HR-3962 a travesty of mockery of sham

new medicare logoWhile a number of Democrats implicated themselves by joining all but one Republican to vote against the Affordable Health Care for America Act, let’s make a distinction for Representative Dennis Kucinich who had reasons the other congressmen are not prepared to articulate. For example, Colorado District 4 house rep Betsy Markey rejected HR-3962 for the usual GOP tea party bugaboos, asserting it would hurt the deficit and didn’t include tort reform. Below is the statement Kucinich released Nov 7. Chew on this, as Dems pat themselves on the back.

Why I Voted NO

We have been led to believe that we must make our health care choices only within the current structure of a predatory, for-profit insurance system which makes money not providing health care.  We cannot fault the insurance companies for being what they are.  But we can fault legislation in which the government incentivizes the perpetuation, indeed the strengthening, of the for-profit health insurance industry, the very source of the problem. When health insurance companies deny care or raise premiums, co-pays and deductibles they are simply trying to make a profit.  That is our system.

Clearly, the insurance companies are the problem, not the solution.  They are driving up the cost of health care.  Because their massive bureaucracy avoids paying bills so effectively, they force hospitals and doctors to hire their own bureaucracy to fight the insurance companies to avoid getting stuck with an unfair share of the bills.  The result is that since 1970, the number of physicians has increased by less than 200% while the number of administrators has increased by 3000%.  It is no wonder that 31 cents of every health care dollar goes to administrative costs, not toward providing care.  Even those with insurance are at risk. The single biggest cause of bankruptcies in the U.S. is health insurance policies that do not cover you when you get sick.

But instead of working toward the elimination of for-profit insurance, H.R. 3962 would put the government in the role of accelerating the privatization of health care.  In H.R. 3962, the government is requiring at least 21 million Americans to buy private health insurance from the very industry that causes costs to be so high, which will result in at least $70 billion in new annual revenue, much of which is coming from taxpayers.  This inevitably will lead to even more costs, more subsidies, and higher profits for insurance companies — a bailout under a blue cross.

By incurring only a new requirement to cover pre-existing conditions, a weakened public option, and a few other important but limited concessions, the health insurance companies are getting quite a deal.  The Center for American Progress’ blog, Think Progress, states “since the President signaled that he is backing away from the public option, health insurance stocks have been on the rise.”  Similarly, healthcare stocks rallied when Senator Max Baucus introduced a bill without a public option. Bloomberg reports that Curtis Lane, a prominent health industry investor, predicted a few weeks ago that “money will start flowing in again” to health insurance stocks after passage of the legislation.  Investors.com last month reported that pharmacy benefit managers share prices are hitting all-time highs, with the only industry worry that the Administration would reverse its decision not to negotiate Medicare Part D drug prices, leaving in place a Bush Administration policy.

During the debate, when the interests of insurance companies would have been effectively challenged, that challenge was turned back.  The “robust public option” which would have offered a modicum of competition to a monopolistic industry was whittled down from an initial potential enrollment of 129 million Americans to 6 million.  An amendment which would have protected the rights of states to pursue single-payer health care was stripped from the bill at the request of the Administration.  Looking ahead, we cringe at the prospect of even greater favors for insurance companies.

Recent rises in unemployment indicate a widening separation between the finance economy and the real economy.  The finance economy considers the health of Wall Street, rising corporate profits, and banks’ hoarding of cash, much of it from taxpayers, as sign of an economic recovery. However in the real economy — in which most Americans live — the recession is not over.  Rising unemployment, business failures, bankruptcies and foreclosures are still hammering Main Street.

This health care bill continues the redistribution of wealth to Wall Street at the expense of America’s manufacturing and service economies which suffer from costs other countries do not have to bear, especially the cost of health care.   America continues to stand out among all industrialized nations for its privatized health care system.  As a result, we are less competitive in steel, automotive, aerospace and shipping while other countries subsidize their exports in these areas through socializing the cost of health care.

Notwithstanding the fate of H.R. 3962, America will someday come to recognize the broad social and economic benefits of a not-for-profit, single-payer health care system, which is good for the American people and good for America’s businesses, with of course the notable exceptions being insurance and pharmaceuticals.

So they pretty blew off my Right Foot, actually it was dislocated, and broke three bones… and my Left knee, which had a descending fracture of the Tibial Plateau and a meniscus tear (they repaired the tear 12 years later once the got around to removing the “temporary” hardware that the Right To Work, Tort Reform, Workfare state of Texas had let stay… and stay… and stay some more…

And unseen damage to the LEFT foot and ankle as well.

Finally, after more than a decade of fighting to get any health care at all, to get SSI and Medicaid Finally and THANK GOD FOR “socialized medicine”… they took out the hardware that was supposed to come out after 2 years but turned out to be 14…

The Talus was necrosed. Means it was a dead bone within my foot and ankle.

So more surgery, where they drilled a foot-long hole up through the bones that make up the pivot of the ankle joint, and put in a Titanium shank.

Just so I won’t accidentally step wrong and splinter the damaged and decayed bone structure.

Now, they’ve found two weeks ago, that my Left Talus is the same way.

I heard John McCain talking about “Joe the Plumber” and talking about how Barack Obama was going to take away money from the “hard working Americans” and give it to people who don’t work as hard…

Why should all those poor, indeed Indigent, on food stamps and sleeping on park benches Business Leaders in Colorado Springs have to pay for the toxic waste that runs off their parking lots every damn time it rains?

