff, meant to curtail the court’s continued abuse of power. It’s obvious from Heicklan’s hyperbole. I attach the significant excerpt in the notes below.

Radiolab didn’t reference this tract, nor mention their and the court’s foreknowledge of it. As they interviewed Heicklen, they asked him about his cause and even brought him to tears as he explained his distress about the injustice of the system, which continues to reinforce inequity and deny jurors their prerogative to step in its way. Then Radiolab prodded Heicklen to explain what he anticipated would happen when he showed up at the courthouse in defiance of the judge’s threat. On cue, Heicklen repeated his entreaty that supporters show up with guns to enforce his right to pass out fliers and avert the judge’s illegal threat to arrest him.

Many of us might share the elderly activist’s frustration with being habitually arrested then exhonerated, each time without apparent progress being made. Radiolab’s pretend reaction was to cue ominous silence, let the pin drop, cue indignant alarm, ostracize Heicklen, cue a spontaneous meting of Radiolab minds to elect to call the cops on Heicklen lest law enforcement personnel be shot.

Radiolab didn’t call the Chief Judge Frederick J. Lauten to question the irregularity of his repeating an illegal threat. How absolutely insane for a judge, already proven to be in the wrong, to keep asserting his authority to have a citizen falsely arrested?

When Heicklen showed up to the courthouse, with a friend, both without weapons of any kind, and without the backup support of “Tyranny Fighters” he’d hoped to mobilize, Heicklen was arrested for the more serious charges involving threats.

Radiolab may or may to have exacerbated Heicklen’s arrest. They certainly took credit for it, which is the least they could do for having exploited Heicklen as their straw man extremist.

Because Radiolab makes little effort to conceal their liberal bourgeois elitism. FIJA, the Fully Informed Jury Association was founded, according to Radiolab, in a Montana “bunghole”, which they qualify, they are entitled to call Helena, the capitol of Montana, because one of the show’s producers is from Montana.

Wolverine
You might ask, what’s Wolverine got to do with this? Anyone who’s read Ariel Dorfman knows better than to bring superheroes into political discourse. Radiolab didn’t know how better to distinguish between a citizen’s right, as proscribed by the Bill of Rights, and a power, something grown from common law. Whatever, they’re wrong. Juries are guaranteed by the sixth amendment, now commonly understood to be “a jury of your peers.”

Radiolab never uses that phrase, it’s too everyman. But they do riff ad nauseum on Wolverine, who’s a superhero with superpowers, namely CLAWS, which for Radiolab described this aberrant power that jury nullification advocates are promoting. The public as beast, and mutant power threatening elitists like a werewolf’s claws. Someone adds, as a further irrelevance, that Wolverine’s real superpower is regenerative, the power to heal but nevermind. They say that, and it’s the only trivia that actually does apply to jury nullification. Radiolab autistic savants.

They recorded Mark Iannicelli in front of the Denver courthouse, that was our single consolation!

It’s no surprise that Radiolab takes the government’s side against the public’s growing inclination to “burn it down.” Radiolab got great quotes from Mark, but chose to demonize other jury nullification pamphleteers who were so frustrated with being arrested that wanted to deter future arrests with guns.

By the show’s end, the white privileged NPR broadcasters feel more comfortable with the law in the hands of “unelected, white” judges over inexpert jurors described as “twelve random jerk-offs from the street.” They’re taking about your constitutionally protected jury of your peers.

Hopefully listeners will glean the great information offered by this piece and nullify Radiolabs’s privileged condescension.

None of them responded to my requests. A copy of your letter to Rick Scott dated October 13, 2016, was given to me. In your letter, you stateit is your intent to “distribute flyers regarding the duties of jurors and witnesses at criminal trials” at the Orange County Courthouse during th first week of December.” This letter is a reminder that such conduct continues to be proscribed on courthouse grounds under Administrative Order 2011-03 which governs expressive conduct taward summoned jurors. Enclosed is a copy of Adminiustrative Order 2011-03 for your perusal.

As you know, this Administrative Order is constituional as the Fifth District Court of appeal had “no difficulry upholding Administrative Order No. 2011–03 as reasonable, viewpoint neutral regulation….” Schmidter & Heicklen v. State, 103 So. 3d 2663,270 (Fla. 5th DCA 2012)(a copy of which is enclosed). This Court, as well as the Orange Cpounty Sheriff, qill enforce the provisions of Admionistrative Order No. 2011-03 to ensure the fair and orderly conduct of jury trials and to prevent dissruptions or interference with that basic right.

Based on the Administrative Order’s continuing validity, you may wish to reconsider your intended course of action and find alternative means in which to disseminate your message. If you intend on distributing materials to jurors, you will be issued a trespass notice and if you then remain on courthouse grounds, you could be arrested for trespass.

Unfortunately there seems to be a disagreement between the Florida court and the United States Federal Court. I was one of the appellants in the Florida case. The decision was based on lies and incorrect information introduced by the state attorneys. The judges should have know this, since I carefully pointed out the errors, but they did not care. They had made up their minds before hearing the case.

Previously I was arrested 5 times for distributing this literature at the the U. S. District Court in Manhattan, NY. I was arrested and charged with jury tampering. After 17 months of trial, Judge Kimba Wood declared that distributing this literature was not jury tampering because I did not discuss any case with a juror sitting on that trial. I was invited to Harvard University Law School to give a lecture on my case. Also I have been informed that my case is being taught to all students at Yale Law School. Presumably it is being taught elsewhere as well.

Currently I distribute the same flyers at both state and federal courthouses around the country. None of them arrest me. Three of these courthouses are state courthouses. They are in Fort Lauderdale, Fl; Pittsburgh, PA (last week); and Newark, NJ. The federal courthouses this year have been in Fort Lauderdale, FL; Newark, NJ; Manhattan, NY; Palo Alto, CA; Pittsburgh, PA (last week) and San Jose, CA; The state courthouses do not approach me. The federal courthouse Homeland Security officers at federal courts all threatened to arrest me until I told them to check it with a judge. They did, and none of them made an arrest.

December 5, 2016 will be a critical day in the history of the United States. I will appear at the Orange County Courthouse, 425 N. Orange Avenue, Orlando, FL and distribute “Nullification by Jury” flyers on the public sidewalk leading from the parking lot to the courthouse. I am asking all Tyranny fighters and anyone else to join me armed with loaded guns to shoot any courthouse employee or officer of the court (i.e. guards, Orlando police, State police, Sheriffs, or lawyers) that approach within 15 feet of me. One of 4 things can happen:

Neither the court personnel, the Tyranny Fighters, nor the press will appear. That will be the smoothest, but dullest, situation.

The Court officers only will appear and arrest me.

The Tyranny Fighters only will appear and protect me.

Both the Court officers and the Tyranny Fighters will appear. The gun battle for the return of a free country with a democratic republic will occur.

I am irrelevant. The future of the United States will be determined by the others or by you. Either we will continue the route to the gas chambers as described in the attached document, or we shall backtrack to a democratic republic. In either case I will have died by then.

Clean Energy march opens DNC 2016

PHILADELPHIA, PA- Sunday’s successful march kickstarted public demonstrations against the 2016 Democratic National Convention in Philadelphia. Thousands called for environmental justice on the eve of the nomination of pro-fracking, pro-pipeline, pro-war-for-oil Hillary Clinton. The banner brought by Denver Occupiers “THINK OUTSIDE THE CONVENTION” dominated the photopress coverage, thanks to a great AP image carried around the world. It was a good thing too, because “Clean Energy” is a bit of a muddy concept, isn’t it?

The event was sponsored in part by the Sierra Club and Food and Water Watch, known to accommodate fracking as part of their Big Greens “let’s be realistic” about what what environmental actions can achieve. I’m not convinced that the average tree hugger has come to favor “clean” over the lesser-descript “green”, but energy industrialists cerainly like clean. They’re confident they’ve squarely branded it with natural gas. The clean coal industry is still making a play for it too.

