WAUSAU, Wis. – An American flag flown upside down as a protest in a northern Wisconsin village was seized by police before a Fourth of July parade and the businessman who flew it — an Iraq war veteran — claims the officers trespassed and stole his property.

A day after the parade, police returned the flag and the man’s protest — over a liquor license — continued.

The American Civil Liberties Union of Wisconsin is considering legal action against the village of Crivitz for violating Vito Congine Jr.’s’ First Amendment rights, Executive Director Chris Ahmuty said.

“It is not often that you see something this blatant,” Ahmuty said.

In mid-June, Congine, 46, began flying the flag upside down — an accepted way to signal distress — outside the restaurant he wants to open in Crivitz, a village of about 1,000 people some 65 miles north of Green Bay.

He said his distress is likely bankruptcy because the village board refused to grant him a liquor license after he spent nearly $200,000 to buy and remodel a downtown building for an Italian supper club.

Congine’s upside-down-flag represents distress to him; to others in town, it represents disrespect of the flag.

Hours before a Fourth of July parade, four police officers went to Congine’s property and removed the flag under the advice of Marinette County District Attorney Allen Brey.

Neighbor Steven Klein watched in disbelief.

“I said, ‘What are you doing?’ Klein said. “They said, ‘It is none of your business.'”

The next day, police returned the flag.

Brey declined comment Friday.

Marinette County Sheriff Jim Kanikula said it was not illegal to fly the flag upside down but people were upset and it was the Fourth of July.

“It is illegal to cause a disruption,” he said.

The parade went on without any problems, Kanikula said.

Tulane kicks Kimberly-Clark off campus!

From the Greenpeace Students’ Network: “Hi ya’ll! My name is Laney White, and I am spring 2009 graduate of Tulane University in New Orleans. I am writing to tell you the great news: Tulane just kicked Kimberly-Clark off campus!!!”

After working with the campus’s Facilities Services throughout the spring semester, my environmental group, Tulane Environmental Action League (TEAL), and I convinced the University to drop Kimberly-Clark, which uses wood clearcut from ancient forests to produce disposable products, in favor of a more sustainable company. Over the course of this summer, Tulane will be making the switch!

Despite obstacles like an apathetic student body, TEAL discovered that the concerted efforts of a small group of individuals could alter how a university chooses to do business. Over a series of meetings with Facilities Services, my student group presented viable alternatives to Kimberly-Clark and provided clear, well-researched arguments for making the switch. Persistence in communication with Facilities was crucial, as was coordinating with potential allies on campus. Tulane’s Office of Environmental Affairs, which is currently working to obtain LEED certification for some buildings on campus, was instrumental in helping make the final push for the switch because the new products will earn the buildings additional LEED points.

As a school located in New Orleans, the Tulane community has a greater stake in climate change and environmental stewardship than the average university. Placed on the frontlines of global warming, the impacts of the clearcutting practices supported by corporations like Kimberly-Clark have the potential to disproportionately affect the Crescent City. Kicking Kimberly-Clark off of Tulane’s campus is a small change that, when joined with the efforts of likeminded students across the country, has the potential to alter the market, change Kimberly-Clark’s practices, and have a huge impact!

I plan to continue my work as an environmental leader and look forward to working with many of you as we work to save the planet from climate catastrophe in the coming years. It is our actions, together, that will determine history and the fate of our planet.

No subsequent war has been about protecting American freedoms, but rather to increase our imperial business interests overseas. Declare another holiday if you must for the blimp-necked brutes who supply the muscle for US belligerency.

Support UFCW Local 7, shop elsewhere

UFCW signUCFW Local 7 workers, the people who look after you at Albertsons, Safeway and King Soopers, may have to go on strike on Saturday in a bid to save their retirement, benefits and hours. As it is they’ve already conceded to wages and work schedules much worse than yours. Do you support them in this fight? Well, you’ll have to figure out where to get your groceries for the next little bit. The more we deny the supermarket chains our business, the shorter the strike will inconvenience us.

Meanwhile however, the search for alternate sources of provisions just might expand your horizons. After you’ve found natural food, fresher produce, or more variety, the big three will have to offer us more of that to lure us back. There are plenty of more traditional grocery stores in town, specialty, natural and discount, where we could be shopping for our food. Check them out.

SPECIAL NOTE: DO NOT go to Walmart, Sam’s Club or Costco, because that’s who’s driving the wages down and giving the supermarket chains the idea that they can treat their workers as terribly.

As a rule too, do not use the auto-checkout machines because they are taking jobs from everyone.