They probably wouldn’t drink the stuff, unfiltered, that comes off their pavement, but, hey, it’s off their property, must be Somebody Else’s Problem.
And the fact that the filtration processes to get the poison out of the water, those processes, yeah…

They cost money. But the people downstream from Colorado Springs (hint: the entire western United States, Mexico, etc… yeah, those people) they can buy their own filtration processes to get OUR poisons out of THEIR water… and all those lawsuits about it? Pshawww… that’s Frivolous Litigation, haven’t they ever heard of Tort Reform?

They don’t want to drink our urine or feces either, but guess what? the amount of runoff water from the pavement really does FLOOD the same treatment plants.
Both here, and in Pueblo, and Wolf Creek, and Albuquerque, and El Paso, Laredo, Del Rio, McAllen, Brownsville…

Not to mention Juarez, Nuevo Laredo, Acuña, Matamoros, I won’t even mention these because the people who want to dump their waste for FREE don’t even consider Mexican citizens to be human, just “potential wetbacks”. …and that’s just from ONE of the four major watersheds.

We already are being sued by Pueblo, which has a lot of Civil Servants, federal employees, living there.

Also the Military Bases all around have to filter the same wastes from the same water, at public expense. That would be EVERYBODY’S, in the entire nation, expense.

Did I mention that the runoff water also makes it more expensive to treat the Raw Sewage from our toilets? Why, yes, I did, I really really did.

Should I mention, you reckon, that the same people who oppose this “taxation” are the same ones who think it’s a good idea to change their oil in their front yards and not ever have to pick up their pet droppings?

Of course, they’ll try to tell us again that Social Responsibility means Socialism, a word they still try to frighten the working class by using. They’ll also say it’s an unfair burden on the poor, because we’d have to pay higher prices to compensate for the Rich not getting corporate welfare.

Under a plan like that, and work with me here, that would include MEDICAID payments for work injuries that are not covered by Workmen’s compensation AND workman’s compensation.

In other words, you get hurt at work, can’t work, have monstrous hospital bills, one surgery alone would run 15 grand, then suddenly the health care you get because the Subsidized Corporate Welfare collecting sons of bitches who got you hurt in the first place were not maintaining their workplace standards, yeah THAT disability insurance… Now if you get laid up and have 50 grand worth of surgery bills, that puts you in a higher tax bracket…. you are being charged for getting hurt and your BOSS gets to skate away free. What in the name of OSHA cutting Free Market Corporate Welfare kind of shit is that? And if, like myself, you are left holding the bag while the Tort Reform movement has let your boss skip state and reorganize his LLC…. and the Government picks up the tab, YOU and not the irresponsible “Free Market Entrepreneur” who caused the accident get punitive damages put on you.

Perhaps our resident Provocateur Michael can explain how bankruptcy laws can make it impossible for Corporate Citizens to default on their bills, and you can’t touch any money the officers of the Corporate Citizens make after they reorganize, BUT if you try to default on your Income Taxes, the IRS can garnishee your wages, for the rest of your life, to pay off taxable income like the emergency medical services, repair surgery, therapy, and being unemployed…. how exactly is that tort “Reform”?

And remember, before you frame an answer, Der Scheisse-meister was an avid supporter of Tort Reform, and apparently, still is.

Let me summarize that: Go to work without protection of the law.
Boss doesn’t have to comply with EPA or OSHA standards because the enforcement from those agencies have been gutted by the Free Market Capitalists… Get hurt on the job… to the point of being disabled for LIFE… have surgery to save your life and/or limb… COSTLY surgery…
Boss man takes advantage of Free Market Capitalist loopholes in Tort Law, defaults on paying anything for his crime…
the Government steps in and charges you, for the rest of your life, out of your disability payments, or whatever measly work you can scrounge afterward, just by making the health care taxable income.

We Are a Nation Sunk Under Corporate Legal Bullshit

It is often said that we are a nation of laws? That’s certainly true, but just what kind of laws? Are our American laws there to provide protection and justice for the overwhelming majority of us, or are they to codify the privileges of the much tinier US elite, the corporations and their super rich owners?

If you don’t know the answer to that, then try to bring a law suit against a corporation or the corporate government that rules over us. Or what’s more likely to be the situation, try to defend yourself when the elites come after you. Fact is, justice in the US is sold in dollars and cents and if you don’t have the money, you’re going to do the time. You’re going to have your life messed over, and you will have no recourse if you come into contact with the No Justice System.

The corporations won’t go to jail, you will. You will, or you will go into limbo one way or the other. Quite simply, we are not a nation that benefits from having any real justice, but a nation sunk under corporate legal bullshit where justice is routinely turned on its head. It’s your lawyers versus theirs, is it not? Can’t fight city hall, and can’t fight the corporation. Don’t be stupid to think otherwise if you go into the US courtroom.

Did you think that the police are there to serve you? Think again. You are the centerpiece of nothing, Pal. What ever made you think that the US was about justice? Some fairy tale nonsense you learned in kindergarden? Those squads of cops all over the place, those prisons in every city and county? They’re there to protect property, not you. Most of us are lucky to own the shirt on our backs, or some small shed we live in. That’s not property! The cops are a goon squad to keep your sorry ass in line, so that property can be maintained. Not some trinkets that you might have accumulated, neither. Real property. Property you’ll never know or see.

When you watch these show trials over and over again, it’s about property. Manuel Noriega? He went to jail because he messed with US government property, The Panama Canal. Somebody steal your car? So what? That’s not property. Took your wallet? Big deal. Saddam Hussein going to get the death penalty? That’s because he tried to take property belonging to the US and European oil companies.