Though the marchers on July 24 were unanimously against fossil fuels, participants may have been hoodwinked into believing they can reclaim the word “clean” from corporate advertizing and its captive media. I doubt it. This is the same argument for reasserting ownership of the American Flag from the America Fuck Yeah pro-war patriots. No. You retire the Swastika, you don’t rebrand it to mean something transformative. Someone pushing to rehabilitate the swastika is a Nazi.

Also typical of demonstrations coordinated by Big Greens, the march on Sunday didn’t go to the DNC. Instead it went Eastward, from City Hall for Independence Hall, for a rally in sweltering heat –and unshaded sun– that will incapacitate many participants from the next day’s march. The Big Greens know from their membership rolls that the average age is elderly.

Care for the less fortunate


With dusk falling across the skyscrapers of upper Manhattan, Pope Francis implored the city – all cities – to care for the less fortunate. “There are the foreigners, their children who go without schooling, those deprived of medical insurance, the homeless, the forgotten elderly,” he said. “These people stand at the edges of our avenues, of our streets, in deafening anonymity.”

Steve Bass found guilty of camping not occupying, but could jury have ruled otherwise without hearing his defense?


COLORADO SPRINGS, Colo.– You may have underestimated the importance of today’s Camping Ban trial. The local media, social justice community and rights watchdogs missed it. But judging from the police force on hand and the elaborate lock-downs placed on the jury pools, it was evident the City of Colorado Springs thought a lot was at stake. I’ve written already about the draconian motions to prevent defendant Steve Bass from explaining his motives, including a ban of the word “Occupy.” Today the court made audience members remove their “Occupy Colorado Springs” t-shirts, but let the cat out of the bag by the palpable gravitas with which the court officials and police handled jury selection. Except for the absence of TV crews outside, you’d have thought Steve Bass was Hannibal Lector tripped up by an urban camping ordinance at “what happened last year in October at a park downtown.”

Yeah, even mention of “Acacia Park” was giving away too much, the prosecuting attorney preferred to call it “115 W. Platte Ave.” Every so often a prospective juror would stand up and say “I presume you’re referring to OCCUPY WALL STREET?” like he was solving a riddle, but instead of the door prize that volunteer would be dismissed from the pool for knowing too much.

After a trial that lasted one third the length of the jury selection, Steve Bass was found guilty. He offered no testimony, his lawyer, the very capable Patty Perelo, made no closing statement, because what defense could be made? Steve and his council elected not to have him testify, because to begin with, he’d have to swear to tell the whole truth, and if he explained he could only tell part of the truth, he’d be slapped with Contempt of Court.

We thought the jurors might have been curious, after seeing the city’s 8×10 glossy pictures with the circles and arrows telling what each one was and hearing not a peep from Bass, but they didn’t express it, and left after giving their verdict. This is Colorado Springs.

One of the prosecution’s witnesses, the arresting officer, nearly spilled the beans when he identified the defendant as someone he couldn’t have confused for someone else, because he’d said he’d encountered Bass many times in the park and shared many conversations.

“Oh?” the defense attorney Perelo perked her ears and asked, “and WHAT did you talk about?”

“Um… homeless policy, mostly.” That’s all HE could say. He couldn’t explain why he’d encountered the defendant so many times, or what the defendant was doing. Attorney Perelo couldn’t push it, because that would be leading him into forbidden territory. His testimony for the prosecutor was delivered straight from his notes.

There were two police witnesses, a map and several photographs, showing the tent and another showing just the poles. Was this necessary for a conviction? Because it necessitated explaining to the jury that said poles were in their “unerected state”. Not to be confused with the tent which was “fully erected”, which the judge pronounced like expressions which tripped off the tongue in cases of serious crime.

A photo of two sleeping bags required the officer to say he found the defendant sleeping “in the bags in the tent in the park” to prove all the elements of a violation of the camping ban.

The prosecuting attorney summarized it thus: “there was a tent, there was a sleeping bag, looks like camping to me.”

Not according to a dictionary definition of course. But that too had been motioned inadmissible. If you look it up, camping is variously defined as to “Live for a time in a camp, tent, or camper, as when on vacation.” Or as when destitute? Dictionaries don’t go there. That’s more like sheltering.

A couple of other examples: Soldiers sleep in tents. They’re not camping. Mountaineers overnighting on the side of a mountain aren’t camping. Refugees of war and natural disasters stay in refuge camps, but aren’t said to be camping. Anyway.

Steve Bass didn’t get his day in court. Everything he wanted to say he couldn’t. His attorney’s strategy today was to prepare for an appeal, on the grounds that the judge deprived Bass of the ability to defend himself.

Did Bass violate the camping ban as the jury decided? The prosecutor explained that nobody, not the judge, nor police officers or herself or the jury was in the position to decide the law. So Steve Bass has to take his case to someone who can.

Jury Selection
Over four hours were spent on choosing a jury, by far the most interesting part of the day. It took three sets of 25 potential jurors to pick six and one alternate. As the process approached lunch hour, the court was eager to buy pizza for seven instead of twenty five, but they didn’t make it.

As I mentioned, usually a juror familiar with “Occupy Wall Street” was dismissed, whether their opinions were favorable or unfavorable. I saw one juror dismissed because delving further would have meant discussing Occupy too much and would expose the other jurors to more occupy talk than the judge or prosecutor wanted.

On the other hand, many jurors had direct relatives in law enforcement, one juror considered a CSPD officer her “knight in shining armor,” so that was another cause for eliminations.

During the second batch, another juror stood up to say he was a former corrections officer, who wasn’t sure if he might have met Steve Bass “in the course of his duties” which poisoned the entire group by suggesting Steve had spent time in prison. That batch was dismissed. In actuality, Steve recognized him, because they both frequented the Dulcimer Shop.

Though Judge Williams maintained a convivial air of impartiality, he betrayed an awful prejudice. Whenever a juror expressed knowing something of what was in the news in October 2011, the judge would asked them if they could refrain from judging Bass based on the misbehavior of others. If jurors who knew about the protests were let to remain in the running, the assumption the judge offered was that “Occupy” was a taint that the defendant hoped they would overcome.

I don’t doubt that this slant extends well beyond Occupy, because municipal courts are notorious for being rubber stamps of a city’s citation process.

For example, in Judge Williams’ instructions to the jury, he read the sample guilty verdict first, in all its solemnity. When he read the not-guilty sample, he broke character to explain that he was not going to repeat the redundant stuff, etc, etc, and then he told the jury they shouldn’t be swayed by the order in which the two samples were read. The dramatic guilty versus the blah blah not-guilty.

Occupy harassment
Knowing about the prohibition against Steve mentioning Occupy, we thought we’d exercise our right not to be gagged. Could it matter? Should it? How preposterous that Steve was being tried and not permitted to say what he was doing. As if some precedent would be set that a defendant might convince a jury that forbidding a person shelter was a bad law.

So we came to court with t-shirts that read OCCUPY COLORADO SPRINGS. Immediately when we sat down, the judge called the lawyers up and decided we’d have to remove our shirts. We were given a chance to explain who we were, but the choice was invert the shirts, put on new ones, or leave. So we walked out.

I had an extra shirt outside with a peace symbol on it. Admittedly a politically-charged shirt, somewhat iconic locally, because it recalled an event in 2007 when peaceful protesters were forcibly removed from a city parade, one of them dragged across the pavement, an elderly woman who subsequently died of complications. So I knew I might be pushing it.

The point being to give Defendant Bass some context. He’s an activist. Alone without a voice he was a perp. With an audience of protestors he becomes a man of mystery. Every accused person in court is sized up in part based on his relations sitting behind him. Why shouldn’t Steve be allowed to show who his friends are?