Next to the White House

While visiting Washington DC in March, I found it interesting to note the edifices closest to the White House.
The Executive Office Building

EAST, WEST
The neighbor to the immediate East of the Obama’s White House is the Department of the Treasury. Is that any surprise? Of course not, but how bourgeois! I could imagine Scrooge McDuck sneaking across the White House garden twice a day to check his reserves. To the West is what we now call the Dwight D. Eisenhower Executive Office Building. It’s the site of the suspicious office fires which may or may not have masked a recent vice-president’s misdeeds. The edifice looks straight out of A Series of Unfortunate Events, and check out the plaque which commemorates what the building used to be called:

State War and Navy Departments

Probably that should be no surprise as well: the White house sandwiched between Treasury and War. “State, War and Navy.” How so much less duplicitous than the “Department of Defense.”

SOUTHWEST
Behind the former War offices, to the Southwest of the White House, lies the war memorial to end all war memorials. It’s the WWI Memorial, of considerably diminutive size compared to those commemorations of subsequent wars which have spilled unto the Mall, but its form followed the convention of the typical Great War monuments erected throughout Europe among the nations who had participated.

Except the American version is dedicated to the “Expeditionary Forces” which I just love. That’s what WWI was about for the US. The trenches of Europe were no place Americans needed to defend their freedom. The troops we sent, to relieve France and England, represented a foreign expedition, exactly that. More precisely, our troops were an R&D expedition for our blustering capitalists.

(This may be no time or place to note that history books do not link America’s WWI experience with the Influenza outbreak of 1917-18, which began in the barracks of US soldiers being mobilized for war. American soldiers took their flu to Europe and ultimately killed 50 million people. Those were not the days before we knew better to stay home to prevent infecting others.)

The US entry into WWI was bitterly opposed by a peace movement which the war-opportunist-profiteers maligned as isolationist. Selfish globalization-denying isolationism has been the slander ever since, used against anyone who tries to block military interventions in all their guises.

Ultimately WWI was no affair of ours, had the Huns emerged victorious, American foreign affairs would hardly have changed. Our foreign trading partners would have numbered more Germans, that’s all. But it’s useless to compare alternative outcomes of WWI, all things staying constant, because America participated and profited wildly.

If American investors had not jumped in Over There, the greatest business opportunities of blossoming industrialism would have been missed. The opportunities offered by the Europeans fighting amongst themselves, proved to have been momentous.

And here was the monument to those lost American lives, sacrificed so that American industrial might, in particular the new banking monopolists, could seize the European spheres of influence throughout the world. Of course the lost lives of the American Expeditionary Force were remembered thus:

“…WHO GAVE THEIR LIVES IN THE WORLD WAR THAT LIBERTY AND THE IDEALS OF OUR COUNTRY MIGHT ENDURE”

It would take another World War for the US to appropriate the colonies and oil fields by means of contracts and loans, with the leverage of coming to their aid again, this time armed with lend-lease bills.

SOUTHEAST
To the Southeast of the White House, across the back lawn, lies the monument antecedent to the Great War. It’s the Civil War Memorial, atop which rides the triumphant General William Tecumseh Sherman. (Who, to be fair, presided over the War Department for a long stretch after the Civil War, actually this nation’s longest peacetime period.)

Sherman monumentCurious that I chose to crop his personage from my pictures, but my eyes were drawn to the lesser figures around the base of the monument, in particular, a half naked woman.

The memorial seemed to include various uniformed Civil War participants. How egalitarian to include a woman. But this woman was no French Revolutionary with breast bared oblivious as she rallied her comrades to victory. This delicate woman was unarmed and stripped to the waist, her children in tattered rags at her feet.

Could this statue be offering another conceit to the reality of war, to Sherman’s March to the sea, to the burning of Atlanta, to the shameful destruction he visited on the secessionist South? Was this a nod to the real role given to Women in war, their sons and husbands taken from them, a non-combatant left helpless to defend her children or herself. Did the shirt torn from her body confess to the woman’s rape?

More probably the feminine likeness personified man’s attraction to war, a soldier’s predilection for her beauty. How many war monuments memorialize as they also beacon?

Much of the terrain around the White House grounds is blocked off by secondary and tertiary security perimeters. But for the arrival of bus unloadng its visitors to see it, the Civil War Monument is normally cordoned off. When I had passed it earlier, a balaclava-clad guard was blocking the only entrance.

SOUTH
The grassy expanse immediately South of the White House, permitting the First Family an uninterrupted view of the National Mall, has actually been given over to parking permits. The loop of asphalt across the lawn, with cars strewn diagonally along the edges, gives the unfortunate impression of overflow event parking. In any other neighborhood, the crowd of cars would be a dead giveaway that someone on the block was having a party.

UCSB Hillel students Rebecca Joseph, Tova Hausman highlight poor education

Charges against Professor William RobinsonToday’s university campuses have to deal with College Republicans, ACTA and NeoMcCarthyists. The latest uneducable creeps shopped their leftist-professor- horror-story to the Anti-Defamation League, to brand their teacher’s criticism of Israel as “anti-Semitic.” UCSB senior Rebecca Joseph and junior Tova Hausman both took exception to Professor William Robinson’s Sociology Listserv email comparing Israel’s mop up operation in Gaza to the Warsaw Ghetto. Below are the words they cut and pasted together to accuse Robinson.