As I reemerged from my car, already a police supervisor was yelling across the street to tell me I wouldn’t be allowed to wear that shirt. “Are you kidding?” I asked. I had a bag full of them, prepared for this eventuality if other spectators wanted to show solidarity. He was crossing the street to preempt my bringing the confrontation to the steps of the courthouse.

“Eric, you know the judge won’t let you wear that shirt.”

“I know no such thing. He only forbid things that say Occupy.” I knew this to be true, technically.

But they weren’t budging, they claimed a jury pool was already in the courtroom and they didn’t want to take any chances. Oddly, the officer blocking my way, beside the supervisor, was Good Old Officer Paladino who’d brutalized my friends and me in 2007. So he knew the t-shirt too well. Actually Officer Irwin Paladino’s history of abusing protesters goes back to 2003. I decided to dispense with plan B and invert my black t-shirt so I could go back in.

Did the CSPD make the smart call forbidding my t-shirt? I’ll be the first to admit the CSPD have outwitted the local social justice movement at every turn in Colorado Springs. They’re clever and competent, but they’re in the wrong. The CSPD are stepping on our rights, and overstepping their authority to do it. While it may have been superior gamesmanship, it was wrong.

Have I mentioned that they followed us everywhere? As if we were the accused in need of escort. On the officers’ radios we could hear them narrating our movements throughout the building. When Patrick went to the bathroom, an officer followed him inside and made small talk as Patrick peed. Did they think we were going to Mike Check the men’s room?

At one point we were able to see from a window on the second floor hall that CSPD were conferring with a parking enforcement officer around our cars. She was examining the license plates, getting on her phone, standing by the cars, as if waiting for something. The cars were legally parked, the meters fed, and well within the four hour limit. But who wants to argue with an impound lot? I assure you this intimidation tactic worked very well to send us out of the courthouse to rescue our vehicles.

Meanwhile, another friend came into the courthouse and overheard officers discussing whether to deny us entry again, and by what pretext, but I’m getting ahead of myself.

While watching the jury selection, it was the batch that was being dismissed in full, the court bailiff suddenly bolted from behind where we were sitting and told the judge she’d overheard us whispering about inappropriate subjects, specifically using profanity. This accusation was based on a dear Occupier’s habit of muttering colorful asides. Okay this was true, but in his defense, it was after the jury being spoiled, about the jury being spoiled, but inappropriate none-the-less and he apologized. But to tie all together in the misbehavior was a fabrication. The prosecutor tried to have us evicted, and Officer Paladino chimed in about the confrontation I instigated at the door. That’s when my friend told the judge she’d overheard CSPD officers discussing plans to keep us out, so the bailiff’s actions began to appear a little contrived.

This complaint was finally settled with the judge’s warning that one peep out of us would get us 90 days in jail for Contempt of Court. At this point we knew the pieces of duct tape we’d brought in to use to protest Steve’s gagging were definitely OUT.

Just before lunch recess I was able to clarify with Judge Williams whether the peace t-shirt I had wanted to wear was acceptable to the court. Receiving no objection from the prosecutor, the judge told me it would be okay, and then assured me he’d inform CSPD.

Returning from lunch, once again with the peace shirt, the security screeners nearly didn’t let me pass, but I barreled past with the confidence of someone who knows his rights. This time Officer Paladino came upon me at the courtroom door, swaggering right into my face assuring me he was not going to let me pass. FORTUNATELY before he could wrestle my arms behind my back, another supervisor arrived who’d heard the judge, and I was allowed to proceed. Boring story I know. But the pattern was unsettling.

Then Steve was found guilty, you could feel the city’s giddiness as they discussed sentencing. We’re only talking community service, but Colorado Springs has only one contractor for that, the odious Keep Colorado Springs Beautiful, whose hi profile task is to clean up after the CSPD Homeless Outreach Team scoops up the homeless and puts them in shelters very much in the model of correctional facilities. Steve was able to negotiate a less anti-homeless agency, and that’s the story so far.

Under cover of night Boston PD raided protest, arrested 50 and razed camp

Under cover of darkness, Boston and Massachusetts State Police raided Camp 2 of the OCCUPY BOSTON protest. A reported fifty activists were arrested, the police brutalized mostly elderly Veterans For Peace members trying to protect the campsite. Even as the paddy wagons were being filled, sanitation department garbage trucks were being filled with all the camp materials, tents, sleeping bags, signs and all. The pretext for the raid was that camping was in violation of city ordinances, the excuse being used on Wall Street and here in Colorado Springs. Constitutionally the enforcement of such laws are violating the protesters’ first amendment right to assemble, a right guaranteed night or day, sunny weather or inclement. The right to shelter is guaranteed by the UN Universal Declaration of Human Rights. Laws targeted at homelessness are being used exactly as opponents feared, to squelch political dissent. Notable about tonight’s raid, the Boston camp was an expansion camp relative to the original encampment, demonstrating that authorities will tolerate protest so long as it is nominal. They definitely do not want to see it growing.

Wikileaked: US soldiers are babykillers

A document released last week by Wikileaks tells of a 2006 raid by US troops on a farmhouse near Balad, Iraq, where the American soldiers handcuffed a household of ten, and executed them with gunshots to the head. Killed: one male adult, three female relatives, an elderly woman, four children aged 3-5, and a 5 month-old infant. Then the raiding party called in an airstrike to cover the crime. Perhaps cross referenced with the Iraq War Logs, reporters will identify which outfit committed the murders, because that’s the only way light is being shed on US war crimes, via Wikileaks. Incidentally, the Ishaqi Incident was reported on in 2006 with the Pentagon dismissing accusations that its actions were anything but appropriate. But this recent cable reveals that the USG knew what they’d done. You’d think the Department of Defense would have an interest in cooperating, because until the killers of zip-tied babies are fingered, all American soldiers are babykillers.

But they don’t have to. Afterward, they don’t even point a finger. And it’s working.

Via too many flat screens to stop, the world audience sees that Israel will stop at nothing to starve off its remaining Palestinians, neither violence, lawsuits, attempted murder, or slander, is too much to keep humanitarians from hindering Israel’s designs on Judea and Samaria.

Now I admit I favor just a little finger pointing, particularly when it’s too early to say, concrete evidence-wise, because that brings out something even less attractive. Accuse Israel immediately and guess what, they’ll indignantly try to put the blame on others. That’s ugly.

And they accuse you of antisemitism, even if you love Jews, but don’t favor the Zionist, mass-murdering variety.

Getting aid to the beleaguered Gazans may prove more difficult than a beeline Mediterranean cruise, but this mountain of a greater Palestinian cause is coming to Mohammed.

Delegitimizing Apartheid Israel is becoming as easy as taking candy from a baby-candy-taker. While the internet hasbarapocalypse foams at the mouth applauding what may or may not have been IDF divers who rigged the MV Saoirse to sink in mid voyage, or what may or may not have been Mossad undercover agents who relieved flotilla participants of their cellphones, the eagerness of Stand-With-Israel fans to stand with such tactics is compounding with self-antisemitism.

It’s becoming more and more clear, with obstacles like the corporate media stacked against critics of Israel, that a nonviolent strategy is tantamount to success against a lawless foe. Remember our TSA considers nail-clippers to be a weapon. your average ocean-going cabin cruiser arms itself with at least a speargun or two if there becomes a need to fend off would-be petty pirates. God forbid the Gaza Flotilla be caught with tools like that.

So how do flotilla activists keep a 24-hour watch against underwater demolition teams? How do elderly activists protect themselves from paid-hoodlums holding them up? The next flotilla will need an entourage of protectors I suppose, if this what happens to this flotilla doesn’t break the blockade of Gaza for good.