The literacy level of these two students is probably on par for Twilight fans, but definitely unbecoming for the University of California system. The first letter is reputedly from a college senior. Rebecca Joseph‘s opening argument was plagiarized from the internet, but she continues to scold Professor Robinson for straying from her idea of what makes a university professor. The second complaint from UCSB junior Tova Hausman copies the first letter’s form, but adds the accusation of sexual misconduct for leaving her feeling raped.

Is it unfair to put simple college students under national scrutiny like this? From their own words they show themselves to be rather helpless. But what to do when students, or some unscrupulous backers, are taking aim at a respected tenured professor? It’s serious business. Organizations like ACTA and Hillel are out to enforce a veritable Right Wing PC rectitude. As if it’s politically incorrect to make fun of uneducated on campus!

Keeping educators silenced was easier during the Bush administration, but the dampers are still on Academic Freedom. Ward Churchill may have won his case in court against the University of Colorado, but opinionated faculty are still few and far between. The latest attack against William Robinson attempts to reinforce more of the same.

UCSB senior Rebecca JosephProbably by now Hillel is wishing they’d coaxed a better educated pair of students to face off against Robinson. The administrators who received the complaint letters should have earmarked the girls for a remedial English refresher in anticipation of their graduation. But let’s look beyond the cheap shots.

The accusations inarticulated here are scurrilous where they are not outright illogical. You be the judge.

First Student Complaint
Here’s the first complaint received by UCSB, from Rebecca Joseph, Vice-president of the Santa Barbara campus Orthodox Jewish Chabad. Interestingly, UCSB has a number of pro-Israel action groups: Hillel, Jewish Awareness Movement on Campus, American Students for Israel, Stand With Us, AIPAC and the Israeli Palestinian Film Festival (which judging by the lineup runs films only by un-self-critical Israelis and sympathetic Palestinians).

Here is Rebecca Joseph’s complaint, uncorrected.

To Whom It May Concern:

On Monday, january 19, at 1:02 pm, I received an email from Professor Robinson for the course Sociology of Globalization (Soc 130SG). The subject of the email was “Parallel images of Nazis and Israelis.” This email compared the aggression of the Nazis to the Jews in Germany, to that which is going on between Palestine and Israel today. Professor Robinson wrote the first three paragraphs including the following: “Gaza is Israel’s Warsaw…” In addition to his few words, he attached an email describing the comparison which goes on to another attachment showing pictures to prove his point.

This email shocked me; before I did anything I gave him the benefit of the doubt and emailed him back asking, “I just wanted to know what this information was for? Is it for some assignment or just information that you put out there for us?” His response was “Rebecca, just for your interest….. I should have clarified.”

At this point I felt nauseous that a professor could use his power to send this email with his views attached, to each student in his class. To me this overstepped the boundaries of a professor and his conduct in a system of higher education. Due to this horrific email I had to drop the course. being a senior and needing any classes I could get, this left me in need of more classes which added more stress.

Two weeks later I saw a friend that was in the course with me and I asked him if it was ever brought up in class or discussed even for a brief minute or two, he responded by telling me that he never even mentioned it in class and that he too would have dropped the course, but he needed it to graduate on time.

Anti Semitism is considered to be hatred toward Jews –individually and as a group– that can be attributed to the Jewish religion and/or ethnicity. An important issue is the distinction between legitimate criticism of policies and practices of the State of Israel, and commentary that assumes an anti-Semitic character. The demonization of Israel, or vilification of Israeli leaders, sometimes through comparisons with Nazi leaders, and through the use of Nazi symbols to caricature them, indicates an anti-Semitic bias rather than a valid criticism of policy.

I found these parallel images intimidating, disgusting, and beyond a teacher role as an educator in the university system. I feel that something must be done so other students don’t have to go through the same intimidating, disgust I went through. I was asked to speak to him and get him to apologize but I feel that it will not make a difference for future students of his.

Whatever the outcome may be, I am hoping for some apology from Robinson, for not only my self and but for my peers in the class as well. In addition I would like to see more happen then just an apology because he has breached the University’s Code of Conduct for Professors and that this issue must be dealt with immediately.

In the Faculty Code of Conduct in Part II, Professional Responsibilities, Ethical Principles, and Unacceptable Faculty conduct, in Section A, Teaching and Students, it states that “The integrity of the faculty-student relationship is the foundation of the University’s educational mission. This relationship vests considerable trust in the faculty member, who, in turn, bears authority and accountability as mentor, educator, and evaluator.”