Joe Stack’s Piper Cherokee Manifesto

Single Engine AircraftIt’s getting so you can’t fly a plane into a federal office building and hope somebody will finally find your website. Though engineer Joseph Stack left an online statement to explain his last act of desperation against the IRS, it was deleted “in compliance with a request from the FBI.” I guess his web hosts think the 1st Amendment has an FBI exemption. Even Google’s cache was expunged. This has freed Reporters to characterize Stack’s missive as a crazed rant. Nothing threatens the establishment like this conclusion: “Sadly, though I spent my entire life trying to believe it wasn’t so, … violence … is the only answer. The cruel joke is that [those] at the top have known this all along and have been laughing, at … fools like me all along.” I don’t know about you, but when I hear that a self-made engineer-businessman who has his own plane, commits suicide on principles he has articulated in a manifesto, I’m curious to hear him out.

I’m reminded of the sad story of the desperate antiwar activist who set himself on fire as a final protest of the escalating wars in Iraq and Afghanistan. He knew accomplices would only dissuade him, so he chose an isolated spot where he could proceed unmolested and set up a video camera to record the act. Naturally, policemen were the first to encounter his body and thus the footage of dramatic statement are consigned to the obscurity of their files.

If you’re reading this, you’re no doubt asking yourself, “Why did this have to happen?”  The simple truth is that it is complicated and has been coming for a long time.  The writing process, started many months ago, was intended to be therapy in the face of the looming realization that there isn’t enough therapy in the world that can fix what is really broken.  Needless to say, this rant could fill volumes with example after example if I would let it.  I find the process of writing it frustrating, tedious, and probably pointless… especially given my gross inability to gracefully articulate my thoughts in light of the storm raging in my head.  Exactly what is therapeutic about that I’m not sure, but desperate times call for desperate measures.

We are all taught as children that without laws there would be no society, only anarchy.  Sadly, starting at early ages we in this country have been brainwashed to believe that, in return for our dedication and service, our government stands for justice for all.  We are further brainwashed to believe that there is freedom in this place, and that we should be ready to lay our lives down for the noble principles represented by its founding fathers.  Remember? One of these was “no taxation without representation”.  I have spent the total years of my adulthood unlearning that crap from only a few years of my childhood.  These days anyone who really stands up for that principle is promptly labeled a “crackpot”, traitor and worse.

While very few working people would say they haven’t had their fair share of taxes (as can I), in my lifetime I can say with a great degree of certainty that there has never been a politician cast a vote on any matter with the likes of me or my interests in mind.  Nor, for that matter, are they the least bit interested in me or anything I have to say.

Why is it that a handful of thugs and plunderers can commit unthinkable atrocities (and in the case of the GM executives, for scores of years) and when it’s time for their gravy train to crash under the weight of their gluttony and overwhelming stupidity, the force of the full federal government has no difficulty coming to their aid within days if not hours?  Yet at the same time, the joke we call the American medical system, including the drug and insurance companies, are murdering tens of thousands of people a year and stealing from the corpses and victims they cripple, and this country’s leaders don’t see this as important as bailing out a few of their vile, rich cronies.  Yet, the political “representatives” (thieves, liars, and self-serving scumbags is far more accurate) have endless time to sit around for year after year and debate the state of the “terrible health care problem”.  It’s clear they see no crisis as long as the dead people don’t get in the way of their corporate profits rolling in.

And justice? You’ve got to be kidding!

How can any rational individual explain that white elephant conundrum in the middle of our tax system and, indeed, our entire legal system?  Here we have a system that is, by far, too complicated for the brightest of the master scholars to understand.  Yet, it mercilessly “holds accountable” its victims, claiming that they’re responsible for fully complying with laws not even the experts understand.  The law “requires” a signature on the bottom of a tax filing; yet no one can say truthfully that they understand what they are signing; if that’s not “duress” than what is.  If this is not the measure of a totalitarian regime, nothing is.

How did I get here?

My introduction to the real American nightmare starts back in the early ‘80s.  Unfortunately after more than 16 years of school, somewhere along the line I picked up the absurd, pompous notion that I could read and understand plain English.  Some friends introduced me to a group of people who were having ‘tax code’ readings and discussions.  In particular, zeroed in on a section relating to the wonderful “exemptions” that make institutions like the vulgar, corrupt Catholic Church so incredibly wealthy.  We carefully studied the law (with the help of some of the “best”, high-paid, experienced tax lawyers in the business), and then began to do exactly what the “big boys” were doing (except that we weren’t stealing from our congregation or lying to the government about our massive profits in the name of God).  We took a great deal of care to make it all visible, following all of the rules, exactly the way the law said it was to be done.

The intent of this exercise and our efforts was to bring about a much-needed re-evaluation of the laws that allow the monsters of organized religion to make such a mockery of people who earn an honest living.  However, this is where I learned that there are two “interpretations” for every law; one for the very rich, and one for the rest of us… Oh, and the monsters are the very ones making and enforcing the laws; the inquisition is still alive and well today in this country.

That little lesson in patriotism cost me $40,000+, 10 years of my life, and set my retirement plans back to 0.  It made me realize for the first time that I live in a country with an ideology that is based on a total and complete lie.  It also made me realize, not only how naive I had been, but also the incredible stupidity of the American public; that they buy, hook, line, and sinker, the crap about their “freedom”… and that they continue to do so with eyes closed in the face of overwhelming evidence and all that keeps happening in front of them.

Before even having to make a shaky recovery from the sting of the first lesson on what justice really means in this country (around 1984 after making my way through engineering school and still another five years of “paying my dues”), I felt I finally had to take a chance of launching my dream of becoming an independent engineer.

On the subjects of engineers and dreams of independence, I should digress somewhat to say that I’m sure that I inherited the fascination for creative problem solving from my father.  I realized this at a very young age.

The significance of independence, however, came much later during my early years of college; at the age of 18 or 19 when I was living on my own as student in an apartment in Harrisburg, Pennsylvania.  My neighbor was an elderly retired woman (80+ seemed ancient to me at that age) who was the widowed wife of a retired steel worker.  Her husband had worked all his life in the steel mills of central Pennsylvania with promises from big business and the union that, for his 30 years of service, he would have a pension and medical care to look forward to in his retirement.  Instead he was one of the thousands who got nothing because the incompetent mill management and corrupt union (not to mention the government) raided their pension funds and stole their retirement.  All she had was social security to live on.

In retrospect, the situation was laughable because here I was living on peanut butter and bread (or Ritz crackers when I could afford to splurge) for months at a time.  When I got to know this poor figure and heard her story I felt worse for her plight than for my own (I, after all, I thought I had everything to in front of me).  I was genuinely appalled at one point, as we exchanged stories and commiserated with each other over our situations, when she in her grandmotherly fashion tried to convince me that I would be “healthier” eating cat food (like her) rather than trying to get all my substance from peanut butter and bread.  I couldn’t quite go there, but the impression was made.  I decided that I didn’t trust big business to take care of me, and that I would take responsibility for my own future and myself.

Return to the early ‘80s, and here I was off to a terrifying start as a ‘wet-behind-the-ears’ contract software engineer… and two years later, thanks to the fine backroom, midnight effort by the sleazy executives of Arthur Andersen (the very same folks who later brought us Enron and other such calamities) and an equally sleazy New York Senator (Patrick Moynihan), we saw the passage of 1986 tax reform act with its section 1706.

For you who are unfamiliar, here is the core text of the IRS Section 1706, defining the treatment of workers (such as contract engineers) for tax purposes. SEC. 1706. TREATMENT OF CERTAIN TECHNICAL PERSONNEL.

(a) IN GENERAL – Section 530 of the Revenue Act of 1978 is amended by adding at the end thereof the following new subsection:

(d) EXCEPTION. – This section shall not apply in the case of an individual who pursuant to an arrangement between the taxpayer and another person, provides services for such other person as an engineer, designer, drafter, computer programmer, systems analyst, or other similarly skilled worker engaged in a similar line of work.