However Professor Robinson has turned away from his professional responsibilities through his “significant intrusion of material unrelated to the course.” (Part II, Section A, Number 1, b). He has also violated the universities policy by “participating in or deliberately abetting disruption, interference, or intimidation in the classroom,” (Part II, Section A, Number 5). Robinson has done so through this intimidating email which had pushed me to withdraw from this course and take another one.

In the University System professors above all, are to be “effective teachers and scholars,” Robinson has gone against his rights as a professor at the university through his, “unauthorized use of University resources or facilities on a significant scale for personal, commercial, political, or religious purposes,” (Section II, Section C, Number 3). Robinson used his university resources, to email each student in this course to get his view across, in doing so; he became a representation of the faculty members of the University of California Santa Barbara. The code of conduct state that, “faculty members have the same rights and obligations as all citizens. They are as free as other citizens to express their views and to participate in the political process of the community. When they act or speak in their personal and private capacities, they should avoid deliberately creating the impression that they represent the University.” By Robinson using his university email account he attaches his thoughts with that of the university and they become a single entity sharing the same ideas.

The second letter, which cribs from the first obviously, was sent by UCSB junior Tova Hausman. At least she credits the US State Dept as the source of her definition of “anti-Semitism.” But Hausman adds the accusation of sexual impropriety, taking a page it seems from David Mamet’s Oleanna.

My name is Tova Hausman, and I was enrolled in Professor William Robinson’s Sociology 130 SG course this Winter 2009. The course was called Social Globalization. Our class received an email in the second week of class, from the professor, called “Parallel images of Nazis and Israelis.” It discussed the parallel acts and images between Nazi Germany during World War II and the present day Israelis. He claims that what the Nazis did to the Jews during the war is parallel to what Israel is doing to Palestine right now. Professor Robinson clearly stated his anti Semitic political views in this email that were unjust and unsolicited. The department of states 2004 definition of anti-Semitism: Anti Semitism is considered to be hatred toward Jews –individually and as a group– that can be attributed to the Jewish religion and/or ethnicity. An important issue is the distinction between legitimate criticism of policies and practices of the State of Israel, and commentary that assumes an anti-Semitic character. The demonization of Israel, or vilification of Israeli leaders, sometimes through comparisons with Nazi leaders, and through the use of Nazi symbols to caricature them, indicates an anti-Semitic bias rather than a valid criticism of policy……

In all the years of schooling and higher education I have never experienced an abuse of an educator position. Taking the opportunity to disseminate personal political views through obtaining email addresses of the class roster that are only for academic use, show betrayal and complete abuse of powers by the professor. To hide behind a computer and send this provocative email shows poor judgment and perhaps a warped personality. The classroom and the forum of which higher education is presented needs to be safe and guarded so the rights of individuals are respected. handle

To express one’s political views is not necessarily wrong but here it was not relevant to the subject matter. How could one continue to participate in this professor’s class? The fact that the professor attached his views to the depiction of what my great grandparents and family experienced shows lack of sensitivity and awareness. What he did was criminal because he took my trust and invaded something that is very personal. I felt as if I have been violated by this professor. Yes I am aware of Anti-Semites, but to abuse this position in an environment of higher education where I always thought it to be safe, until now, is intimidating.

This professor should be stopped immediately from continuing to disseminate this information and be punished because his damage is irreversible. He abused his privilege to teach, to lead, and to mentor.

The pedagogical relationship between faculty member and student must be protected from influences or activities that can interfere with learning consistent with the goals and ideals of the University. Whenever a faculty member is responsible for academic supervision of a student, a personal relationship between them of a romantic or sexual nature, even if consensual, is inappropriate. Any such relationship jeopardizes the integrity of the educational process.

1. Failure to meet the responsibilities of instruction, including:
(b) significant intrusion of material unrelated to the course;

2. Discrimination, including harassment, against a student on political grounds, or for reasons of race, religion, sex, sexual orientation, ethnic origin, national origin, ancestry, marital status, medical condition, status as a covered veteran, or, within the limits imposed by law or University regulation, because of age or citizenship or for other arbitrary or personal reasons.

5. Participating in or deliberately abetting disruption, interference, or intimidation in the classroom.

3. Unauthorized use of University resources or facilities on a significant scale for personal, commercial, political, or religious purposes.

“Faculty members have the same rights and obligations as all citizens. They are as free as other citizens to express their views and to participate in the political processes of the community. When they act or speak in their personal and private capacities, they should avoid deliberately creating the impression that they represent the University.” (U.C. Academic Council Statement, 1971)

We have received complaints that on January 19, 2009, you sent an email to a number of your student entitled “parallel images of Nazis and Israelis.” If this allegation is true, ADL strongly condemns the views expressed in your email and urges you to unequivocally repudiate them.

While your writings are protected by the First Amendment and academic freedom, we rely upon our own rights to say that your comparisons of Nazis and Israelis were offensive, a historical and have crossed the line well beyond legitimate criticism of Israel.

In our view, no accurate comparison can be made between the complex Israeli-Palestinian conflict and the atrocities committed by the Nazis against the Jews. Nor can Israeli actions or policies be fairly characterized as acts of ethnic cleansing or genocide. Unlike the Holocaust (and to more recent examples of genocide and ethnic cleansing in Darfur, Rwanda and Kosovo), there is no Israeli ideology, policy or plan to persecute, exterminate or expel the Palestinian population — nor has there ever been. In direct contrast, the Nazis’ “final solution” to the “Jewish problem” was the deliberate, systematic and mechanized extermination of European Jewry. Hitler’s “final Solution” led to the calculated, premeditated murder of six million Jews and the destruction of thriving Jewish communities across Europe.

We also think it is important to note that the tone and extreme views presented in your email were intimidating to students and likely chilled thoughtful discussion on the Israeli-Palestinian conflict. Clearly, that is antithetical to the very purpose of the academy. Finally, using your university email address to send out material that appears unrelated to your Globalization of Sociology course likely violates numerous parts of the University of Santa Barbara Faculty Code of Conduct (see, for example, Part I, 2; Part II, A, 1, b; Part II, C, 3; Part II, E, 1).

Again, ADL strongly condemns the views expressed in the January 19, 2009 email and we urge you to unequivocally repudiate them.

And yes, I did offer you an opportunity “if you wish” to provide a written response to the complaint before I met with the Charges Advisory Committee, which is solely vested with the authority to dismiss a complaint as frivolous and unfounded.

And let’s not overlook the attempts to initiate an email campaign to bring public pressure on UCSB to reprimand Professor Robinson. A commenter to this blog linked to a website advocating a form email to convey (our) universal indignation over the anti-Semitism at UCSB. The form letter is suggested by “anonymous” (possibly Alvin Black aka Dr. Mike) and he recommended signing it “Name withheld to protect privacy.” We reprint the opening and closing here:

Dear Chancellor Yang,

As I am sure you know, several months ago, Professor William I. Robinson, a self described “scholar -activist” and professor of Sociology and Global Studies at your university, forwarded an email to his students condemning Israel. The email contained images of Nazi atrocities along with images from Israel’s defensive campaign against Hamas’s terror. This comparison is considered by both the US State Dept and the European Union, in their working paper on anti-Semitism, to cross the line into anti-Semitism. This email was so disturbing to at least two students that they felt compelled to drop his class. Because of the nature of the emails, the Anti-Defamation League, as well as the UCSB Academic Senate’s Charges Committee have become involved.

Isn’t that what this post is about actually? We’ve aggregated the criticisms flying against Professor Robinson, but most notably this article seeks to expose the UCSB students who led the faceless attack against Professor Robinson.

Until the Los Angeles Times revealed their names today, the identities of both Joseph and Hausman had been concealed. Even the specific complaints they brought against Robinson were kept secret from the accused himself. Now, what kind of people insist on slandering others from the shadows?

At NMT, we make ourselves known, while many of our detractors do not. We could not care less, but if apologists for Israel’s crimes consider themselves in the right, why do they hide behind aliases?

If you support Israel’s “right to defend itself” by breaking international conventions and committing war crimes, stand up and say it. If you think Israel has every right to take the land of the Palestinians and keep it, Goddamn it come out from behind your creepy disguises and say it. If you’re going to impugn others for whatever false transgression, without the courage to reveal yourself, do you expect anyone to accord you credibility?

If you are going to condemn the Palestinians of Gaza for exercising their basic human right to resist an illegal foreign invasion and occupation of their land, you better have the nerve to say it publicly. Cowards.

The same Corporate Sucks or their demented twins who derided any suggestion that the overcrowded overmedicated animals in the Meat Factories aka Concentrated Animal Feeding Enterprise system could possibly be a huge breeding pool for Viral diseases, such as for instance Influenza and resistant bacterial strains like the MRSA and Tuberculosis SuperBugs which are resistant to every antibiotic known.

Or that feeding them antibiotics, which kill bacteria but not Viral infections, leave the immune systems of the Future Hamburgers and Kentucky Fried weakened, thus more susceptible to, oh, let’s seeeeee…. Bird Flu and Swine Flu.

There was another series of commercials a couple of years ago, where a hideously deformed troll gets on a city bus, hacking and sneezing and wheezing, everybody recoiling in fear….

Then he takes an over the counter Flu remedy and gets “all better”…

Those Mexican Swine

Pork industry spokespeople are trying to take the focus off the large factory hog farms operated by Smithfield Foods in the vicinity of La Gloria, MX, where the outbreak started. Smithfield is the largest supplier of US pork.

BTW You can track H1N1 Swine Flu developments via Veratect on Twitter. Keep in mind Veratect is a government intelligence corporation.