(b) EFFECTIVE DATE. – The amendment made by this section shall apply to remuneration paid and services rendered after December 31, 1986.

Note:

·      “another person” is the client in the traditional job-shop relationship.

·      “taxpayer” is the recruiter, broker, agency, or job shop.

·      “individual”, “employee”, or “worker” is you.

Admittedly, you need to read the treatment to understand what it is saying but it’s not very complicated.  The bottom line is that they may as well have put my name right in the text of section (d).  Moreover, they could only have been more blunt if they would have came out and directly declared me a criminal and non-citizen slave.  Twenty years later, I still can’t believe my eyes.

During 1987, I spent close to $5000 of my ‘pocket change’, and at least 1000 hours of my time writing, printing, and mailing to any senator, congressman, governor, or slug that might listen; none did, and they universally treated me as if I was wasting their time.  I spent countless hours on the L.A. freeways driving to meetings and any and all of the disorganized professional groups who were attempting to mount a campaign against this atrocity.  This, only to discover that our efforts were being easily derailed by a few moles from the brokers who were just beginning to enjoy the windfall from the new declaration of their “freedom”.  Oh, and don’t forget, for all of the time I was spending on this, I was loosing income that I couldn’t bill clients.

After months of struggling it had clearly gotten to be a futile exercise.  The best we could get for all of our trouble is a pronouncement from an IRS mouthpiece that they weren’t going to enforce that provision (read harass engineers and scientists).  This immediately proved to be a lie, and the mere existence of the regulation began to have its impact on my bottom line; this, of course, was the intended effect.

Again, rewind my retirement plans back to 0 and shift them into idle.  If I had any sense, I clearly should have left abandoned engineering and never looked back.

Instead I got busy working 100-hour workweeks.  Then came the L.A. depression of the early 1990s.  Our leaders decided that they didn’t need the all of those extra Air Force bases they had in Southern California, so they were closed; just like that.  The result was economic devastation in the region that rivaled the widely publicized Texas S&L fiasco.  However, because the government caused it, no one gave a shit about all of the young families who lost their homes or street after street of boarded up houses abandoned to the wealthy loan companies who received government funds to “shore up” their windfall.  Again, I lost my retirement.

Years later, after weathering a divorce and the constant struggle trying to build some momentum with my business, I find myself once again beginning to finally pick up some speed.  Then came the .COM bust and the 911 nightmare.  Our leaders decided that all aircraft were grounded for what seemed like an eternity; and long after that, ‘special’ facilities like San Francisco were on security alert for months.  This made access to my customers prohibitively expensive.  Ironically, after what they had done the Government came to the aid of the airlines with billions of our tax dollars … as usual they left me to rot and die while they bailed out their rich, incompetent cronies WITH MY MONEY!  After these events, there went my business but not quite yet all of my retirement and savings.

By this time, I’m thinking that it might be good for a change.  Bye to California, I’ll try Austin for a while.  So I moved, only to find out that this is a place with a highly inflated sense of self-importance and where damn little real engineering work is done.  I’ve never experienced such a hard time finding work.  The rates are 1/3 of what I was earning before the crash, because pay rates here are fixed by the three or four large companies in the area who are in collusion to drive down prices and wages… and this happens because the justice department is all on the take and doesn’t give a fuck about serving anyone or anything but themselves and their rich buddies.

To survive, I was forced to cannibalize my savings and retirement, the last of which was a small IRA.  This came in a year with mammoth expenses and not a single dollar of income.  I filed no return that year thinking that because I didn’t have any income there was no need.  The sleazy government decided that they disagreed.  But they didn’t notify me in time for me to launch a legal objection so when I attempted to get a protest filed with the court I was told I was no longer entitled to due process because the time to file ran out.  Bend over for another $10,000 helping of justice.

So now we come to the present.  After my experience with the CPA world, following the business crash I swore that I’d never enter another accountant’s office again.  But here I am with a new marriage and a boatload of undocumented income, not to mention an expensive new business asset, a piano, which I had no idea how to handle.  After considerable thought I decided that it would be irresponsible NOT to get professional help; a very big mistake.

When we received the forms back I was very optimistic that they were in order.  I had taken all of the years information to Bill Ross, and he came back with results very similar to what I was expecting.  Except that he had neglected to include the contents of Sheryl’s unreported income; $12,700 worth of it. To make matters worse, Ross knew all along this was missing and I didn’t have a clue until he pointed it out in the middle of the audit.  By that time it had become brutally evident that he was representing himself and not me.

This left me stuck in the middle of this disaster trying to defend transactions that have no relationship to anything tax-related (at least the tax-related transactions were poorly documented).  Things I never knew anything about and things my wife had no clue would ever matter to anyone.  The end result is… well, just look around.

I remember reading about the stock market crash before the “great” depression and how there were wealthy bankers and businessmen jumping out of windows when they realized they screwed up and lost everything.  Isn’t it ironic how far we’ve come in 60 years in this country that they now know how to fix that little economic problem; they just steal from the middle class (who doesn’t have any say in it, elections are a joke) to cover their asses and it’s “business-as-usual”.  Now when the wealthy fuck up, the poor get to die for the mistakes… isn’t that a clever, tidy solution.

As government agencies go, the FAA is often justifiably referred to as a tombstone agency, though they are hardly alone.  The recent presidential puppet GW Bush and his cronies in their eight years certainly reinforced for all of us that this criticism rings equally true for all of the government.  Nothing changes unless there is a body count (unless it is in the interest of the wealthy sows at the government trough).  In a government full of hypocrites from top to bottom, life is as cheap as their lies and their self-serving laws.

I know I’m hardly the first one to decide I have had all I can stand.  It has always been a myth that people have stopped dying for their freedom in this country, and it isn’t limited to the blacks, and poor immigrants.  I know there have been countless before me and there are sure to be as many after.  But I also know that by not adding my body to the count, I ensure nothing will change.  I choose to not keep looking over my shoulder at “big brother” while he strips my carcass, I choose not to ignore what is going on all around me, I choose not to pretend that business as usual won’t continue; I have just had enough.

I can only hope that the numbers quickly get too big to be white-washed and ignored that the American zombies wake up and revolt; it will take nothing less.  I would only hope that by striking a nerve that stimulates the inevitable double standard, knee-jerk government reaction that results in more stupid draconian restrictions people wake up and begin to see the pompous political thugs and their mindless minions for what they are.  Sadly, though I spent my entire life trying to believe it wasn’t so, but violence not only is the answer, it is the only answer.  The cruel joke is that the really big chunks of shit at the top have known this all along and have been laughing, at and using this awareness against, fools like me all along.

I saw it written once that the definition of insanity is repeating the same process over and over and expecting the outcome to suddenly be different.  I am finally ready to stop this insanity.  Well, Mr. Big Brother IRS man, let’s try something different; take my pound of flesh and sleep well.

Cindy Sheehan, Phil Ward & Travis AFB

Action against UAV drones at Travis AFB, CaliforniaColorado Springs has its own loony pro-war vet, every bit the ass like retired sergeant Phil Ward, pictured here trying to intimidate antiwar luminary Cindy Sheehan. The good news is these puffed chests are easily deflated, but you have to act decisively. Sheehan and her colleagues plan to press charges against Ward, who police had let pass, and whom the media permitted to remain nameless.

The media have blamed last week’s altercation on Sheehan, although the video shows otherwise. The elderly vet can be seen moving straight into Sheehan, standing nose to cheek until she steps back and attempts to keep him one bullhorn’s length away. Then Ward strikes at the horn, and pushes others who come to Sheehan’s rescue.

Though he put Sheehan and her fellow activists at risk, Sgt. Ward brought the media’s attention to her new tour to protest the US Air Force bases, in this case Travis AFB in California and Creech AFB in Nevada, from which air strikes on Afghanistan, Pakistan and Iraq are being conducted via unmanned drones.

Hmm. Where is our good old Major George when we need some publicity?

“Killing is right and proper”

On Saturday, Bay Area CODEPINK and I, started our caravan to Creech AFB in Nevada with a morning peace rally at Travis AFB in Fairfield, CA.

After we got there we were informed that we had to move off the base and were shown by MPs where we could protest. As good warriors for free speech and peace, we groused about it and we were moving forward to where we were supposed to go, when a very angry older man pulled up and started yelling at us to: “Don’t go, I want to counter protest you.” I told him, first of all, he shouldn’t be drinking so early in the morning, and secondly not to worry, that we were going anywhere, we were just moving about 100 yards away.

We decided to just stop and take a picture by the Travis AFB sign and then we were going to get back in our cars to caravan down to Lemoore NAS because it was extremely windy and we were running a little late anyway.

I was giving a little speech denouncing the drone-bombing program and the upcoming 50 percent troop escalation to Afghanistan, when the angry old man, now dressed in a military uniform, charged around the corner and got right into my bullhorn-I told him to get out of my face and he very violently slaps the bullhorn away from me.

Everything happened so quickly: I was so shocked that I was actually physically assaulted that I just turned away from him and that’s when my colleague, Suzanne immediately jumped to my aid and got between the man and me. He swore profusely and pushed her-and then a mini-melee ensued. The numerous MPs and POs that were there finally intervened after I asked them to stop the man from assaulting my friends. I touched no one even though I was within my rights to defend myself. The video clearly shows that the aggressor and the person who brought unreasoning anger and violence to the rally was Sgt. Phil Ward

After the mini-melee, a Fairfield Police Officer, told Suzanne and I that we couldn’t press charges against the man who physically assaulted us because it was a “he-said, she-said” situation, when at least one dozen law enforcement officers were standing around and witnessing the events AND if we did press charges, then Suzanne and I would also have to go to jail until things got sorted out! Complete bullshit.

After all that, when we were leaving, like we were asked to, I got about 2 feet out of the parking lot and I noticed one of the CODEPINK women was not in the van, so I pulled over to the side of the road to wait for her and as soon I we got rolling again, to add insult to injury, I WAS PULLED OVER and detained for about one-half hour and kept isolated in my car from the others until I was presented with a ticket for “impeding traffic!”

We dropped my daughter’s car off and I hopped in the van with a group of desperadoes, (with me being the third youngest, at 52, and six out of eleven in the van being over 70), and we headed down to Lemoore NAS and a National Guard post in Fresno. After another three- hour drive from Fresno, we landed at a cheap motel in Mojave California and I was shocked to open my email and see that I had received numerous emails attacking me for essentially “bullying” a poor, old military veteran.

I watched the news videos to confirm my recollection, which was 100 percent correct. I got to watch an interview that Phil Ward did after his attack on us and he says that the killing in the wars is “right and proper” and was exceedingly upset with Obama because he is only sending 34,000 more troops to Afghanistan when the generals asked for 40,000 more. During an interview with me, I am clearly shaken, but I say, “no matter how much violence they bring to us, we will bring them more peace.”

A thing to think about in this whole episode, is that at least one area newspaper posted that we were going to be at Travis AFB, and it only drew ONE person out to protest us who was unreasonably aggressive and almost comically out of control? Hmm-it makes one wonder what Phil Ward was up to. He charged out of his car at us from the second he got there and felt it was okay to be physically aggressive towards me and the other protestors and he did get away with it with impunity?

We will bring them more peace, but we will also bring them justice, too, as we are planning on pressing charges against Phil Ward as soon as we return from Creech AFB.

There’s scum that attack and more scum that protect those attackers.

There’s scum that take away our rights to peaceably assemble and to freedom of speech, and more scum that protect those who try to steal those rights.

We the People need to be the ones to vigorously defend our rights and defend peace on earth from everyone from Sgt. Phil Ward to President Obama who think that killing is “right and proper.”

I’d like to revisit photographs of George Bush. On everyone pictured standing next to him, I’ll stamp “NOT AL-ZAIDI,” meaning, NOT A HERO. The tag would apply to all of us of course, but in particular, to those who had a chance -but didn’t- to confront the naked emperor. The single bravest man in the world, Muntadhar al Zaidi, was released from prison this week, to recount the torture he endured for his act. Is your courage bolstered or tempered by his example? We are inspired by the unbroken Al Zaidi, but his keepers, our governments, know how to repress our audacity. We’re let to celebrate Al Zaidi as a hero, but he has also been made an example, for rule by state terrorism.

Said al Zaidi: “What provoked me to a confrontation was the injustice that has befallen my people, and the way in which the occupation wanted to humiliate my country by placing it and its people—the elderly, women, children and men—under its boot. At the time the Iraqi prime minister appeared on satellite channels saying he would not sleep until he was assured of Bush’s safety, I found ample bedding and cover. As the prime minister was speaking, I was being tortured in the most cruel manner, being electrocuted, beaten with cables, beaten with metal rods.”

Osama on Obama

The usual channels have yielded another video from Osama bin Laden, wherein a still photo of the al-Qaeda godfather accompanies an audio “statement to the American people,” purportedly recorded June 4. Here is the full English translation of the 10 minute tape. First, two questions.

ONE: I find it interesting that the message echoes what most anti-imperialists already believe. From a Chavez, or Ahmadinejad, this text would be timid. Throw in the unverified nature of this transmission, the mystery of whether Osama lives, or whose interest he really served, and this new tape subverts somebody’s message, but whose?

For example, in the new tape, Osama bin Laden recommends three books. The NYT is quick to tell us that any recommendation from bin Laden is certainly unwelcome by any author. The books? The Israel Lobby and US Foreign Policy, Jimmy Carter’s Palestine: Peace not Apartheid, and Confessions of an Economic Hit Man. The NYT just as quickly dismissed the titles as well.

TWO: Why does no one release the full translation of Osama’s message? Newspapers comment on his statements based on interpretations made by US intelligence contractors, who themselves do not release their translations to the public.

Are there no Arabic speakers who wish to translate bin Laden’s words for the international audience? Why is everyone content to hear what the US government says is Osama’s message?

“And here we should pause for a moment, for anyone with an atom’s weight of mercy is compelled to sympathize with the suffering of the elderly, women, and children under the fatal siege, while above them the Zionists pour down burning American-made white-phosphorus bombs. Life there is miserable beyond any conception, such as the number of children who are dying in the hands of their fathers and doctors because of a lack of food, medicine, and basic electricity. It is truthfully a stain of shame on the forehands of all world politicians who facilitate this, and the people who ally with them with prior knowledge of their intentions—along with the influence from the Israeli lobby in America. And here, there is an important point that requires attention regarding the war and stopping it: when Bush took power and appointed a secretary of defense who had assisted in killing two million suffering villagers in Vietnam, intelligent people predicted on that day that Bush was preparing for new massacres during his term in office, and this is what occurred in Iraq and Afghanistan. Then, Obama took charge and kept Cheney and Bush’s men—those from the senior leadership in the Pentagon—like Gates, Mullen, and Petraeus. Intelligent people understand that Obama is a weak man who cannot stop the war like he promised, but instead, he will postpone it to the greatest possible degree. If he was really in control, then he would have handed over leadership to the generals who have opposed this foolish war—like the former forces commander General Sanchez and the head of Central Command who was forced by Bush to resign shortly before leaving the White House because of his opposition to the war. Life, Love, Liberty and Lunch

I thought the advent of Youtube would finally lead me to the script for a TV special of the late 70s called Life, Love, Liberty and Lunch. I can find only scant trace of it online. And so I will post sans link.