Swine Flu is no communicable via the consumption of pork. In fact, according to Smithfield, no hogs have been diagnosed with the disease. Although we have only their word on that. The hogs may be asymptomatic. But the pork industry, and I’m guessing the major players, primarily Smithfield, are too big to fail, and are doing what they can to have broadcasters and public officials come up with another name for Swine Flu.

But I’m not sure we shouldn’t be scrutinizing the swine from the vicinity of a Swine Flu outbreak. It’s not the Poor Hapless Mexican Flu for example. Does Smithfield think its swine do not stink?

You can’t get Swine Flu by eating pork, but you can chose not to consume the products which keep the industrial “confined animal feeding operations” (CAFOs) in business. In this particular case, Smithfield Foods subsidiary Granjas Carroll in Veracuz, Mexico. Smithfield is “the leading processor and marketer of fresh pork and packaged meats in the United States, as well as the largest producer of hogs,” and has issued a formal denial of any Swine Flu link to its facilities.

If you are inclined to pass, for now, on Smithfield pork products, the domestic brands are John Morrell & Co., Armour-Eckrich Meats (Armour, Eckrich, LunchMakers, Healthy Ones, Margherita, Mayrose, Schickhaus, Corando), Curly’s Foods, Patrick Cudahy (Riojano/El Nino), Farmland Foods, Cook’s Ham, North Side Foods Corp., Stefano Foods, and Smithfield RMH Foods.

Less easy to see are Smithfield’s supply lines to restaurants. Smithfield provides the ham products to McDonalds and Subway.

The Big-Agra corporations involved are The Smithfield Packing Company, Cumberland Gap Provision Co., and Smithfield Specialty Foods Group, represented by porcine spokeswoman Paula Dean.

Maybe Ms. Dean wants to take her Porky Pig empathy embodiment act a step further, to lead a sun-less existence of a factory farm inmate.

We are told that as a consequence, Madoff doesn’t have to tell anyone where he buried the treasure. Meanwhile his accomplices are being charged and are proclaiming themselves innocent.

Okay, I didn’t know that not plea-bargaining means not having to say you’re sorry, or divulge where you took the loot. I didn’t know that when Kenneth Lay died, it meant that because his appeal could then never be exhausted, his wife and family got to keep the money. An appetizing pattern emerges…

Can you imagine a parade of white-collar-criminal bunkmates sidling up to Madoff in prison, hoping to learn the whereabouts of his vanished bullions (who saw that pun coming)? Nor can I. Michael Milken –now a financier and philanthropist–had plenty of business suitors waiting to hire his larcenous consultation when he was released. Paper crimes don’t garner severe prison sentences. Whether Madoff has a felony on his record or not can hardly hinder his future prospects.

Madoff has a very good reason to plead guilty. It’s a bit like the Kenneth Lay play-possum legal strategy. Let’s remember Bernie Madoff couldn’t even afflict himself with jail. He remained out on bail in his luxury penthouse, until his day in court. Since then where has he been? Have YOU seen him? Are you sure he’s where authorities say he is?

I’m convinced that Bernie has a plan to stay out of the penal system. And it doesn’t involve a jury verdict.

I’d guess with just a fraction of his loot, he can pay off the very few administrators involved to handle the paperwork to incarcerate someone in his place. No visitors, no outsiders to know. It won’t be Bernie doing the time, it’ll be a stand in. Maybe as simple as a real inmate, written off as released, but reissued Bernie’s ID. No cosmetic surgery necessary, what’s the probability that prison guards know what Bernie Madoff looks like anyway.

If Bernie had to go back and forth to court, he’d have to do be there himself. Being seen by too many people.

In prison, rather, not in prison, Madoff can live the rest of his years on a private estate, miles from onlookers, his fence-line probably abutting Kenneth Lay’s.

The DTCC history show 2 events that pushed this corporate outfit to the head. One was Bill Clinton’s deregulation of securities signed into law in 2000 at the end of his presidency, and the other was 9/11.

Q. I have heard that many securities were lost on 9/11. Is that true?

A. Yes, although they were eventually all replaced. Some $16 billion worth of certificates disappeared in the collapse of the World Trade Center towers on 9/11, and it took many months and nearly $300 million in industry costs to replace them. During this period, electronic records were used to ensure the owners of the securities could be identified. Meanwhile, shares held electronically were not harmed at all on 9/11.

OK, that’s nice…. And here, written in 1999 about the Clinton Administration’s proposed financial deregulation of that year that then later allowed the rise of even more speculative securities and the eventual domination of DTCC over the securities market, is the following…

***Threat to financial stability***

The proposed deregulation will increase the degree of monopolization in finance and worsen the position of consumers in relation to creditors. Even more significant is its impact on the overall stability of US and world capitalism. The bill ties the banking system and the insurance industry even more directly to the volatile US stock market, virtually guaranteeing that any significant plunge on Wall Street will have an immediate and catastrophic impact throughout the US financial system.

The Glass-Steagall Act of 1933, which the deregulation bill would repeal, was not adopted to protect consumers, although one of its most celebrated provisions was the establishment of the Federal Deposit Insurance Corporation, which guarantees bank deposits of up to $100,000. The law was enacted during the first 100 days of the Roosevelt administration to rescue a banking system which had collapsed, wiping out the life savings of millions of working people, and threatening to bring the profit system to a complete standstill.

As a recent history of that era notes: “The more than five thousand bank failures between the Crash and the New Deal’s rescue operation in March 1933 wiped out some $7 billion in depositors’ money. Accelerating foreclosures on defaulted home mortgages—150,000 homeowners lost their property in 1930, 200,000 in 1931, 250,000 in 1932—stripped millions of people of both shelter and life savings at a single stroke and menaced the balance sheets of thousands of surviving banks” (David Kennedy, Freedom from Fear, Oxford University Press, 1999, pp. 162-63).

The separation of banking and the stock exchange was ordered in response to revelations of the gross corruption and manipulation of the market by giant banking houses, above all the House of Morgan, which organized huge corporate mergers for its own profit and awarded preferential access to share issues to favored politicians and businessmen. Such insider trading played a major role in the speculative boom which preceded the 1929 crash.

Over the past 20 years the restrictions imposed by Glass-Steagall have been gradually relaxed under pressure from the banks, which sought more profitable outlets for their capital, especially in the booming stock market, and which complained that foreign competitors suffered no such limitations to their financial operations. In 1990 the Federal Reserve Board first permitted a bank (J.P. Morgan) to sell stock through a subsidiary, although stock market operations were limited to 10 percent of the company’s total revenue. In 1996 this ceiling was lifted to 25 percent. Now it will be abolished.

The Wall Street Journal celebrated the agreement to end such restrictions with an editorial declaring that the banks had been unfairly scapegoated for the Great Depression. The headline of one Journal article detailing the impact of the proposed law declared, “Finally, 1929 Begins to Fade.”

This comment underscores the greatest irony in the banking deregulation bill. Legislation first adopted to save American capitalism from the consequences of the 1929 Wall Street Crash is being abolished just at the point where the conditions are emerging for an even greater speculative financial collapse. The enormous volatility in the stock exchange in recent months has been accompanied by repeated warnings that stocks are grossly overvalued, with some computer and Internet stocks selling at prices 100 times earnings or even greater.

And there is a much more recent experience than 1929 to serve as a cautionary tale. A financial deregulation bill was passed in the early 1980s under the Reagan administration, lifting many restrictions on the activities of savings and loan associations, which had previously been limited primarily to the home-loan market. The result was an orgy of speculation, profiteering and outright plundering of assets, culminating in collapse and the biggest financial bailout in US history, costing the federal government more than $500 billion. The repetition of such events in the much larger banking and securities markets would be beyond the scope of any federal bailout.

In fact, a ‘US Kicks Ass Solution’ is behind this new ‘Road to Peace’ where Israel shall be allowed by the US to totally militarily dominate the region as Pentagon servant. And the United Nations is totally on board with the US, too!

In reality, the use of only military, military might alone, is no ‘solution’ on a ‘road to Peace’, and is the complete opposite of that. Barack Obama is just the latest camouflage, in place for this official apparatus of the Two State Solution peace-process industry. The basic game plan is still just more US-made war until the other side totally collapses.

However, the more-war-until-the-other-side-totally-collapses might just well be leading to US total economic collapse. Over the long haul we’ll hardly ever get any real Peace, and certainly that is the case with this parallel economic collapse in process. Meanwhile, the blah, blah, blah goes on and on and on. The dominant elites want ‘Peace’ without Justice, as is always the case.

The only real Peace will be when Palestinians are given their rights and that includes being allowed to be equal partners inside what Zionists now call, the ‘Jewish State’. Can racist America ever come to allow racist ‘Jewish State’ Israel to cede to these just demands? Will we ever seek a ‘One State Solution’ in that treats all as equals? We hardly have that in America, let alone the Middle East. And there is no official peace-process industry that is yet working to dismantle the US war making machine.

Israel and the surplus Passover bread

I thought the NPR human interest story about Passover was going to be a PR piece: What do Israeli Jews do with their leavened bread during Passover, when religious observance forbids not just the consumption of bread, but the possession of it? What do Jewish bakeries, grocers, eateries, distributors and warehouses do with their un-unleavened inventories? I’ll bet you were going to guess that they give it away!

Not to other observers of Passover obviously, but to non-Jewish needy maybe, who can eat it.

No doubt Israeli Jewish bread purveyors schedule inventory reductions to coincide with Passover. But according to the news segment, the mass of raised dough, for the brief Passover hours untouchable to Jewish adherents, regularly amounts to $150 million, every year. So what do they do with it?