L4 was a TV special which incorporated four scenes by leading playwrights Neil Simon, Tom Stoppard, Eric von Italie and one more. It might have been Peter Ustinov, and his is the only one I remember. The rest of the program played like Love American Style I think, or Short Cuts. I’m thinking the Liberty segment had to do with the 1976 bicentennial. But the last segment was like I’m Not Rappaport with a big smile.

In the last scene, two elderly gentlemen meet in Central Park, as they do every day, to play not chess, but a game of verbal oneupmanship. Today their contest is to paint the perfect lunch, and they describe every successive course with the zeal of famished itinerants actually pouncing on it. As dessert nears, each is determined to add the last touch. Peter Ustinov played one of the gentlemen and he asked his rival if after reaching cheese, dessert, sherry, and coffee, he could think of nothing else. No, said his opponent, already confident of triumph. Nothing else, baited Ustinov?

You forgot, said the great actor to his old friend…. A CIGAR! No truly great meal could go without, the other concedes, and the two walk of together, to part until the next time.

So many years later, mere mention of cigars still conjures that scene for me. It’s still hard for me to imagine that it could even be true, that cigars improve a post-meal glow, but I’ll take a distinguished elder’s word for it. LUNCH was about anticipating that others, especially others with seniority, can always have something up their sleeve to teach you.

Burn your uniforms…

All those who sat and watched and cheered when the Colorado Springs Gestapo beat elderly and disabled persons for the non-crime of participation in a parade, and still say after two and a half years that you’re “fighting for Freedom”. Bullshit. You had a chance to stand for freedom right here in America and in all that time chose not to do so.
Military both Active Duty and Paramilitary Youth groups like the Scouts and Devilpups and Young Marines… burn your uniforms. You’ve soiled them with the blood of Americans, repeatedly.

Your fascist attitudes and actions have earned you shame, yet you have not enough pride or dignity to even be embarrassed by your hypocrisy and Lies.

“Freedom” for only those who agree with you is slavery to everybody else. To say otherwise you shame the very name of Liberty.

Dispute over flag protest erupts in Wisc. village

WAUSAU, Wis. – An American flag flown upside down as a protest in a northern Wisconsin village was seized by police before a Fourth of July parade and the businessman who flew it — an Iraq war veteran — claims the officers trespassed and stole his property.

A day after the parade, police returned the flag and the man’s protest — over a liquor license — continued.

The American Civil Liberties Union of Wisconsin is considering legal action against the village of Crivitz for violating Vito Congine Jr.’s’ First Amendment rights, Executive Director Chris Ahmuty said.

“It is not often that you see something this blatant,” Ahmuty said.

In mid-June, Congine, 46, began flying the flag upside down — an accepted way to signal distress — outside the restaurant he wants to open in Crivitz, a village of about 1,000 people some 65 miles north of Green Bay.

He said his distress is likely bankruptcy because the village board refused to grant him a liquor license after he spent nearly $200,000 to buy and remodel a downtown building for an Italian supper club.

Congine’s upside-down-flag represents distress to him; to others in town, it represents disrespect of the flag.

Hours before a Fourth of July parade, four police officers went to Congine’s property and removed the flag under the advice of Marinette County District Attorney Allen Brey.

Neighbor Steven Klein watched in disbelief.

“I said, ‘What are you doing?’ Klein said. “They said, ‘It is none of your business.'”

The next day, police returned the flag.

Brey declined comment Friday.

Marinette County Sheriff Jim Kanikula said it was not illegal to fly the flag upside down but people were upset and it was the Fourth of July.

“It is illegal to cause a disruption,” he said.

The parade went on without any problems, Kanikula said.

Village President John Deschane, 60, an Army veteran who served in Vietnam, said many people in town believe it’s disrespectful to fly the flag upside down.

Congine, a Marine veteran who served in Iraq in 2004, said he intends to keep flying the flag upside down.

“It is pretty bad when I go and fight a tyrannical government somewhere else,” Congine said, “and then I come home to find it right here at my front door.”

At least they didn’t beat up any elderly and disabled people…

Freezing the elderly to death in America

He had not paid his utility bill of $1,000 outstanding, but he had a will donating $600,000 to another corporation, the McLaren Health Care Corporation which controls the administration of the local hospital (Bay Regional Medical Center) near by.

Poor man. And here is the news that the national media did not report, and that is that this corporation that this poor gentleman donated his money to pays its CEO around $2,500,000 salary per year! That’s his picture up there.

Around 600 people per year freeze to death each Winter in the US, which is not too bad for a capitalist country when you consider that much smaller Hungary (another country with a capitalist government) loses almost the same number of poor each Winter, too. I got ‘overdraft protection’ from Bank of America, and I went over about $2 on a Safeway debit card purchase with them. They charged me over $100 before I even knew about it. I had told them I didn’t want their ‘protection’, but they had given me it anyway. So I closed out with them, Bank of America not even having any local banks in the area. Now they call me twice a day with a recorded message and have screwed with my credit rating. That’s my overdraft protection’ plan from them…. phone harassment.

If somebody came and knocked repeatedly twice a day unsolicited on my front door, the police would go get them for this abuse. But Bank of America can bombard me with computerized phone calls 14 times a week, and nobody calls that a crime, except for me. The bastards. Why doesn’t Barack Obama give me ‘overdraft protection’ from the Bank of America criminals?

Bank of America though has been given much better and real overdraft protection by their cronies, Barack and Dubya, the DP and RP. Little accounting error? Then Dubya and Barack are stumbling all over themselves to rush multiple tens of billions to Bank of America to fix their small little banking ‘error’!

They could actually nationalize the damn Bank of America and that would be fine by me. Hey, why doesn’t our government do just exactly that? Nationalizing is what they do with many small folk who go to jail if they do not pay off money they steal from others through their ‘bad investments’. Heck, the cops never even give small crooks the option to return that money, it’s simply you have been ‘nationalized’ and now you spend the next 20 years with us! Where’s the respect for small time crooks who are merely emulating the Bank Of America Big Boys with their financial thefts? The ‘law’ is rather strange in America… Rob little and you are a Bad Boy. Rob BIG, and the government starts throwing other people’s money at you!

“Antibiotics don’t kill it and most germicides used for environmental cleaning don’t kill it. Only bleach does,” and by the time patients are diagnosed, they have had a day or two to contaminate their rooms and everyone who has had contact with them.

This study gives a really low undercount of this problem, too, since most facilities are not doing the testing and do not have the awareness about this disease that they should have. One big cause of the problem is the simple misappropriation of funds away from hiring enough nursing assistants to do decent care of the elderly in US hospitals and nursing homes. The money flows to the top reaches into the hands of people who do little to no actual hands-on work caring for the elderly and sick. I’m talking about insurance companies and all the administrative layers they create to pilfer funds away from the actual care givers themselves.

Not to be outdone by Russian mechanical robotic nurses and surgeons, the Japanese apparently are banking more on using cyborgs in the capitalist medical field. Americans are still most heavily into computerized systems, it seems, as the hospitals there are into the use of computers to program and flowchart flesh and blood nursing/ medical staff more and more?.

Maybe you are in need of the Robotic Physiotherapist’ on its way, whose ultrasound behavior you can surely count on? And the Pentagon has already developed the robotic EMT known as Vecna BEAR Robot For Battlefield Extraction And Retrieval. Capitalist medicine is a science and not an art, and a lab rat can get no better care than what is ahead for us.

Regulation, testing, law, and deception

shysterIn America we are seeing a convergence of the meltdown of all capitalist for-profit driven systems breaking down all at once, whether it be the Financial System, the Health System, the Legal System, or the Educational System. At the heart of the problem is that regulations, testing, and law have been turned into their total opposites by the American Business Community, as they search out profits with an unparalleled, in the history of Humankind, greed and avarice.