Well according to NPR, here’s the deal.

On paper, the bread is entrusted to the governing rabbis, who make a collective deal with a single cooperative non-Jew. This Israeli Arab agrees to purchase the lot, by making a down-payment, with the proviso that he cannot take delivery until the balance is paid, and a further understanding that he will intentionally default on the transaction. He joked with the reporter that every year he falls short of the sum required. When the Passover restriction lifts, possession of the bread reverts to its Jewish owners, whose premises it never left, physically. The stock goes back on the books, and everyone is back in business.

No details about whether this is how Jewish communities have always overcome the Passover prohibition. Which we might assume has been a pressing challenge for centuries. And to be fair, the restriction was never about divesting of the bread, or being charitable, but more about commemoration through sacrifice, the flight from Egypt when Jews were compelled to take with them only unleavened bread.

So this news segment was not a heavy handed PR message about the piety of Israeli Jews, but a subtle glimpse into the pragmatic world of Judaism. Either message serves to familiarize the 98% of Americans who are not Jewish, with the daily life of Israelis. Though Israel may be a foreign nation, with the foreign concept of a state religion, the people of Israel are otherwise close kin of the white European Americans, as their blood-surrogate claimants to the Holy Land.

If you’re still wondering about the Arab Israelis who could have been in line for day old largess, don’t worry, this segment had that loose end tied up.

This drew incredulous prompts from nearby Israeli Jews. Why would Arabs chose Matzo, the poor man’s bread, without being obligated?

But so says NPR. There it is. So no one’s missing the uneaten bread.

The lingering motif being, that while religious differences may remain, in terms of baked-goods gastronomy, Arab Israelis are wannabe Jewish Israelis.

God’s Chosen People, America’s chosen cousins, are even their captives’ chosen masters.

How are police an economic stimulus?

A first application of stimulus funds went to rescue law enforcement jobs in Ohio. Barack Obama was on hand to herald their taking the oath. Are you wondering how policemen meet the criteria used to justify taxpayer monies supposed to stimulate growth and common wealth?

Aside from the obvious, raising income for municipal entities, through fees, court costs, and social services. More action for the penal system, much of that already a growing private sector.

There would also be the police function of assuring stability, which encourages confidence in business investment. Or is that getting ahead of our recovery narrative?

More police anticipates America’s rising unemployment, and rising unrest. When the public faces repossessions, foreclosures, padlocked factories, and a drastic reduction in the supply of even the basic needs, local police departments are going to be the front line government service to teach the “tough love.”

Quality DysControl Syndrome

quality controlQuality DysControl Syndrome is what dominates our economic activity though it wasn’t supposed to be this way according to Big Business. They said self regulation was best but we can easily define Quality DysControl Syndrome as being the exact polar opposite of Quality Control, which is only produced from external regulations being enforced.

Regulations like meat examinations to make sure that there is no trichinosis in the pork, e-coli in the beef and so on. Regulations that routinely put chlorine and fluoride in the tap water, and make sure that raw sewage or mercury is not just dumped off into the lakes, or that brakes don’t routinely fail on cars due to poor quality of raw materials or poor design of the product, etc. If you don’t have regulations in place you most often get Quality DysControl Syndrome. That’ what we got in most cases.

Why is there so much Quality DysControl Syndrome and so little Quality Control in our economic life? The answer is easy to see and is simple. Quality Control costs much more upfront than lack of Quality Control ever does. However, Quality DysControl Syndrome eventually costs so very much more over the long run, but unfortunately for society, those additional costs can be hidden and then later passed on far away from the original point of production.

Colorado Springs government and police continue to lie about their raids on the Homeless

liars myersHOMELAND INSECURITY REPORT- The CS police, under the direction of Police Cap Ricky ‘Liars’ Myers, are continuing to fudge and pretend their innocence about their raids and harassment against the Homeless population in the city, on behalf of the Business Community which simply hates these unfortunate people. They want them all gone but can’t find a way to get it done without attracting public attention. So they have to play all sorts of mind games using the local press as conduit for their song and dance.

‘The cleanups first received negative publicity last fall after homeless advocates charged the monthly sweeps include improper searches and that personal belongings are routinely tossed out. The ACLU contends the cleanups violate the Fourth Amendment and the Colorado Constitution. ….. In bullet-point fashion, ACLU staff attorney Taylor Pendergrass describes its findings after it “interviewed dozens of persons who claimed to have had private property seized and destroyed by CSPD and KCSB.” Among them is that the cleanups were typically unannounced and conducted when homeless people were away from their camps and couldn’t protect their belongings. “Numerous different CSPD officers have been involved in seizing and destroying property, but many interviewees consistently identified CSPD Officer’s Olav Chaney and Tracey (sic) Fox,” Pendergrass wrote in the letter.’