In Education, we see Big Business mandated testing being used to dis-educate youth. In Finance, we see the regulatory agencies acting to allow fiscal business anarchy. In law, we see the legal code twisting and turning itself around to codify and legalize torture. In the Health System the regulations are being used by the corporate world to protect their abuse of the elderly and sick, rather than to keep that from happening. In short, American capitalism has become most adept at hijacking regulatory systems under their control, and then using them to produce chaos and dysfunction.

George Will’s vocabulary outshines him

George Will Hitler bowtieCOLORADO SPRINGS- Some people look smaller in person than they do on TV. Many of us only know George Will from newsprint, but in person he’s an organ grinder’s monkey, amusingly agile, if a little threatening, but basically smallish and tethered to somebody asking for money.

Maybe it was my perspective from the steep audience seating in the South Theater of CC’s new Cornerstone Arts Center. Maybe it was looking down at George as he walked in circles between folksy baseball anecdotes, over-simplified economics and patronizing criticism of the American culture of entitlement.

I wanted to ask how a gentleman of his obvious acuity got any pleasure from addressing audiences like they were idiots. People who applauded him, by the way, and laughed at the slightest old joke. “Half of all students are of below average intelligence.” Hahahahaha. “I’m glad you got that one.” Hahahahaha.

I remember a professor I had in an advanced math class who used to berate us undergrads for the time he had to waste with us. Tonight’s audience was filled to overflow with Colorado Springs’ better-heeled hayseeds, but George Will seemed perfectly at home.

Will’s “reflections on the 2008 election” consisted of the usual horse race stats about which states have to be won by whom in order to satisfy the probabilities of precedent. “History is consistent after all,” he was attributing this adage to someone I think, “right up until the moment it isn’t.” Hahahaha. Numbers and groups of states, etc. The next president may again win the necessary electoral votes and loose the popular vote.

As a gesture to the college age portion of tonight’s audience, Will offered that all the statistical stars were lining up for a Democratic win in November, but to his contemporaries in the theater Will later confided that he didn’t consider Obama ready to lead. He also opined that Sarah Palin would provide a refreshing change to Washington DC.

Thankfully the Pulitzer Prize rewardee soon wrapped up his election year remarks and got back on the horse he undoubtedly had been commissioned to ride. Scold Americans for their entitlement mentality and convince them to privatize Social Security. There followed a Libertarian mocking of all social responsibility, and an incredible stretching of credulity seeing the absence of ready rebuttal.

Take for example, Big Pharma. George Will applauds Big Pharma and the obscene profits they reap. Those profits are only appropriate, he says, considering the tremendous costs the pharmaceuticals bear with R&D and the circumnavigation of regulations. Really George? Profit is the product of income minus expense. You want to count the expenses twice? One might compare profit against expense in the light of risk, but wouldn’t that be to beg the definition of “obscene” profits, considering none have reported obscene losses?

Will chastised the growth of the Agricultural Department citing the narrowing ratio of Ag employees to American Farmers, without referencing the precipitous rise of Big Agra and the eclipse of family farms.

Of course, entitlement programs were the chief evil, while no mention was made to corporate entitlements or bailouts or subsidized banking or the federal deficit, EXCEPT where Americans will obviously have to borrow from the next generations to finance Medicare and Social Security.

While George Will admonished Americans for wanting more from their government, he expressed not a single curiosity for how every other developed nation is able to care for their sick, their poor, and their elderly. In fact, Will compared West Germany to East Germany as an example of Capitalism’s proven superiority to Socialism, without observing that modern Germany’s social system is not the heartless one he advocates for here.

Will got lots of applause, and fielded no challenging questions. A last answer, defined for me, the nature of his limited mindset. Will was asked if a sales tax mightn’t be a more equitable substitute for the income tax. Never mind it being regressive, the suggestion certainly pleased the crowd. George Will explained that a sales tax would have to be in excess of 20% to provide the same monies. This would be unfeasible, Will pronounced. But he didn’t say it was because neither the poor, nor the working class, nor the middle class could afford a 20% rise in the cost of living. No, Will described how buying a $500,000 home would mean an additional $100,000 in tax. Unthinkable he said. And he accuses Obama of being elitist. Hahahahaha.

Finding respite in Beijing’s hutongs

BEIJING- Since I arrived in China I’ve made it my mission to avoid Westerners. Hitting the Beijing historical sites a week before the Games, then traveling by overnight train to Xi’an (three Chinese and me in a tiny cubicle with four bunks — now that was fun), I’ve found myself immersed in a sea of Asian faces. An odd feeling, but not as odd as being surrounded by only Chinese voices.

The Chinese are a garrulous people, speaking in monosyllabic singsong nasal tones, downright noisy by my standards. Interestingly, though, the sounds don’t bother me at all. The voices seem to blend with the screeching of the cicadas or the chirping of the birds. I hear them, but since I don’t understand the language, or even the intonation, the noise becomes like background music to me. Less intrusive than listening to my iPod because I don’t feel compelled to fast forward, contemplate lyrics, or sing along. I think it’s like being deaf, only with sound.

Avoiding Westerners has become more difficult now that the Games are underway. Yesterday, I found a safe haven in the hutongs of old Beijing. For several hundred years, the majority of Beijing residents lived in siheyuan, which are housing compounds with rooms arranged around a central courtyard. The hutongs, or narrow alleyways, run between rows of siheyuan. Hutong has come to refer to neighborhoods set up this way.

Life in the hutongs is a slow and simple affair. Elderly women sit side-by-side on stools barely six inches off the ground. The old men squat around wooden game boards, occasionally laughing at one thing or another. Middle-aged women sew or cook in tiny rooms with open doors, always facing the street so as not to miss any of the goings-on. Little children do as little children do everywhere. I didn’t see many young men and women in the hutongs. I imagine they were somewhere in the city, straddling the divide between the old and new China.

Wherever I walked, the people stared at me with undisguised curiosity. They didn’t appear friendly, nor unfriendly. They simply watched. I would return their gaze for a moment, bow my head slightly and smile. “Nin hao,” I’d say, hoping that my attempt to singsong the syllables didn’t pain them too much. Without fail, they smiled and returned the greeting enthusiastically. Often they offered me whatever they had in their hands—a piece of fruit, a paper fan, a plastic-beaded bracelet. I would point to my camera, asking permission to take a picture. They would laugh and blush and hide behind each other in protest. I wasn’t sure how to interpret their apparent reticence, but I thought it was best to accept it at face value and photograph the laundry or the bicycles instead.

With the modernization of Beijing, many residents have moved from the hutong to the high-rise. But I found that a few traditional hutongs, home to lovely people who can remember when, may still be found by a girl on a quest to avoid the West.

Hairy monkeys of old Beijing

Beijing handicraftBEIJING- Eric once told me that he liked hanging around his artist friend, Patti Smithsonian, because she saw creative potential in nearly everything. He’d see a stack of old paper and head for the garbage can. She’d stop him. “Don’t throw that away! Let’s tear it into strips and make a papier-mâché hat!” That kind of thing.

I’ve since experienced the same thing with my project-princess daughter. Packing materials, raffia, old lightbulbs, used ribbon — nothing gets tossed until I’ve run it by my little artist’s eye.

Winding my way through the hutongs of central Beijing yesterday, I came across something that will give Devon and Patti a year’s worth of new ideas. Hairy monkeys. An old folk handicraft started in the late Qing dynasty, hairy monkeys are made from the furry magnolia bud and the shed skin of the ever-present and super-screechy cicada. Resembling human beings in action — fortune tellers, barbers, fruit sellers, street hawkers — the hairy monkeys recall the urban life and customs of old Beijingers. Treasures from childhood, the monkeys are still loved by the elderly hutong-dwellers.

I found them completely hilarious and charming. I know Devon will, too. The already-long list of things I can’t pitch out will get even longer as it grows to encompass the entire outdoors.
